Rules and Regulations
Time and Place: Each Saturday in May through the last Saturday in October; 9:00 a.m. -
1:00 pm. at City Center Park, Chanhassen, MN. Vendors may arrive at the City Center
Park as early as 7:30 a.m. The first parking lot north of 78th Street will be reserved lbr
your convenience. If you have any questions, please call Jim Bledsaw at 934-2114 or

Special Rates for Vendors under 16 years of age. Manager has discretion to
waive annual fee for some local gardener, depending on market conditions.
What can be sold:
Produce and other food products:
1. Fruits, vegetables, grains, flowers, bedding plants and potted plants, aquaculture and
fish. The seller must flow bedding plants and potted plants from seed, plug, cutting,
bulbs, or bareroot. No resale ofprefinished plants are allowed. Transplanted plants must
be grown to the point where the roots fill the pot (roots hold the soil when the pot is
removed).

Farmers:
Those who raise the produce, plants or animals which they sell at the Chanhassen
Farmers market, on land within fifty miles of Chanhassen, Minnesota. This may include
someone who processes produce into a value added product such as jams, cider, or salsa.
It may also include farmers who raise the basic ingredient(s) of a product, but who must
send it out for fundamental processing before creating the value added product. Such
vendors might include those farmers producing oils, smoked meat, etc.
Value-added Agricultural products:
These include raw agricultural products that have been proCessed by the vendor, or any
product, the sale of which a government agency regulates. Examples are milk, cheese,
oils, vinegars, meats, poultry, eggs, honey, soap, and herbal preparations. Agricultural
products licensed, inspected or otherwise regulated by the federal government, the State
of Minnesota, Carver County, or the City of Chanhassen may be sold only upon the
Farmer's Market's receipt and acceptance of required documentation of compliance with
all regulations. Vendors must abide by all applicable federal, state, and local health
regulations. In addition, they must adhere to federal guidelines on all labels.
Processors:
Those who sell processed foods which they have prepared. Processors are persons or
entities offering fresh food products (such as meats, seafood, ciders, baked goods, jams,
etc.) that have added value to their product through some sort of "hands-on" processing
(e.g., smoked or butcher meats, handmade candies, etc.). All processors' permits and
licenses shall be displayed whenever a processor is selling at The Chanhassen Farmer's
Market. Processors must produce their products in Minnesota or be Minnesota based.
Processed tbod products should use ingredients from Minnesota farms as much as
possible. The Chanhassen Farmer's Market shall give stall preference to processors
using ingredients from Minnesota farms or waters.
Resellers:
Those who buy produce from farmers within fifty miles of Chanhassen, Minnesota, truck
it to The Chanhassen Farmer's Market, and resell it directly to the consumer. The
reseller is expected to be the only stop between the grower and the consumer. They are
not expected to deal with shippers, warehouses or jobbers. They must not sell produce
not grown in Minnesota. Resellers are sellers of crops that cannot be grown reliably, or
offered tbr sale in sufficient quantity, by those farmers selling at the farrner's market, as
determined by The Chanhassen Farmer's Market governing body. Resellers must have
crops pre-approved by the market governing body before delivering the crops to market
for sale. Approved resold crops must be specifically limited, so as not to compete with
crops of farmers within the Chanhassen Farmers Market, as defined by the farmer's
market's polices and by-laws. Resellers must label their products as being resold*, and
information must be available tbr the consumer as to which farms produced those
products. (* other terms synonymous with "resold" may be substituted.)
Prepared Food Vendors (Concessionaires):
Prepared food vendors offer freshly made foods, available for sale and immediate
consumption on-site at The Chanhassen Farmer's Market. Prepared/hod vendors shall
possess and maintain all required state, county and local permits. Prepared food vendors
should use ingredients produced in Minnesota as much as possible. When selecting
prepared tbod vendors, The Chanhassen Farmer's Market will encourage vendors to
provide a good variety of healthy foods, and will give preferences to vendors using
ingredients produced in Minnesota. Certain vendors may be restricted due to contractual
obligations of the farmer's market.
1. Selling Privileges:
