PC SUM 2004 04 06CHANHASSEN PLANNING COMMISSION REGULAR MEETING SUMMARY MINUTES APRIL 6, 2004 Chairman Sacchet called the meeting to order at 7:05 p.m. MEMBERS PRESENT: Steve Lillehaug, Bethany Tjornhom, Kurt Papke, Rich Slagle, Uli Sacchet, Craig Claybaugh and Dan Keefe STAFF PRESENT: Kate Aanenson, Community Development Director; and Bob Generous; Senior Planner PUBLIC PRESENT FOR ALL ITEMS: Janet & Jerry Paulsen Debbie Lloyd 7305 Laredo Drive 7302 Laredo Drive OATHS OF OFFICE: Uli Sacchet, Craig Claybaugh and Dan Keefe took the oaths of office for Planning Commissioners. ADOPTION OF PLANNING COMMISSION BYLAWS. Chairman Sacchet asked for any comments or questions. Hearing none, the following motion was adopted. Slagle moved, Claybaugh seconded to adopt the Planning Commission Bylaws as presented. All voted in favor and the motion carried unanimously with a vote of 7 to 0. ELECTION OF CHAIR & VICE CHAIR. Claybaugh moved, Papke seconded to appoint Uli Sacchet as Chairman of the Planning Commission. All voted in favor, except Uli Sacchet who abstained, and the motion carried with a vote of 6-0-1. Sacchet moved, Tjornhom seconded to appoint Rich Slagle as Vice Chair for the Planning Commission. All voted in favor, except Rich Slagle who abstained and the motion carried with a vote of 6-0-1. PUBLIC HEARING: REVIEW PROPOSED CHANGES TO CHAPTER 20, ZONING OF THE CHANHASSEN CITY CODE. THESE CHANGES AFFECT ARTICLES 1 THROUGH XXXI OF THE CHAPTER AND ARE INTENDED TO UPDATE AND CONSOLIDATE THE ENTIRE ZONING ORDINANCE. Planning Commission Summary - April 6, 2004 The public hearing was continued with Bob Generous continuing the staff presentation and review of the proposed changes to the code beginning with page 60. Janet Paulsen, 7305 Laredo Drive brought up issues dealing with Section 20-481, using the center line of streams and clarification on the setback requirements. In speaking with the Watershed District, they require 100 foot setback. Also clarification on the wording of 481(b) additional structure setback. Commissioner Papke asked staff to explain how and where they define the top of a bluff. Commissioner Slagle asked for clarification on entrance monuments. Janet Paulsen suggested that it would be a good idea for RSF to have a 60 by 60 building pad requirement and pointed out inconsistency under Section 20-615(4) regarding neck lots. The commission discussed on Page 92, Section 20-920 the requirement regarding privately owned underground amenities. Engineering was recommending that this item stay in but Planning Commission had recommended that it be removed feeling it was onerous. There was discussion over Section 20-962. Camping regulations. Janet Paulsen was concerned this was Chan hassle. Discussion on Section 20-1025 regarding retaining wall regulations and driveway regulations. Janet Paulsen brought up her desire that neighbors get notified regarding driveways being placed right next to property lines and the issue of driveway easement. Jerry Paulsen, prior to closing the public hearing, thanked the Planning Commission for their hard work and taking the code more seriously than preceding Planning Commissions. Chairman Sacchet closed the public hearing and asked for staff direction on how to proceed. Lillehaug moved, Claybaugh seconded to table review of changes proposed to Chapter 20, Zoning of the Chanhassen City Code. All voted in favor and the motion carried unanimously with a vote of 7 to 0. APPROVAL OF MINUTES: Slagle noted the verbatim and summary Minutes of the Planning Commission meetings dated March 2, 2004 and March 16, 2004 as presented.
