SUMMARY OF REQUEST: The applicant is requesting a variance from the City's light
ordinance to permit the up-lighting of the buildings within the Life Time Fitness Center
campus.
LEVEL OF CITY DISCRETION IN DECISION-MAKING:
The City's discretion in approving or denying a variance is limited to whether or not the
proposed project meets the standards in the Zoning Ordinance for a variance. The City has a
relatively high level of discretion with a variance because the applicant is seeking a deviation
from established standards. This is a quasi judicial decision.

PROPOSAL/SUMMARY
The developer is proposing the use of up-lighting on the buildings within the development. City
code prohibits lighting directed skyward except for lighting illuminating the United States of
America Flag. Since this variance relates directly to a site plan, the Planning Commission is acting
in an advisory role to the City Council for the variance request. Life Time Fitness currently has
uplighting only on their prototype building. None of the local fitness centers have this lighting.
BACKGROUND
On August 9,2004, the Chanhassen City Council approved the site plan for the Life Time
Fitness Campus. As part of their plans, the applicant proposed the use of up-lighting to highlight
the building. However, a variance for the lighting was never noticed so the City could not
formally act on the request.
In response to residents' concern that many of our outdoor light fixtures are unnecessary and
obtrusive, the City revised the lighting ordinance to try and reduce the amount of lighting in the
nighttime sky. The parking lot lighting standards were revised by ordinance number 290 on
February 22, 1999, to limit parking lot lighting pole height to 30 feet and requiring 90 degree or
less cutoff angles on the light fixtures. Lighting directed skyward for commercial and industrial
buildings was prohibited by Ordinance Number 377 on May 24, 2004.
APPLICABLE REGULATIONS
Section 20-913, Lighting
(e) Lighting shall not be directed skyward except for lighting designed for illuminating the
United States of America Flag.
DISCUSSION
The development site is located to the east of the Minnesota Landscape Arboretum and west of
Memorial Park, a 100-acre open space assembled by the City to provide permanent open space.
This area does not generate light or create nighttime sky illumination. As the City continues to
develop, more and more light will spill in to the evening sky so it is important to regulate and
limit the amount of lighting directed skyward. Lighting of the site, directed skyward, could create
additional night sky illumination that may negatively impact the neighborhood and community.
"Decorative lighting of building exteriors, fountains, landscaping, bridges, statuary and other
man-made and occasionally natural features is common, especially in large cities on large
landmark structures. ... Many of the most common applications such as building floodlighting
can be effectively accomplished using down-directed and fully shielded luminaires, but others
are very difficult to light in this fashion and will inevitably lead to substantial proportions of light
emanating into the sky. Internally illuminated decorations are inherently unshielded, and direct
at least 50% of the emitted light directly into the sky.

To a limited degree, and when done well, decorative lighting can be attractive and effectively
showcase distinctive architecture or community features. The illumination of building exteriors
is however more often used as an advertising vehicle, effectively converting entire buildings into
signs that are not regulated by the local sign codes. Common practice for building floodlighting
uses up-directed luminaires that project a large proportion of their light directly into the sky.
This approach should be strongly discouraged, and the USA Pattern Code makes extensive
lighting of this type difficult by applying strict limits on the amount of unshielded lighting
allowed. Luminaires mounted at the top of the wall or roof to be illuminated and directed
downward are effective and will minimize uplight." - Outdoor Lif.?htinf.? Code Handbook,