Only members of the Chanhassen Farmer's Market are extended selling privileges.
2. Fees and Space assignment:
Vendors have first right of refusal to stall spaces occupied the previous season. To
preserve your rights you must pay annual dues by the end of the first general meeting of
the new market season.
Stall spaces may be reserved by paying at least one week in advance, unless an annual fee
is paid.
Any member without a reserved space will be given a space by the Market Manager on a
first come, first served basis at the Manager's discretion. The assignment is for that
market day only and may vary from week to week.
3. Farmer's Market Day Arrival/Departure Procedure
The market hours will be from 9:00 AM - 1:00 PM., each Saturday. Arrival and setup
time will be 7:30 a.m. to 8:45 a.m. All vendors will be ready for business by 9:00.
Allowances may be made for farm vendors who need to harvest product the morning of
the market.
For safety reasons, early take-down and departure before closing time will not be
allowed. Exceptions may be made in case of emergency. See the Market Manager.
4. Miscellaneous / Appearance and Conduct
1. Vendors will be neat, suitably dressed (shirt and shoes), and deal with the
public and fellow- vendors in a courteous and appropriate manner at all
times.
2. All vendors will display their products neatly and attractively, with
consideration for the other vendors and the general public.
3. Vendors are responsible/'or their own stalls, will supply all necessary trash
containers, and will leave their site clean and in a condition suitable to the
Market Manager and the City of Chanhassen. Each member will remove
containers, waste and trimmings before leaving the Market.
4. Vendors will in no way cause detriment to other vendors.
5. No rummage-sale, second hand, or flea-market-type items may be sold.
6. Space dimensions must be respected. Do not block the view of other vendors
or the flow of traffic or encroach on areas assigned to other vendors.
7. Alcoholic beverages may not be sold, consumed or advertised at the Market.
8. Vendors are required to post an identification sign in a prominent place stating
the vendor's' name, product, and area they are from.
9. All vendors are expected to clean up their stall and around their stall after
usage. This includes the parking lot.
10. All vendors must display a sign approximately 10" X 20" with their name and
address.
5. Membership
By becoming a member, the vendor agrees to the terms of the Rules and Regulations and
the Bylaws of The Chanhassen Farmer's Market.
All Chanhassen Farmers Market members will provide an insurance certificate of
$500,000, naming Chanhassen Farmers Market and the City of Chanhassen as "additional
insured."
As condition of membership, the member agrees to release and hold The Chanhassen
Farmer's Market, its directors, officers, agents and employees harmless from all claims
related to or arising from such membership.
The Chanhassen Farmer's Market reserves the right to prohibit anyone from selling at the
Farmer's Market.
Members are expected to comply with any government regulation that may be in effect
for activities that take place at the Farmer's Market. These include certification of scales,
health rules applicable to samples and food display~ statements about being organically
grown, ooos etc.
Food Vendors are responsible for providing proper "product liability" insurance. Product
liability insurance is necessary because customers may have allergic reaction or illness
due to some chemical residue, product-acidity, food spoilage, or other tbod-safety related
issue.
Compliance with all codes and regulations of the County Health, Fire and Police
Departments; the State Health and Revenue Departments; and the Center for Disease
Control is required. These agencies have the final say in any dispute in the operation of
the Farmer's Market. These codes and regulations will also apply to the preparation of
foods on-site including food samples.
Vendors found to be in violation of one or more rules may be suspended Irom selling at
the Farmer's Market.
Anyone who fails to comply with the Rules and Regulations or the Bylaws may have
their membership terminated with no refund of dues or fees.
6. Farmer's Market Operations
Knowledge of and compliance with all state regulations regarding the production,
labeling, display and sale of all products at the Farmer's Market is the responsibility of
the individual vendor.
Sales tax must be collected as required by. State law. It is the responsibility of each
vendor to obtain their tax numbers, and be familiar with which of their items are taxable,
and to collect such taxes and forward them to the State Department of Revenue.

