SUMMARY OF REQUEST: The developer is requesting an Interim Use Permit to grade property for construction of a parking lot expanison and stormwater drainage improvements. LOCATION: 6421 Hazeltine Boulevard (Minnetonka 0i Middle School West) (PID 25- 0030000) APPLICANT: Minnetonka Public Schools District 276 5621 County Road 101 Minnetonka, MN 55345 PRESENT ZONING: 2020 LAND USE PLAN: ACREAGE: 30.3 acres Office Institutional (OI) Public /Semi- Public DENSITY: 0.1 F.A.R. LEVEL OF CITY DISCRETION IN DECISION - MAKING: The City has limited discretion in approving or denying interim use permits, based on whether or not the proposal meets the standards outlined in the Zoning Ordinance and city code. If the City finds that all the applicable standards are met, the permit must be approved. This is a quasi - judicial decision. Notice of this public hearing has been mailed to all property owners within 500 feet. PROPOSAL /SUMMARY The applicant is requesting an interim use permit to grade in excess of 1,000 cubic yards for the construction of additional parking spaces and the installation of storm water drainage improvements on the site. The proposed parking expansion will permit more convenient access and greater utilization of the pool. In addition, Inspec provided a Surface Water Pollution Prevention Plan and a HydroCAD summary report. Inspec and ISD 276 made efforts to communicate with the city early on and that has made for a clean, accurate plan with few additional changes necessary. APPLICABLE REGULATIONS Chapter 7, Article II, Excavating, Mining, Filling and Grading Chapter 20, Article IV, Division 5, Interim Use Permits Chapter 20, Article XXI, "OI" Office and Institutional District BACKGROUND The school is completing an addition and upgrade to the swimming pool area (located on the south end of the building) and an alteration and upgrade to the physical heating plant. On January 24, 2011, the Chanhassen City Council approved the interim use permit to permit site grading for the tennis courts at Minnetonka Middle School West, Planning Case #2011 -01 On February 27, 2006, the Chanhassen City Council approved Interim Use Permit #2006 -03 to permit the grading of approximately 3,400 cubic yards for an infiltration basin and drainage swales to reduce downstream erosion and sedimentation along Highway 41 (Planning Case 92006 -03). On June 9, 2003, the Chanhassen City Council approved Interim Use Permit #2003 -02 to permit grading in excess of 1,000 cubic yards to install a storm water pond and reconfigure the bus circulation route and parking area on the north side of the school. ANALYSIS The applicant is expanding the parking lot to add 51 parking stalls and install a storm water filtration swale. The entire parking area will then be restriped. STORM WATER MANAGEMENT The project proposes to disturb 2.42 acres and add 0.61 acres of new impervious. In order to provide treatment and rate control for the new impervious area, the applicant is proposing a filtration feature located southwesterly on the property. Water will discharge from the filtration swale through an underdrain into the existing storm sewer system before being discharged into the pond which was constructed with the water tower. The pond has yet to have an as -built survey performed: however, the proposed pond design will have adequate storage to accommodate the increased storm water load. The design calls for water to enter the filtration swale via six curb cuts. The applicant is proposing to use a field stone rip rap to dissipate energy into the filtration swale. Staff would recommend that a pre - treatment forebay is installed at the location of the curb cut instead. These will allow for easy maintenance and will prevent failure of the system as a result of Planning Commission Minnetonka Middle School West IUP — Planning Case 2014 -01 January 7, 2014 Page 3 of 6 sedimentation causing a reduction in the permittivity of the soils. Anoka County and others have developed relatively simple forebays that would be suitable. The detail for the drainage swale calls for the use of MNDOT 25 -141. MNDOT and BWSR have compiled their seed mixes to develop state seed mixes. State seed mix 25 -141 is not appropriate for the intended use as it a mesic general roadside ditch mix with limited deep rooting plants as would be needed in a filtration swale. State seed mix 33 -260 (Dry Swale /Pond mix) or equivalent shall be used instead. The design calls for up to 35% pulverized top soil. Under MNDOT specifications, topsoil can have up to 40% clay content. This is unacceptable for a filtration feature. The plan shall call out MNDOT 3877 Filter Topsoil Borrow or shall otherwise limit the clay content to less than 5% of the topsoil portion. Most references to perforated pipe with a sock have been removed with the exception of detail 11 — "Drain Tile Cleanout" on page C5. Remove the reference to sock. As this filtration swale will be privately owned and maintained, an operations and maintenance manual must be developed and provided to the City for review, comment and approval. This O &M should address annual inspections as well as anticipated maintenance requirements. GRADING, DRAINAGE AND EROSION CONTROL The existing parking area directs water from east to west, where manholes with grated covers receive the stormwater runoff. The manholes are located on the west side of the parking area and the south side of the school. This storm sewer system carries runoff to a storwnwater pond on the southwest side of the school. The proposed design will move an estimated 2,400 cubic yards of material, including i T L .• ... 8R£NC➢N ". reclaimed pavement from the parking area. It will expand the parking area by lowering a hill southeast of the parking lot and paving it for new parking spaces. The parking area will have curb and gutter to direct water flow. It will be graded to ensure runoff will flow from east to west across the parking area and toward the manholes with grated covers near the school. This grading will mimic the existing drainage pattern. In the plans, the applicant shall note the current and proposed style of the grated manhole covers. The proposed design also includes construction of new bio- filtration cells on the south side of the school. The bio - filtration cells will collect and divert runoff to the existing stormwater pond. The driveway south of the school will have curb with drainage cutouts that will direct runoff to the new bio - filtration cells. The hill south of the school will also be altered to direct water to the bio - filtration cells for entry into the stormwater system. A $5,000 escrow to guarantee restoration and erosion control measures will be required with the permit. Planning Commission Minnetonka Middle School West NP — Planning Case 2014 -01 January 7, 2014 Page 4 of 6 Staff will require that the applicant provide a proposed haul