Since this time, staff has been working with the Riese's and a site plan is scheduled to be presented to the Planning Commission on October 5th and to the City Council on October 11 tho The buyer has a very tight timeframe on this project, and would like to begin construction before the end of the year. The buyers are using two types of financing for the project - personal equity and traditional lending. The personal equity must be spent by October 27th in order to avoid certain tax consequences. While their traditional financing (a Small Business Administration loan) has been approved, it will not be available until after the October 27th deadline. The Riese's have asked that the City help bridge this gap, and partially close on the property by October 27th and issue a contract for deed until the remainder of their financing is available. Staff has discussed this issue with legal counsel and we are comfortable with this approach. In essence, title will remain in the ED A's control until the total purchase price has been paid, but this will allow the buyer to continue the process without losing personal equity. This action does require an amendment to the purchase agreement, which is attached to this report. The amendment gives the buyers one month after the closing date (scheduled for October 27th) to produce the remaining funds. RECOMMEND A TION (reQuires a maioritv vote of the EDA) Staff recommends the Economic Development Authority approve the attached first amendment to the purchase agreement between the ED A and Fred and Valaire Riese.