Summer Discovery Playground
Head to your nearest playground for some summer fun! Our famous Summer Discovery
Playground program is back with another summer of great activities. We've got tons of activities
for everyone--games, arts, crafts, nature activities, special events, songs, and more! This
program is designed for kids ages 4-11 (children must turn age 4 by the start of the program).
A maximum of 30 kids will be taken with each age group. A minimum of 10 kids is needed in
each session or the site may be cancelled. In case of inclement weather, call the Weather Hodine
at 952-227-1411. Rain-out dates will not be made up.

Come get a little crazy and have some fun learning Spanish. This is an excellent opportunity to learn
basic vocabulary, useful expressions, conversational skills and cultural awareness. Lots of fun
activities designed to get students speaking Spanish. Great for students with no prior Spanish as
well as those with some previous experience. The instructor is Sue Welsh. She has 15 years
teaching experience with all ages and levels in both public and private educational settings. Sue has
also lived in both Spain and Mexico. Each participant will receive a Spanish booklet, project and
cooking supplies, and parent tip sheet.

Lacrosse Unlimited programs are designed

skill or ability. Lacrosse Unlimited coaches

Dear Kathy,
I received your email and, out of courtesy, am informing you that the Chanhassen Athletic
Association (CAA) is protesting your response to me and the school district. I have
interpreted your letter to state that the CAA will be receiving remaining fields if any, after
other organizations Aapproved@ by the Chaska Park and Recreation Department have
been allocated.
The agreement between The City of Chaska and School District 112 states that the
responsibility of the Chaska Park and Recreation Department is to schedule fields in
accordance with school district facility use policies. The agreement does not empower
the Chaska Park and Recreation~Department to certify organizations as worthy of facility
use.
The CAA expects School District 112 to be the certifying organization, since Chanhassen
residents have funded the facilities equally. As a Chanhassen resident and taxpayer, I
certainly do appreciate the intent and spirit of the agreement, recognizing the cooperative
cost savings opportunity to all taxpayers. Proper interpretation of this agreement,
however, remains a priority with CAA members, and certain terms require amendments
to ensure equal access of school district facilities to all taxpayers. The execution of this
agreement, as apparently interpreted by the City of Chaska, certainly does not afford the
intended value to School District 112 residents who are CAA members.
The CAA expects the school district to allocate indoor facility use according to
organizational headcount, instead of prior year--s requests or program specifications. In
past years, for example, The Chaska Basketball Association (CBA) has received 70% of
the gym space, when they only own 55% of the total District 112 registrants. The CAA
has accepted registrations from 45% of the people in our school district, and expects 45%
of the available facilities. The CAA understands that CBA offers travel programs that
they believe requires more gym time for competitive reasons. We fail to understand,
however, what that has to do with taxpayer rights to equal access.
The CAA intends to protest the use of gI)istrict 1120 in the name of any organization
that is not affiliated with the school district. Use of a school name, logo, or official
identification, implies endorsement by the school district. I can choose to register my
children in other programs, but there is a clear difference between the CAA philosophy,
and that of other organizations. I do not believe, for instance, that cutting 10 year old
children, or creating elite teams is healthy for kids or a community. I have a right to
exercise that choice without prejudice from the school district, unless the school district is
holding public heatings in support or opposition to specific recreational programs.
Without a certificatiOn process, the school district is improperly permitting the perception
of endorsement, when no such endorsement exists.
It is time for the District 112 School Board to draft a certification policy for facility use of
taxpayer owned property. I, for one, have found no child development literature that
supports elitism in youth sports, or cutting kids, or demonstrating any form of
discrimination based on athletic ability or physical size. I have found plenty of literature,
however, to support the AIn-House@ concept until at least age 12 years old. I do not
believe that a school district should permit use of school district facilities to organizations
that offer programming that is contrary to our school district--s mission. Just because the
school district does not manage youth sports does not mean the school district has no
involvement in how the school district facilities are used. This very conflict between the
CAA and The City of Chaska is a prime example of what happens when a school district
washes it=s hands of youth sports. These facilities belong to the public, the school board
members are voices of the public, and the school district staff executes the public will.
The 2,400 voting members of the CAA expect equal access to facilities, expect that all
public use meet missionary expectations, and expect that facilities be fairly and properly
manage in accordance with public policy.
Finally, I would like to understand what right the Chaska Park and Recreation
Department has to judge the hard work of citizens and city employees who are doing
nothing more than trying to manage programs in the best interests of their own
community. Your letter implies that CAA members and City Staff in Chanhassen are not
committed to the welfare of the entire District 112 community. I can argue that a Park
and Recreation Department that believes in cutting ten year old children, and giving
preferential treatment to elite athletes is not representing the whole community. Shame
on you for believing that you know more about what is good for my family than I do. The
Chaska Park and Recreation Department should stick to managing within the scope of
your duties, on behalf of the people that pay your salaries, instead of policing how other
communities' manager their affairs.

