A trail easement does exist at this location and it is currently being utilized informally. The city, per a 1983 development contract, is responsible for the installation of an improved trail surface. This work has not been completed to date. The mailing discussing the request for a private dock at Carver Beach prompted a resident to call and inquire about the connector. The attached letter was mailed to residents in the vicinity of the trail during the first week in January. The two responses received to date are attached. I have ordered a survey of the two property lines in question. Prior to reviewing this issue with the neighbors, it would be helpful if Commissioners could take the time to visit the site. You can view the trail from either the Fox Chase or Carver Beach side. A map is enclosed, I suggest that the Commission take public comment and offer staff guidance at your January meeting. I thought it might be helpful to memorialize our discussion and to formally state my position on the matter of the new pathway. My wife and I want to support a path to be created between the Hedlund's and our property. However, there are several issues that need to be resolved before we can support the proposal: It is our present understanding that the easement on which the path is proposed is entirely our on property at its north to south boundaries. This would only be an issue for us if the planned path encroaches on already improved property. Given that there is not much room between the house and the easement, the path would be extremely close to our home and would reduce our usable property, among other things (if improved property were effected)~ Given the proximity of the proposed public pathway to our home, I am also concerned about the impact to the value of our home and a reduction in our level of privacy~ The pathway will create increased public traffic to and from the lake area (already a problem). This will act to further reduce the level of privacy around our home. Does the City propose fencing or other means of protecting privacy for us and the Hedlunds? Also, during the spring and summer months, non-neighborhood and neighborhood visitors like to drive up to the entrance of the path for access. This creates unsightly parking and traffic in front of our home and adjacent properties, often until late in the evening. Additionally, trash seems to accumulate along the current unimproved path and on our property. Will the City be maintaining the area? If not, then what is the plan to prevent trash accumulation? The creation of a pathway will increase motorized traffic (motorcycles and snowmobiles) despite any proposed threatening signage forbidding such use of the path. Noise associated with these activities will significantly reduce our ability to have "quite enjoyment" of the property. This issue is potentially a huge show-stopper for us. Unfortunately, not everyone is considerate. We already have snowmobilers, bicycle riders, etc., using our front lawn and side areas to access the unimproved path and the lake area. I have no reason to believe that folks will be more considerate once new path is created or if a sign is installed. What does the City propose on this point? I would like to review the detailed plans with you to better understand the project. Plans might also include a notion of how the path would be built without accessing personal real estate on either side of the easement. I understand that a key next step includes a determination/measurement of the easement with respect to my home and the proposed path. From this activity we will be able to determine the extent to which any existing improved property would be taken as a part of the proposed project. Following this determination you and I agreed to conference and evaluate the other issues, assuming no problems with the intended location of the path. To expedite things, you may want to consider meeting jointly with the Hedlunds and us. Again Todd, we'd like to support the project but cannot until such time as the City has reviewed this project with sharper vision, thttil such ti, re as zt;e zt~ork through these points, ~t;e remain staunchl!t opposed to the project. I am also aware of the concerns and issues offered by the Hedlunds. I strongly support their objections/concerns as well. Just as an aside, I'm wondering why, if neighbors already use the path for access, are we trying to improve it... perhaps it is so that more people will use it? I'm not certain that's a good idea with respect to my property and the Hedlund's. Let's talk after your evaluation. Todd, thanks again for you help on this matter.
