Special Joint Meeting with City Council
February 21, 1985
CALL TO ORDER
Chairman Whitehill called the meeting to order at 7:37 p.m.
Present were Commissioners Swenson, Horn, Robbins, Bohn and
Whitehill. Also present were City Manager Ashworth, City Planner
Dacy, and George Watson and Fred Hoisington of Brauer and
Associates. Mitch Swanson of Beushoof and Associates was also
present.
APPROVAL OF MINUTES
Robbins moved, seconded by Horn, to approve the minutes of the
January 17, 1985 meeting. All voted in favor and the motion
carried.
STATUS REPORT - NEGOTIATIONS OF OLD INSTANT WEB BUILDING
City Manager Ashworth presented the details of the sale of the
old Instant Web building.
Whitehill moved, seconded by Horn to approve the sale of the old
Instant Web building to Gary Kirt /David C. Bell Investment
Company and Dorek /Baden subject to the following:
1. Securing a bank guarantee for the first mortage.
2. The $200,000 construction loan is contingent upon completion
of the bowling center.
3. Timing of payment for land purchase should be evaluated to
minimize cash flow effect.
PRESENTATION OF ROUGH DRAFT CONCEPTS - BRAUER AND ASSOCIATES
Fred Hoisington of Brauer and Associates presented a rough draft
of a concept plan for the HRA and City Council to review before
the second Public Forum on March 14, 1985. Discussion of the
concept plan centered on the following points:
1. The existing uses on the north side of 78th Street detract
from the image of the downtown area.
2. The city should establish an attitude to keep the existing
businesses and to attract new businesses. The city should
try and accommodate existing business persons as much as
possible.
3. The downtown core area should play off the existence of the
dinner theater with support uses such as specialty retail,
general retail, and establishment of a pedestrian environment
in order to not only serve the Chanhassen residents but also
to provide a regional draw.

4. The West 79th Street area forms a second downtown. It was
discussed that this area's purpose should be for convenience
and highway commercial uses.
5. The institutional and historic buildings that are now located
in the downtown area be maintained and incorporated into the
overall development plan.
APPROVAL OF DOWNTOWN REDEVELOPMENT AGREEMENT
Whitehill moved, seconded by Horn, to approve the Downtown
Redevelopment Agreement with Brauer and Associates dated February
15, 1985. All voted in favor and the motion carried.
APPROVAL OF BILLS
Horn moved, seconded by Bohn, to approve -the bills except for
check number 24667 regarding the insurance of the old Instant Web
building. All voted in favor and the motion carried.
Bohn moved, seconded by Horn, to adjourn the meeting at 10:12
p.m. All voted in favor and the motion carried.

The three sale agreements, including subsidiary documents, were
delivered to the two purchasers on Monday. Numerous discussions
with the applicants have occurred and we appear to have agreement
on all points. I had anticipated having the attorney's final
draft in this office for distribution with this packet.

MEMORANDUM

SUBJ: Interior Plan and Site Plan for the Instant Web Building
Attached are copies of the interior plan and the overall site
plan for the reuse of the Instant Web building. The city will be
processing the subdivision of the property to Gary Kirt and Dorek
and Baden on April 1, 1985. The Planning Commission and City
Council will also be reviewing the site plan on March 27, 1985
and April 1, 1985. Because of the staff involvement during the
negotiation process and because of the present review of the
downtown redevelopment plan, the attached plans were given to
Brauer and Associates for review. They will present their
findings at the aforementioned meetings.