SUBJECT: Public Gathering Permit for the Miracle Kids Triathlon
The Miracles of Mitch Foundation is requesting approval of a Public Gathering
Permit to hold a triathlon event on Sunday, August 22, 2004, from 9:00 a.m. to
2:00 p.m. in Lake Ann Park. The triathlon is being planned to honor the
memory and spirit of Mitch Chepokas, a ten year old Chanhassen boy who
passed away after battling a terminal illness. Representatives from the
foundation presented the information to the Park & Recreation Commission on
March 23, 2004. The Commission acted unanimously to recommend that the
City Council approve the public gathering permit (see minutes included in item
la of this agenda).
Tony Schiller is one of the front line coordinators of the event. Mr. Schiller
met with staff, including Paul Oehme, City Engineer/Public Works Director;
Mike Wegler, Street Superintendent; Sgt. Jim Olson and me to discuss many
facets of the event. It was determined that the only way to provide a safe
environment for the participants is to close Lake Ann Park from 9 a.m. to
11 a.m. After 11 a.m., the park would be opened to the general public.
The following is a chronological list of events:
Swimming: Swimming will be the first event, starting at approximately
9:00 a.m. The children will swim exclusively in the buoyed area of the
swimming beach. After exiting the water they will run to their waiting
bikes in the boat launch parking lot.
Biking: The kids will bike out of the park on Lake Ann Park Drive (the
main road). This road will be divided into two with cones from the boat
launch parking lot to the entrance of Lake Ann Park on West 78th Street.
The children will continue biking west on West 78th Street through the
Audubon intersection to just east of the Kwik Trip convenience store. The
children will turn around and continue east on the same route and will re-
enter Lake Ann Park. To provide a safe route for the bikers, West 78th
Street will need to be temporarily closed from west of the entrance to Lake
Ann Park to Prairie Flower Boulevard. The temporary closure would only

be from approximately 9:00 a.m. to no later than 11:00 a.m. The road
closure affects a number of residential property owners. The race
coordinator will notify Mr. Mike Gorra of the event and will work out the
logistics if he needs to enter/exit his property during the race.
The other affected residential area is the Walnut Grove neighborhood. The
Carver County Sheriff's Department has identified areas of the course that
need to be staffed with either a deputy or a reserve officer. Sgt. Olson
attended the meeting and feels this route is acceptable provided that these
areas are secured. Residents of this development will be allowed to exit
out of their neighborhood from Prairie Flower Boulevard to West 78th
Street heading west to Galpin Boulevard. They may also exit directly onto
Galpin Boulevard from their neighborhood.
Once the bikers are back in the park, they will continue to the boat launch
parking lot to complete the biking portion of the event.
· Running: Following the biking, participants will run on the trail from
Lake Ann Park to Greenwood Shores Park, turn around, and run back.
Food and Entertainment: After the race is complete, race organizers
would like to have a ceremony, serve food, and provide entertainment.
This component of the event will begin at approximately 11 a.m. and take
place in the Lakeside, Parkview, and Pavilion picnic areas.
The triathlon committee originally wanted to host the event from 11:00 a.m. to
4:00 p.m. I am recommending that the race begin at 9:00 a.m. Having the race
earlier will minimize the impact on the park and the impact on other people
using the park. The race would be completed by 10:30 a.m. or 11:00 a.m., and
would have little or no impact on our normal beach traffic.
Besides the event description, the following conditions must be met for
approval:
1. Reserve the picnic facilities at current 2004 Resident Rates:
Pavilion: $110 - 25% (discount non-profit) $82.50
Parkview: $ 50 - 25% (discount non-profit) 37.50
Lakeside $ 50 - 25% (discount non-profit) 37.50
Total $157.50
2. Must provide a safe race course with safety cones throughout Lake Ann
Park Drive to separate vehicle and participant traffic.

