The following conditions must be met in order for the market to operate: 1. All vendors shall be restricted to the area depicted on the site map. 2. No vendor shall be allowed within the right-of-way of Market Boulevard. 3. Each vendor shall comply with all state and local regulations and provide proof of appropriate liability insurance. A member of the farmer' s market board shall be on the premises during weekly set-up, operation, and take-down of the market. 6. To ensure that local government units are treated equally, the Minnesota Department of Transportation (Mn/DOT) has developed a Policy Guideline for Cost Participation to be used on all Mn/DOT projects. This policy is being used for determining the cost participation responsibilities for each local unit of government involved with the TH 212 Design Build project. The City of Chanhassen has requested the expansion of many city trails as part of the scope of work for the TH 212 Design Build project. This request includes four crossings along TH 212, within the Chanhassen city limits, that currently do not exist. The Department has fully sponsored three of the four requests. Those locations are Pioneer Trail, Powers Boulevard and Lyman Boulevard. The fourth location is the Bluff Creek underpass that is located less than 1000 feet from the pedestrian crossing at Pioneer Trail. Due to the location of this crossing in relation to the Pioneer Trail crossing, the Department has determined that the City of Chanhassen will be responsible for this request. I am writing to clarify Chanhassen's position on the planned Highway 212/312 Bluff Creek pedestrian underpass. This improvement has been anticipated since the official mapping of the proposed highway. Bluff Creek and the Bluff Creek preservation corridor represent a major north/south linkage in Chanhassen's pedestrian trail system. At present, the Bluff Creek trail passes under Highway 5, Coulter Boulevard, and the Twin Cities and Western Railroad. An underpass at Highway 212/312 will extend this trail route to southern Chanhassen. Chanhassen has experienced great success in developing its comprehensive trail system as a component of the private development process. We incorporate the construction of the majority of our trails into development contracts between the City and developers. Depending on the language of the agreement, the costs associated with the construction of the trails may or may not be eligible for reimbursement from the City. Under this arrangement, a limited number of future trail sections are scheduled into a capital improvement program. We anticipate that the section of the Bluff Creek trail extending from Lyman Boulevard to the new Highway 212/312 corridor will be constructed within the next five years concurrent with the private development of the 2005 MUSA area. We are aware that pedestrian underpasses and overpasses associated with the TH 212/312 project in other cities are programmed as MnDOT-sponsored improvements. I respectively request that Chanhassen receive the same treatment. Again, thank you for taking the lead on this project. Justin Larson of Sathre-Berquist, Inc., representing the applicant, was present. Upon conclusion of presentations and discussion by the Commission, the following recommendation was forwarded: "Commissioner O'Shea moved, Commissioner Atkins seconded to recommend that the City Council require the following conditions of approval regarding parks, trails and trail connectors for Settlers West. An internal trail or sidewalk connection to the Southwest LRT Trail shall be constructed. Appropriate public easements or outlots shall be dedicated to accommodate said trail. A sidewalk along Settlers West Road be constructed, connecting the entire neighborhood to the Richard T. Anderson ConserVation Area, and that appropriate public easements or outlots be maintained to facilitate this connection. 3. I have interpreted your letter to state that the CAA will be receiving remaining fields if any, after other organizations Aapproved@ by the Chaska Park and Recreation Department have been allocated. The agreement between The City of Chaska and School District 112 states that the responsibility of the Chaska Park and Recreation Department is to schedule fields in accordance with school district facility use policies. The agreement does not empower the Chaska Park and Recreation Department to certify organizations as worthy of facility use. The CAA expects School District 112 to be the certifying organization, since Chanhassen residents have funded the facilities equally. As a Chanhassen resident and taxpayer, I certainly do appreciate the intent and spirit of the agreement, recognizing the cooperative cost savings opportunity to all taxpayers. Proper interpretation of this agreement, however, remains a priority with CAA members, and certain terms require amendments to ensure equal access of school district facilities to all taxpayers. The execution of this agreement, as apparently interpreted by the City of Chaska, certainly does not afford the intended value to School District 112 residents who are CAA members. The CAA expects the school district to allocate indoor facility use according to organizational headcount, instead of prior year=s requests or program specifications. In past years, for example, The Chaska Basketball Association (CBA) has received 70% of the gym space, when they only own 55% of the total District 112 registrants. The CAA has accepted registrations from 45% of the people in our school district, and expects 45% of the available facilities. The CAA understands that CBA offers travel programs that they believe requires more gym time for competitive reasons. We fail to understand, however, what that has to do with taxpayer rights to equal access. The CAA intends to protest the use of ADistrict 112@ in the name of any organization that is not affiliated with the school district. Use of a school name, logo, or official identification, implies endorsement by the school district. I can choose to register my children in other programs, but there is a clear difference between the CAA philosophy, and that of other organizations. I do not believe, for instance, that cutting 10 year old children, or creating elite teams is healthy for kids or a community. I have a right to exercise that choice without prejudice from the school district, unless the school district is holding public hearings in support or opposition to specific recreational programs. Without a certification process, the school district is improperly permitting the perception of endorsement, when no such endorsement exists. It is time for the District 112 School Board to draft a certification policy for facility use of taxpayer owned property. I, for one, have found no child development literature that supports elitism in youth sports, or cutting kids, or demonstrating any form of discrimination based on athletic ability or physical size. I have found plenty of literature, however, to support the h. In-HouseO concept until at least age 12 years old. I do not believe that a school district should permit use of school district facilities to organizations that offer programming that is contrary to our school district=s mission. Just because the school district does not manage youth sports does not mean the school district has no involvement in how the school district facilities are used. This very conflict between the CAA and The City of Chaska is a prime example of what happens when a school district washes it=s hands of youth sports. These facilities belong to the public, the school board members are voices of the public, and the school district staff executes the public will. The 2,400 voting members of the CAA expect equal access to facilities, expect that all public use meet missionary expectations, and expect that facilities be fairly and properly manage in accordance with public policy. Finally, I would like to understand what right the Chaska Park and Recreation Department has to judge the hard work of citizens and city employees who are doing nothing more than trying to manage programs in the best interests of their own community. Your letter implies that CAA members and City Staff in Chanhassen are not committed to the welfare of the entire District 112 community. I can argue that a Park and Recreation Department that believes in cutting ten year old children, and giving preferential treatment to elite athletes is not representing the whole community. Shame on you for believing that you know more about what is good for my family than I do. The Chaska Park and Recreation Department should stick to managing within the scope of your duties, on behalf of the people that pay your salaries, instead of policing how other communities' manager their affairs.