SUBJ: Land Acquisition for the Bloomberg Property
Community Development Block Grant funds are intended to be used
to acquire the 2.4 acre parcel from Mr. Bloomberg for additional
parking area for the Instant Web building. In order to use
Community Development Block Grant funds, it is necessary to con-
duct an Environmental Assessment Worksheet so that all HUD regu-
lations are being met. Staff is now in the process of completing
that worksheet which will be forwarded to the Minneapolis HUD
Office for approval. There is a thirty day comment and
review period that has to expire before HUD will give its
authorization to expend the monies. Please see the memorandum
on item #5 on the agenda regarding the use of CDBG funds for Year
IX and Year XI.
Because of the complexity of the acquisition regulation of HUD,
our representative from the Minneapolis HUD Office (Larry
Blackstad) recommended the hiring of a "process manager" to coor-
dinate the acquisition process. His /her duties would entail
hiring an appraiser and insuring all HUD requirements are met.
The city has contacted two potential candidates as recommended by
Mr. Blackstad. Their fees can be paid by CDBG funds.

SUBJ: Update of Existing Tenants
Attached are copies of all correspondence to existing tenants in
the old Instant Web building. As can be seen, there were a
number of tenants who were more than sixty days in arrears in
rent payments. In some situations we have had to renegotiate
or establish a payment schedule for the amount owed to the HRA.
Overall, we are receiving good cooperation from these tenants.
We have also met with Dave Halverson on the removal and reloca-
tion of the automobiles and boats in the mid to the rear portions
of the building. We have sent a letter to each vehicle owner
advising them that reconstruction of the building will be
occurring April 15, 1985, and for the safety of their vehicle, we
are encouraging them to have their vehicles removed by April 1,
1985.
We have made arrangements with Quali -Tech and M.A. Gedney to
allow the continuation of their storage area until April 31st.

This letter is to confirm our telephone conversations regarding
amending the lease termination notice sent to you at the end of
-- February. You stated that you would be able to vacate the middle
area of the building by March 31, 1985. You requested that the
storage currently occurring in the southeast corner of the
building be allowed to remain at that location until April 30,
1985. This letter is to confirm that the above outlined lease
arrangements are acceptable to the Chanhassen Housing and
Redevelopment Authority. Accordingly, the previous termination
notice is hereby amended to include allowing Gedney to maintain
storage, at approximately the same square footage area, in the
southeastern corner of the building until April 30, 1985.
Should you have any questions regarding this letter, please feel

possession of the building on May 1, 1985.
Your current lease with the Housing and Redevelopment Authority is on a 30 day
notice basis. To allow construction crews to start work in the facility in
advance of May 1, 1985, the Housing and Redevelopment Authority has no option
but to give you notice that we must terminate your lease effective midnight,
April 30, 1985. During the period of April 1 through April 30, 1985, you may be
required to relocate, within the building, so that construction crews may begin
rehabilitation work.
Your company has been a good tenant and we would like to work with you to make
your relocation as easy as possible.
The proposed developer of the woodframe section, David C. Bell Company, is pro-
posing to develop approximately 50,000 square feet of the Instant Web building
for general retail services. Mr. Gary Kirt, representing David C. Bell,
desires to work with your canpany in your relocation efforts and may be able to
accommodate your leasing needs during the next year.
Mr. Bloomberg has also contacted the City noting his desire to do whatever he
can to keep your company as a business within the City. Mr. Bloomberg is aware
of the redevelopment plans of the City as we will be required to purchase addi-
tional land from Mr. Bloomberg to make the redevelopment project a reality.

and by force if necessary, upon the ten (10) days notice of intention to re-
enter, remove all persons and their property therefrom, and to use such
force and assistance in effecting and perfecting such removal as said Lessor
may deem advisable to recover at once full and exclusive possession of all
said demised premises, whether in possession of said Tenant or of third
persons,..."

its rights under the lease to forceably recover "at once full and exclusive
possession of all said premises."