The necessary road closure signage for the course must be obtained
through a company such as United Rentals, and a sign plan must be
approved by the City and Carver County.
4. Gopher State One Call must be notified to locate utilities at least
48 hours prior to erecting any tents or driving stakes into the ground.
5. If additional restrooms are needed, the fee of $85/unit for regular
restrooms and $126/unit for handicapped restrooms will be assessed.
6. A plan detailing how the parking lots will be used during the event and
the traffic flow must be submitted.
If seasonal park maintenance workers are needed for garbage pick up or
cleaning either before and after the event, a fee of $12/hour per
employee will be assessed, with a two employee minimum.
8. Additional refuse containers and/or dumpsters can be provided at
market rate, which will be determined at the time the order is placed.
The Miracles of Mitch Foundation must provide a $1 million
Comprehensive General Liability insurance policy naming the City of
Chanhassen, Carver County, and the Minnetonka Public Schools
Community Education and Services as an additional insured for the
event.
RECOMMENDED ACTION
It is recommended that the City Council approve the Miracle Kids Triathlon
for Sunday, August 22, 2004 with the conditions listed above.
ACTION REQUIRED
Approval of this event requires a simple majority vote of those City Council

Miraclekids Triathlon
These are my comments on the triathlon:
The closure of West 78th St. is very important from a safety standpoint. It would only
have a direct impact on one person along that section and that would be Mike Gorra.
I think that proper signage will be very important to notify people about the closure
th
prior to vehicles turning onto West 78 off of Powers. Paul Oehme and I should
have final say over the number of barricades, style of barricades, and wording for the
closure of West 78th.
Todd Hoffman has advised me that there will not be any traffic allowed (except
emergency traffic) into or out of the park while the bicycle portion of the race is going
on. He is also going to recommend that the park be closed to the general public
while the triathlon is going.
There needs to be a volunteer for each parking lot access point to make sure that
somebody does not leave early. The road through Lake Ann is fairly long and has
several access points for parking lots. There needs to be good communication and
coordination (walkie talkies) for race volunteers.
I recommend that there be two paid licensed officers to cover the intersection at the
entrance to Lake Ann and at Prairie Flower. I would also recommend the CSO'S
both work that day. I will also try to get Sheriff Reserves and Posse members to help
with the function.

There should be medical people on scene and an ambulance dedicated to Lake Ann
for the race.