route for review and approval. This site will cross the minimum threshold for a National Pollution Discharge Elimination System permit. The applicant must apply for and receive authorization under this permit prior to any earth - disturbing activities. Inlet protection shall be shown on all catch basin and catch basin manholes with the potential to receive sediment -laden water as a result of this project. Inlet protection shall also be placed at all curb cuts until the filtration swale is stabilized. The applicant is strongly encouraged to provide inlet forebays at the curb cuts. This will reduce long -term maintenance costs and increase the effectiveness and lifespan of the filtration swale. At a minimum, the O &M manual must indicate how sediment deposition within the swale will be addressed and how the effectiveness of the practice will be measured. An as -built grading plan is needed at the completion of site grading to ensure compliance with the approved grading plan. RETAINING WALL A retaining wall is proposed south of the school, in the side of a small hill near the bio- filtration cells. The face of the wall is toward the south side of the school. The proposed wall is a maximum of 5.5 feet tall. The wall design shall be a concrete segmental wall with a chiseled finished face. The grading plan shall be revised to show the retaining wall. PARKING LOT s The parking lot meets the Chanhassen City Code requirements of 9'x18' minimum stall dimensions, as well as the 26' wide driving aisles for 90° parking spaces. There are 5 dead -end parking aisles, all of which have a 26'x10' vehicle turnaround area. The plan must follow all applicable state and federal guidelines, including ADA standards for the sidewalk reconstruction. LANDSCAPING The applicant is adding approximately 17,185 square feet of vehicular use area. The minimum requirements for landscaping for the Minnetonka Middle School West parking lot expansion include 1,375 square feet of landscaped area around the parking lot and six trees for the parking lot. The applicant's proposed as compared to the requirements for landscape area Planning Commission Minnetonka Middle School West IUP — Planning Case 2014 -01 January 7, 2014 Page 5 of 6 and parking lot trees is shown in the following table. Since the existing parking area does not have landscape islands, perimeter landscape plantings, rather than landscape islands, are appropriate. Applicant does not meet minimum requirements for trees in the parking lot area. A minimum of six trees are required to be planted in and around the parking area. Staff recommends that the Planning Commission approve the Interim Use Permit subject to the following conditions and adoption of the attached Findings of Fact and Recommendation: 1. New retaining wall(s) exceeding 48 inches in height will require a professional design and building permit. 2. "No Parking Fire Lane" signage and yellow painted curbing will be required. Contact Chanhassen Fire Marshal for exact location of signs and curb to be painted yellow. 3. The applicant shall install a minimum of six deciduous trees. 4. The interior width of the landscape islands or peninsulas shall be 10 feet. 5. All parking stalls shall be marked with painted lines not less than four inches wide in accordance with the approved plan. 6. Staff recommends the applicant installs forebays at each curb cut. 7. All seed mixes shall be from the MN State Seed Mix list. 8. Seed mix 25 -141 shall be replaced within the filtration swale with 33 -262 or its equivalent. 9. The plan shall call out MNDOT 3877 Filter Topsoil Borrow or shall otherwise limit the clay content to less than 5% of the topsoil portion. 10. Proof of this must be provided to the City. 15. The plans shall be revised to note the style of the existing grated manhole covers and, if they are to be upgraded, note the new style. 16. A $5,000 escrow for restoration and erosion control will be required with the permit. 17. The applicant must provide a proposed haul route for review and approval. 18. On January 7, 2014 the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Minnetonka Public Schools District 276 for an interim use permit for the property located at 6421 Hazeltine Boulevard. The Planning Commission conducted a public hearing on the proposed interim use which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned OI, Office Institutional District. 2. The property is guided by the Land Use Plan for Public /Semi - Public use. 3. The grading operation will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. The site work will result in the creation of a water filtration swale which will improve water quality. b. The grading operation will be consistent with the objectives of the city's comprehensive plan and the zoning code providing additional storm water treatment. The earthwork will be maintaining the site in a form suitable for institutional use which is compatible with the Comprehensive Plan and the zoning code. c. The grading operation will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area because the site improvements will improve the use of the site as well as improve water treatment. . d. The grading operation will not be hazardous or disturbing to existing or planned neighboring uses because the grading and drainage will be contained within the site perimeters. Hours of operation are limited and specific conditions of approval will be in place and enforced by the city. e. The grading operation will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. The grading is temporary which does not need to be served by public facilities and services. The proposed grading will improve storm water management in this area. f. The grading operation will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community since this site already contains a school. g. The grading operation will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare due to excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. The conditions of the approval will provide standards by which the activities should be minimized. h. The grading operation will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Through the use of signage, limits on the hours of operation, and the limited nature of the operation, traffic impacts will be limited. i. The grading operation will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. The grading operation is 2 limited. j. The grading operation will be aesthetically compatible with the area since the grading and re- vegetation of the site will improve the site storm water management. k. The grading operation will not depreciate surrounding property values since the plan will improve the site and its impacts on the surrounding properties. 1. The grading operation will meet standards prescribed for certain uses as provided in Chapter 7, Article III of the Chanhassen City Code. 5.