SUBJ: Community Development Block Grant Funds - Year IX and XI
On April 1, 1985, the City Council will be conducting two public
hearings to discuss the proposed use of Community Development
Block Grant funds. One hearing is to discuss the reallocation of
Year IX monies and the other for the new -Year XI allocation.
The reallocation of Year IX is to redesignate existing project
activities to a "land acquisition" category so that the city can
use these funds to purchase the 2.4 acres needed for additional
parking for the reuse of the Instant Web building. Year IX funds
must be expended by July 1, 1985. At present the balance for the
existing projects are as follows:
Site clearance and preparation $45,000
Downtown Project Marketing Plan $11,215
(Note that the city has $33,000 in Year X for land acquisition)
As you recall, the site clearance and preparation activity was
for the demolition of the Instant Web building. This project
description does not address the need for land acquisition;
therefore, these monies must be reallocated into a specific land
acquisition category according to HUD regulations. The Downtown
Project Marketing Plan activity originally scheduled $20,000.
Approximately $8,785 was expended for the market study done by
McCombs. If the $11,215 is to be used for land acquisition, it
also has to be reallocated to land acquisition category.
A member of the Senior Citizen Center in Excelsior has also con -
tacted the city for $200 -$300 to use for the installation of
handicapped bathrooms and oven hoods. The center needs approxi-
mately $2,000, and other communities have been contacted as well.
An amount of $215 could be reallocated for this purpose.
The Year XI allocation for Chanhassen totals $38,532. The
tentative purchase price discussed for the acqusition of the 2.4
acre parcel south of the Instant Web building was $95,000. This
would dictate reservation of at least $11,000 of the Year XI
funds for land acquisition. However, in order to allow the city
adequate flexibility, at least $25,000 should be reserved.

as part of the Downtown Project Marketing Plan. The purpose of
this project was not only to conduct the downtown office /retail
market study but also to allow the development of promotional
materials which will be designed to attract private developers
for the downtown project. Therefore, the HRA and City Council's
intent of reserving monies for this purpose can still be main-
tained. Monies should also be set aside for administration of
the CDBG funds. An allocation of $1,532 is recommended.

Year XI (1985) Urban Hennepin County CDBG Program
INTRODUCTION
The Urban Hennepin County Statement of Objectives provides direction for
planning and implementing the 1985 (Year XI) Urban Hennepin County CDBG
program consistent with national and local objectives. The national
objectives of the CDBG program are: developing viable urban communities
by providing decent housing, a suitable living environment and expanded
economic opportunities principally for low and moderate income persons;
aiding in the prevention or elimination of slums or blight; and meeting
other community development needs having a particular urgency. Urban
Hennepin County objectives are supportive of the national objectives
and detail their application specifically to the Urban Hennepin County
CDBG Program..
Each activity carried out with CDBG funds must, of course, be eligible
under program regulations (24 CFR 570) as well-as meet the objectives of
the Urban Hennepin County CDBG Program.
Consistent with the 1983 amendments to the Housing and Community
Development Act of 1974, a minimum of 51 percent of program funds must
be used for projects which directly benefit low and moderate income
persons.
CDBG funds may be utilized to address a wide range of housing and com-
munity development needs. The Statement of Objectives identifies Urban
Hennepin County Community Development needs which should be addressed
through the use of CDBG funds as well as how these funds should be pro-
grammed and used.
The objectives are stated under program subheadings, followed by
procedural statements which illustrate how the objectives might well be
achieved.
PROGRAM PLANNING AND ADMINISTRATION
Objective: Develop and implement a Housing and Community Development
program which addresses Urban Hennepin County objectives and
meets local needs and priorities in a timely and efficient
manner.
Objective: Maximize the benefit resulting from each activity.
Objective: Emphasize activities which provide for a balanced program
primarily benefiting low -and moderate - income persons.
Objective: Assure citizen involvement in the formulation, implemen-
tation and evaluation of the CDBG Program.
Objective: Facilitate mutual cooperation among participants in the
development and implementation of multi- community CDBG
activities to address common concerns and needs.
Procedural Statements:
• Establish a project specific implementation schedule not to exceed
18 months from the grant award date.
• Keep proposals for project funding to a minimum (no more than
three) generally consistent with the effective utilization of the
planning allocation available to the cooperating unit.
• Monitor the established 18 -month implementation schedule to ensure
effective project implementation and /or the reallocation of
assigned funds.
• Monitor the performance of all cooperating units on at least a
semi- annual basis to review their ability to implement local
programs.
• Provide a structured opportunity for citizen participation in the
development, implementation and ongoing evaluation of the CDBG
program.
• Encourage greater citizen involvement in the CDBG program through
expanded communication on program funding levels, program objec-
tives and eligible activities.
• Assign funds for programmed activities remaining at the end of 18
months from the date of the beginning of the program year from
which they were awarded to the Countywide Discretionary Account
for reprogramming.
• Provide monthly project status reports to all cooperating units
and the Citizens Advisory Committee to assist in program evalua-
tion.
• Plan and implement activities which pool resources of several
participants to meet a shared need.
• Implement activities which are fully eligible under program rules
and regulations and satisfy all applicable laws and special
compliance requirements.
NEIGHBORHOOD REVITALIZATION
Objective: Maintain and preserve viable neighborhoods and neighborhood
service centers through concentrated community development
activities.

