CHANHASSEN VILLAGE COUNCIL MINUTES - May 10, 1971
The regular Chanhassen Village Council Meeting was opened with
the Pledge to the Flag. The following members were present:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
COUNCIL MINUTES: A motion was made by Councilman Bennyhoff and
seconded by Councilman Neils to approve the Council Minutes of
May 3, 1971. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
PARK AND RECREATION COMMISSION MINUTES: A motion was made by
Councilman Bennyhoff and seconded by Councilman Wolf that the
May 4, 1971, Park and Recreation Commission Minutes be noted
and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
YOUTH ADVISORY COMMITTEE MINUTES: A motion was made by Councilman
Bennyhoff and seconded by Councilman Klingelhutz the the April 14,
1971 and April 21, 1971, Youth Advisory Committee Minutes be noted
and read. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
BOND REQUIREMENT: A motion was made by Councilman Klingelhutz and
seconded by Councilman Bennyhoff that the State Bank of Chanhassen
file with the Village, a bond in the amount of $120,000 guaranteeing
all funds on deposit in the State Bank of Chanhassen. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
BOND SALE: Robert Ehlers of Ehlers and Associates explained, to the
Council, the financial needs necessary to pay all projects in
progress plus the Lake Ann Trunk to serve Lakeview Hills.
A motion was made by Mayor Coulter and seconded by Councilman Bennyhoff
that the firm of Ehlers and Associates prepare the necessary
prospectus for a $775,000 Bond Issue for the proposed sewer and
water projects. Date of sale to be approximately July 12, 1971.
Necessary Resolutions to be submitted back to the Council as soon
as possible. The following voted in favor thereof: Mayor Coulter,
Councilmen Bennyhoff, Klingelhutz, Neils and Wolf. No negative
votes. Motion carried.
SEWER AND WATER CHARGES: A motion was made by Mayor Coulter and
seconded by Councilman Klingelhutz to set the date for a Public
Informational Meeting for the 24th of May, for a proposed increase
in the unit charges. Also the changing of the existing sewer and
water service charges. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.

SIGN ORDINANCE: A motion was made by Councilman Klingelhutz and I
seconded by Councilman Bennyhoff that the Chanhassen Chamber of
Commerce be notified of the proposed amendments and that the
Council postpone a decision on these amendments for one week.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz and Wolf. Councilman Neils voted no.
Motion carried.
BOAT ORDINANCE #46: A motion was made by Councilman Wolf and
seconded by Councilman Neils to adopt Ordinance #46 as submitted.
The following voted in favor thereof: Mayor Coulter, Councilmen
Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes. Motion
carried.
4TH STREET: The Village Administrator explained his meeting with
Top of the Bluff and their agreeing to pay ~ of the estimated
project cost, $3600 for a seal coat and chips job.
A motion was made by Councilman Klingelhutz and seconded by Council-
man Bennyhoff to authorize the seal coating and chips project as
outlined in the January 12, 1971, letter from the Village Engineer.
The work on this project to be performed by our own Maintenance
Department, within the limits of the survey dated March 31, 1971,
by the Village Engineer.
After much discussion, Councilman Bennyhoff withdrew his second I
and Councilman Klingelhutz withdrew his motion.
A motion was made by Councilman Klingelhutz and seconded by
Councilman Bennyhoff to establish the right-of-way limits for
4th Street as 2 (two) rods each side of the center line of the
existing roadway as indicated in the survey dated March 31, 1971,
by the firm of Schoell & Madson. The following voted in favor
thereof: Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils
and Wolf. No negative votes. Motion carried.
The Administrator to submit back to the Council by the next meeting,
the estimated costs for upgrading 4th Street to a 20 foot width,
seal coated and chips surface.
ORDINANCE #45 (VARIANCE REQUESTS) :
HAROLD HESSE: A motion was made by Councilman Neils and seconded
by Councilman Wolf to table any action on this until the Planning
Commission has reviewed this and submitted back to the Council,
their recommendations. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
MRS. LES ANDERSON: A motion was made by Councilman Neils and
seconded by Councilman Wolf that the variance not be granted
to Ordinance #45 for Lot 9, Block 4 and Lot 3, Block 3 Pleasant
Acres, as there appears to be no hardship and no written appli~
cation has been submitted with all the requirements fulfilled as
per Ordinance #45. The following voted in favor thereof: Mayor
Coulter, Councilmen Neils and Wolf. Councilmen Bennyhoff and
Klingelhutz voted no. Motion carried.

ORDINANCE #45 (VARIANCE REQUESTS) :
MRS. LES ANDERSON (contd): A motion was made by Councilman Wolf
and seconded by Councilman Bennyhoff to approve the variance
request for Lot 9, Block 4 and Lot 3, Block 3, Pleasant Acres,
under Ordinance #45 if the soil test passes an acceptable per-
culation rate. Building Permit to be handled Administratively.
The following voted in favor thereof: Mayor Coulter, Council-
men Bennyhoff, Klingelhutz, Neils and Wolf. No negative votes.
Motion carried.
BUILDING PERMIT APPLICATION: A motion was made by Councilman
Klingelhutz and seconded by Councilman Bennyhoff to instruct the
Village Attorney to look into the 16~ foot dedicated right-of-way
adjacent to the Bongard Implement and Feed Mill. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Klingelhutz to approve the Building Permit Application as
per plans dated April 6, 1971. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff and Klingelhutz. Councilmen
Neils and Wolf voted no. Motion carried.
PARK AND RECREATION: A motion was made by Mayor Coulter and
seconded by Councilman Klingelhutz to approve the purchase of
four (4), 30 foot backstops with 10 foot wings and 600 lineal
feet of chain link fence. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils and Wolf.
No negative votes. Motion carried.
HUMAN RIGHTS COMMISSION: A motion was made by Councilman Wolf
and seconded by Councilman Neils to join the League of Minnesota
Human Rights Commissions for a fee of $10.00. The following
voted in favor thereof: Mayor Coulter, Councilmen Bennyhoff,
Klingelhutz, Neils and Wolf. No negative votes. Motion carried.
A motion was made by Councilman Bennyhoff and seconded by Council-
man Neils to adjourn. The following voted in favor thereof:
Mayor Coulter, Councilmen Bennyhoff, Klingelhutz, Neils cand Wolf.
No negative'votes. Motion carried.