Outdoor Lif.?htinf.? Manual for Vennont Municipalities - This manual reviews all aspects of
outdoor lighting, rather than simply developing guidelines. It provides a good background for
communities to prepare or draft an outdoor lighting ordinance. The manual states that a
community can encourage appropriate lighting through the following planning tools:
comprehensive plans, zoning ordinances, lighting districts (based on use), design review and
public works specifications. A community can also regulate lighting through the review of a
lighting plan which should be submitted at the time of site plan review. They suggest that
lighting be ultimately regulated through a zoning permit.
The manual states that communities should review the following for a new project:
1. Light levels and distribution: "Light levels should be appropriate for the proposed use of the
site...The applicant should be aware of the maximum, minimum, and average light levels that
will be generated."
2. Pole Heights: "Pole heights should be compatible with the scale of the surrounding
architecture and the scale of the site. Lights on 25 to 30-foot poles create a high 'ceiling' that
shapes an outdoor space at night, giving it a grand scale.. .Lights on lower poles (10-18 feet)
create a more intimately lighted space that is comfortable for pedestrians... Very low (42-
inch) poles, called bollards, are often used for gardens and walkways."
3. Classification of Luminaries:
a. Cut-Off Fixtures: "This type of fixture is the most effective in controlling glare and
skyglow. Cut-off fixtures control glare by directing light well below the horizontal."
b. Semi-Cut-Off Fixtures: "Because the lamp is only partially shielded, minimal glare
control is provided."
c. Non-Cut-Off Fixtures: "Some luminaries in the non-cut-off category are designed to
be decorative or historic...If the luminance is low enough, the effect of glare will be
minimal."
d. Floodlights: "Floodlights are designed to create a control beam of light.. .Because
they are installed on an angle and usually use high wattage lamps they have a very high
capacity to create glare."
The Chanhassen City Code addresses pole height, which is limited to 30 feet, the requirement for
cut-off fixtures, which limits the cut-off to 90 degrees or less, and glare. Additionally, the
Chanhassen City Code prohibits directing lighting skyward. The site is sufficiently illuminated to

highlight the building. Additionally, the architect is using down-lighting to highlight the building.
The city lighting standards require that lighting be directed downward to reduce glare and limit the
amount of night sky illumination. The proposed development can be illuminated following the
city's lighting standards.
The "Z" fixture has an adjustable pivot point that allows the fixture to be adjusted to any angle.
The fixture is typically adjusted after installation to maximize lighting effect and minimize any
wasted light beyond the building face. This would not require moving the fixture away from
building into the landscaping and works well at its current location. The fixtures are located
between windows along the front of the building only and are directed at the masonry portions of
the facade which have a negligible reflectance. Low levels of light at the perimeter of the light
cone do cross over to the windows which along with being tinted, have a glare-reducing
treatment. The applicant feels the accent lighting will bring out the character of the building
materials at night without creating negative light pollution.
The applicant has presented a schematic showing the proposed ground lighting and the vertical
photometric calculations. While the applicant's proposal appears to limit the amount of up
lighting, there still will be some spillover and reflected light directed skyward. If the lighting
variance is approved, staff recommends that the applicant direct the light lower on the building
such that the cone of projected light does not reach the top of the building. However, staff
believes that decorative lighting should be directed downward as permitted by the code.
RECOMMENDATION
Staff recommends that the Planning Commission adopt the following motion:
"The Chanhassen Planning Commission recommends denial of the variance to permit lighting
directed skyward in the Life Time Fitness development."

FINDINGS OF FACT
AND RECOMMENDATION
INRE:
Application of Life Time Fitness Corporation for a variance to permit lighting directed
skyward to architecturally highlight the buildings.
On September 7,2004, the Chanhassen Planning Commission met at its regularly
schedule meeting to consider the application of Alliant Engineering, Inc. and Life Time
Fitness Corporation for a variance for the property located at the southeast comer of TH 5
and TH 41, Lot 1, Block 1, Life Time Fitness to permit up-lighting of the buildings. The
Planning Commission conducted a public hearing on the proposed amendment and site
plan with variance was preceded by published and mailed notice. The Planning
Commission heard testimony from all interested persons wishing to speak and now
makes the following:
FINDINGS OF FACT
1. The property is currently zoned Planned Unit Development, PUD.
2. The property is guided by the Land Use Plan for office/industrial uses.
3. The legal description of the property is: Lot 1, Block 1, Life Time Fitness.
4. The Board of Adjustments and Appeals shall not recommend and the City Council
shall not grant a variance to lighting standards unless they find the following facts:
a. The literal enforcement of this chapter would cause an undue hardship. Undue
hardship means that the property cannot be put to reasonable use because of its size,
physical surroundings, shape or topography.
Finding: The site is sufficiently illuminated to highlight the building. The architect
is using down-lighting to highlight the building in addition to the up-lighting. There
is no undue hardship in lighting the exterior of the buildings.
b. The conditions upon which a petition for a variance is based are not applicable,
generally, to other property within the same zoning classification.
Fnding: The city lighting standards require that lighting be directed downward to
reduce glare and limit the amount of night sky illumination. This standard applies to
all commercial, industrial and institutional developments.