Purpose and Mission: Fulfilling the wishes of Mitchell Chepokas, a miracle kid who is gone but still very much with us in
spirit, the Miracles of Mitch Foundation was formed in order to provide financial support to families dealing with the worst
possible event: the critical illness of a child. The motto of the MiracleKids Triathlon is Kids Racing for Kids Who Can't. The
event will serve as a foundation fund-raiser while promoting a summer fitness program culrninatin9 with kids participating
in a swim-bike-run, kids-only triathton.
Presentation and Staging: Mitch's favorite color was Orange. The entire park wilt be emblazoned in bold orange, with an
unforgettable finish line, huge cheerin9 crowds and OrangeFest--- the celebration picnic-party with 9ames, pictures, music
and fun.
Triathlon Coordinators: foundation volunteers led by triathlon expert and G--time World Champion, Tony Schiller.
.En.trance Requirements: kids who raise pledges of $50 or more will gain entry into the race and receive the MiracleKids
Triathlon Training and Race Guide. This fun and easy to follow body-mind shape-up plan will help kids 9et fit and ready for
the big day.
,AIl.,Inclusive Event: Mitch had a big heart for all kids and would wan[ the MiracleKids Triathlon to reach out to kids
from all backgrounds. For that reason, we have created a Sponsor-a-Kid Scholarship Program to eliminate the
physical and financial barriers that could prevent some kids from participating.
S. ponsor-a-Kid Scholarships: Donor contributions will make it possible to invite several underprivileged,
physically challenged, and ill children to race (those with special needs will get to race in tandem support with
experienced triathtetes so they too can finish)~ By partnering with organizations serving these groups, we will
invite kids to race. There wilt be a scholarship contest where kids submit written essays and/or their very own
artwork depicting why they'd fike to race in the MiracleKids Triathlon. Chosen kids will receive free entry, the
MiracleKids Tdathlon Training and Race Guide, all the equipment they'll need (including a bike they get to
keep), and even transportation to and from the race. It will be an unforgettable day of Miracles.
Spirit of Play - Not Competition: In the spirit of Mitch, eve .ry kid will wear the Number 1 and all finishers
will "break the tape" to earn their MiracleKids Champions Medal. There will be no official timing or record
keeping.

The Perfect Venue: I believe Lake Ann Park to bc among the finest triathion venues
anywhere, and as a veteran of 200+- triathlons all over the wor!d, that says a lot. I!;e park
has it all... ,mnple parking, fantastic fi~cilitics, beauty, sandy beech, clear water, and
private lakeshore parkland. I have had extensive discussion with city personnel to
determine the saC'est course with the [east impact on ciiy traffic.
Minimizing l~act on }>ark Users: I have swum 3-4 times each week for thc last 17
summers in Lake Ann and have noticed that very lbw people visit the park on Sunday
mornings. This is especially true in the late August "dog days" of summer. So wc
strategically chose Sunday, Aug 22 as a day thai will have the ~eas( hnpact on park users.
Thc park will remain open to visitors who want to be included in thc fire. Race fi~milics
will begin Ica.ring the park i~ droves near and be~Ure the noon hour.
l'he Course: (see maP) Alter swimming in I_.;tke Ann. kids will run to the bikes transition
staging area in the Far NE parki~g lot, then bike om on a coned off' right-hand portion of
the right hand lane ol'the main park road. They will exit the park on the W. 78~h
westbound bike trail and stay on the trail to tile lummx:mnd at Prairie Flower where they
~vill U-turn and return on W. '78~h pedaling eastbound toward the park in the Westbotmd
lane until they reach the park and return to the transition zone in tile cc, ned off rigi~t-h~md
portion of the right hand lane oF the park road. Then kids will run on the bike trail toward
the turnaround near Greenwood Sh{~re~; Park and return m~ the trail to finish near thc boa!
landing. No roadways will be used Ibr the mn porto;re.
Road Closure: In a meeting between Sergeam Jim Olson~ Mike Wegler, Paul ()chine,
Jerry,' Ruegemer and myseli~ it was determined that thc best, saC;est and least impact on
city traffic could be made by closing W, 78t~: from the Park entrance to Prairie Flower,
which will also include closir~g off'access to W. 7gt~ t~'on~ the very minimally used
Audubon Rd at Hwv 5 and W. 78th. East and Westbound Iraflic will be able to enter and
exit the park on W.'78th fi'om Powers only. F. astbound W. '78th trafl'ic f/:rom Galpin Rd.
will be able to access Prairie Flower or return to Galpim and residents reaching W. 78

Request for Rezoning; Southwest Metro Transit
Maintaining and creating new pedestrian/bicycle routes to the proposed
Southwest Metro Transit Station is very important. The construction of new
Highway 101 south will include the installation of a ten-foot trail adjacent to the
subject property. The Transit Station project must install a trail/sidewalk adjacent
to Lyman Boulevard from Highway 101 east to a street crossing at Summerfield
Drive. Appropriate and adequate internal sidewalk connections must also be
planned to allow convenient and safe non-vehicular traffic throughout the site.