Procedural Statements:
• Target CDBG funds for use in conjunction with other available
Federal, State and Local resources for a combination of housing
and community development activities in identified neighborhoods.
• Define neighborhoods geographically and /or statistically con-
sistent with adopted local plans and identified needs,
specifically those of low -and moderate income residents.
• Upgrade identified neighborhoods consistent with local policies
developed in consultation with residents.
• Demonstrate that component activities are supportive of improve-
ments in the neighborhood housing stock, physical condition and /or
economic development.
HOUSING
Objective: Direct housing resources to sectors of the housing market
providing the greatest benefit to lower income persons.
Objective: Explore all potential resources for the financing of as-
sisted housing and actively participate in their use to
construct and /or subsidize the development and /or rehabi-
litation of housing affordable to low and moderate income
households.
New Construction
Objective: Facilitate the development of new housing, including, but
not limited to, site acquisition, public improvements,
assistance with front -end costs and multi- community
projects.
Procedural Statements:
• Develop a priority list of communities for housing development con-
sistent with priorities established in the Housing Assistance
Plan.
• Establish multi- community housing development projects wherever
feasible based on realistic market service areas.
• Utilize all available approaches to finance housing development.
Existing Rental
Objective: Maximize utilization of available rental rehabilitation and
tenant assistance programs.

Procedural Statements:
• Participate in the rental assistance programs for existing units.
• Participate in the Rental Rehabilitation program.
• Utilize all available approaches to finance improvements to the
existing housing stock and assure its continued availability to
low -and moderate - income persons.
Housing Rehabilitation
Objective: Provide housing rehabilitation assistance to eligible house-
holds.
Procedural Statements:
• Offer a variety of housing rehabilitation assistance utilizing
loans and grants and affecting both owner occupied and rental
units.
• Follow uniform Urban Hennepin County Procedural Guidelines
including applicant income and asset eligibility requirements and
client assistance levels.
• Utilize all available housing rehabilitation /improvement programs
either in conjunction with or independent of the CDBG rehabilita-
tion programs (i.e., MHFA loans, TEA weatherization and repair).
PUBLIC FACILITIES AND IMPROVEMENTS
Objective: Rehabilitate existing public improvements and facilities and
assist in the development of new facilities and improve-
ments.
Objective: Emphasize direct benefit activities for low -and moderate -
income persons.
Objective: Coordinate the development of senior centers in locations
suitable for the provision of other services to the
elderly.
Procedural Statements:
• Use the provision of public improvements to encourage targeted
revitalization and new development.
• Utilize grant funds for the payment of special assessments for
public improvements to property of low and moderate income home-
owners to the extent possible.
o Fund the development /improvement of senior center as multi -
community facilities to the extent feasible.