c. The purpose of the variation is not based upon a desire to increase the value or
income potential of the parcel of land.
Findings: The variation is not based on a desire to increase the value or income
potential of the parcel, but rather to highlight the building.
d. The alleged difficulty or hardship is a not self-created hardship.
Finding: The alleged difficulty or hardship is a self-created hardship The proposed
development can be illuminated following the city's lighting standards.
e. The granting of the variance will not be detrimental to the public welfare or injurious
to other land or improvements in the neighborhood in which the parcel is located.

variance to permit up-lighting of the Life Time Fitness buildings.

Dear Mr. Generous:
We respectfully request the City of Chanhassen to reconsider permitting Life Time Fitness to
install ground mounted building accent lighting for the Life Time Fitness center being built at the
southeast comer of Highway 5 and Highway 41 in Chanhassen, Minnesota.

health and fitness building. These fixtures would be located between the windows and would be

effect and minimize any wasted light beyond the building face.
This accent lighting is intended to highlight the character of the building design and materials at
night without creating negative light pollution. We believe the proposed lighting meets the intent
of the City's lighting ordinance.

I, Karen J. Engelhardt, being first duly sworn, on oath deposes that she is and was on
August 26, 2004, the duly qualified and acting Deputy Clerk of the City of Chanhassen,
Minnesota; that on said date she caused to be mailed a copy of the attached notice of Public
Hearing for a variance to the City's lighting standards for Lifetime Fitness Center -
Planning Case No. 04-22 to the persons named on attached Exhibit "A", by enclosing a copy of
said notice in an envelope addressed to such owner, and depositing the envelopes addressed to all
such owners in the United States mail with postage fully prepaid thereon; that the names and
addresses of such owners were those appearing as such by the records of the County Treasurer,
Carver County, Minnesota, and by other appropriate records.

City Review Procedure:
Subdivisions, Planned Unit Developments, Site Plan Reviews, Conditional and Intenm Uses, Wetland Alterations,
Rezonings, Comprehensive Plan Amendments and Code Amendments require a public hearing betore the
Planning Commission. City ordinances require all property within 500 feet of the sUbject site to be notified of the
application in writing. Any interested party is invited to attend the meeting.
Staff prepares a report on the subject application that includes all pertinent information and a recommendation.
These reports are available by request. At the Planning Commission meeting, staff will give a verbal overview of
the report and a recommendation The item will be opened for the public to speak about the proposal as a part of
the hearing process. The Commission will close the public hearing and discuss the item and make a
recommendation to the City Council. The City Council may reverse, affirm or modify wholly or partly the Planning
Commission's recommendation. Rezonings, land use and code amendments take a simple majority vote of the
City Council except rezonings and land use amendments from residential to commercial/industrial.
Minnesota State Statute 519.99 requires all applications to be processed within 60 days unless the applicant
waives this standard Some applications due to their complexity may take several months to complete. Any
person wishing to follow an item through the process should check with the Planning Department regarding its
status and scheduling for the City Council meeting.
A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often developers
are encouraged to meet with the neighborhood regarding their proposal Staff is also available to review the
project with any interested person(s).
Because the Planning Commission holds the public hearing, the City Council does not. Minutes are taken and
any correspondence regarding the application will be included in the report to the City Council. If you wish to have
somethinq to be included in the report, please contact the Planninq Staff person named on the notification