HANDICAPPED IMPROVEMENTS
Objective: Ensure that program supported facilities and housing units
are accessible to handicapped persons.
Objective: Ensure that each accessibility improvement meets a parti-
cular need, removes a specific barrier and represents a
defined priority in the community.
Procedural Statement:
• Develop a handicapped accessibility plan for improvements which
identifies the barrier(s) to be removed, establishes needs and
priorities, explains how mobility and accessibility will be im-
proved and lists the facilities and programs to benefit from such
action. The plan must identify non - construction options for re-
moving barriers.
ECONOMIC DEVELOPMENT
Objective: Undertake activities to stimulate -economic development
consistent with local economic development strategies.
Objective: Provide additional permanent, private sector employment
opportunities to low -and moderate - income persons.
Objective: Provide job training opportunities, in conjunction with
private sector economic development activities, to low and
moderate income persons.
Procedural Statements:
• Offer assistance to private- for - profit ventures as an integral
part of economic development.
• Demonstrate commitment to or interest by developers, expanded
employment opportunities for low and moderate income persons
and /or the elimination of existing blighting .influences for
economic development activities.
• Undertake economic development activities only when they are con-
sistent with local plans or policies.
ENERGY
Objective: Develop the Urban Hennepin County CDBG program in a manner
sensitive to energy conservation issues.
Objective: Provide assistance to low -and moderate - income homeowners for
energy improvements.

- Procedural Statement:
• Develop energy use strategies which as a minimum emphasize
local needs and include items such as those listed under eligible
activities in Section 105(a)(16) of the Housing and Community
Development Act as amended in 1983.
PUBLIC SERVICES
Objective: Provide funding for public services to the extent they are
consistent with CDBG regulations and the program needs of
Hennepin County and the cooperating units.
Objective: Substantiate benefit to low -and moderate - income persons for
public service activities.
Procedural Statements:
• Limit the expenditure of CDBG funds for public services to no more
than fifteen percent of the Urban Hennepin County grant.
• Initial funding of public services with CDBG monies must be for
new or increased levels of service.
• Demonstrate that CDBG funds are the only source to maintain or
increase a public service activity and that local funding is not
available.
• Provide public services as a program of a cooperating unit(s).
DISPLACEMENT
Objective: Implement the Urban Hennepin County CDBG Program and Housing
Assistance Plan in such a manner as to minimize the direct
or indirect displacement of owners or tenants from occupied
dwelling units, and business locations.
Procedural Statement:
— The displacement of families, individuals or businesses, whether
they occupy their premises as owners or tenants, shall be under-
taken only when: (1) the owner requests that the cooperating unit
acquire the property due to a hardship situation resulting from an
action by the cooperating unit; (2) the premises is found to be
substandard to a point beyond repair; (3) the health and welfare
of the resident is in jeopardy; or (4) acquisition /relocation is
necessary to.implement a physical development activity consistent
with adopted local policies and /or plans.
When acquisition /relocation is necessary, the process will be
conducted according to the Uniform Relocation Assistance and Real
Property Acquisition Act, as amended.

Displaced residents or businesses shall be assisted through the
provision of relocation counseling and assistance in securing an
alternative location.
The costs of relocation payments and assistance required under
Title II of the Uniform Relocation Assistance and Real Property
Acquisition Act may be paid from funds provided by the CDBG pro-
gram and /or those available locally from any source.
When temporary relocation is necessary to complete the rehabili-
tation of a residential unit, it will be timed to minimize the
period of displacement for the affected owner or tenant. Tempo-
rary relocation benefits will be limited to the fixed payment
schedule contained in the Uniform Act, and increased rent costs
will not be paid for a period exceeding 30 days. Temporary relo-
cation benefits will not be provided to businesses affected by
rehabilitation.
Funding for relocation costs will be included in the budget for
each project involving displacement and any costs not specifically
required by the Unifrom Act will be paid in accordance with this
policy as provided for in 24 CFR 570.606 (C) of CDBG regulations,
effective November 2, 1983.
Program activities involving direct or indirect displacement will
be the sole responsibility of the cooperating units participating
in the Urban Hennepin County CDBG Program.
