On September 24, 2012, the Chanhassen City Council approved the following: Planned Unit Development — Residential Amendment revising sections b and c of the zoning standards; Preliminary Plat creating 17 lots and 7 outlets; and Site Plan with Setback Variances: Approve a 17 -unit townhouse development consisting of 10 twinhomes, 1 detached townhouse (Villa) and 6 three -unit townhouses, plans prepared by Pioneer Engineering, dated 08- 03 -12, with a 1.5 -foot variance to permit the decks to project 8.5 feet into the required yard along the eastern project boundary (21.5 -foot setback), and a 8.7 -foot variance to permit decks to be set back 21.3 feet from the wetland buffer edge SITE PLAN The applicant is amending the site plan converting a three -unit townhome into a two -unit twinhome. The previous approval was for 17 total units (see left graphic below). This amendment will reduce the total units to 16. The three -unit structure in the south central portion of the development adjacent to Lake Riley Drive is being replaced with a two -unit structure. Exterior materials are to be a combination of cement board trim and stone accents with premium vinyl siding. The roofing is to be Architectural Series asphalt. The exterior colors are to be of rich natural earth tones complementing the colors of the existing development. The proposed architecture should complement the existing and proposed housing within the project. The design and materials match those required for the townhouse development of Lakeside. There are three pallets of colors proposed for the project. All units incorporate projecting porches and decks. The twin homes comply with the Lakeside PUD design standards. SUBDIVISION BL0.;6K i The applicant is replatting Lots 1 -3, Block 3, Lakeside 71h L Addition into two (2) lots. The total site area being replatted is 0.2338 acres (10,187 square feet). There are no perimeter drainage and utility easements within the L T L. lots. STREETS/UTILITIES n The streets and utilities were installed with the Seventh Addition improvements. The developer proposes to abandon the sewer and water service within the driveway shown for Lot 1; services for Lot 1 are to the west. This proposal is acceptable. , ,_, 1 1 _ GRADING Minor grading adjustments are required for the proposal. The grading plan includes a 10 -foot long retaining wall on the side of each unit that will be constructed with the building. If the walls are four feet high or taller, the walls must be designed by an engineer and a building permit is required. MISCELLANEOUS Buildings over 9,250 square feet in area (floor area to include all floors, basements and garages) must be protected with an automatic fire protection system. A final grading plan and soils report must be submitted to the Inspections Division before permits can be issued. Retaining walls over four feet high require a design by a professional engineer, a building permit, inspections and final approval. Buildings are required to be designed by an architect and engineer (licensed in the State of Minnesota) as determined by the Building Official. The developer and /or their agent shall meet with the Inspections Division as early as possible to discuss plan review and permit procedures. PARKS & RECREATION The developer has previously paid $78,600 in park dedication fees for Lakeside 7th Addition. The reduction of one lot will require that the City process a $1,400 credit in park fees. The three -unit building slated for the 7th addition paid $11,400 in park fees. Setbacks are from the perimeter of the development and between buildings, rather than to individual lot lines. The PUD ordinance requires setbacks from roadways and exterior property lines. On February 18, 2014, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Ron Clark Construction for subdivision approval to replat Lots 1, 2 and 3, Block 3, Lakeside 70 Addition into two lots; and site plan approval to amend the approved site plan to convert a three -unit structure to a two -unit structure. The Planning Commission conducted a public hearing on the proposed Planned Unit Development which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Planned Unit Development - Residential (PUD -R). 2. The property is guided in the Land Use Plan for Residential -High Density. 3. The legal description of the property is: Lots 1, 2 and 3, Block 3, Lakeside 7b Addition. 4. The Subdivision Ordinance directs the Planning Commission to consider seven possible adverse affects of the proposed subdivision. The seven (7) affects and our findings regarding them are: a. The proposed subdivision is consistent with the zoning ordinance; b. The proposed subdivision is consistent with all applicable city, county and regional plans including but not limited to the city's comprehensive plan; c. The physical characteristics of the site, including but not limited to topography, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and storm water drainage are suitable for the proposed development; d. The proposed subdivision makes adequate provision for water supply, storm drainage, sewage disposal, streets, erosion control and all other improvements required by this chapter; e. The proposed subdivision will not cause environmental damage; f. The proposed subdivision will not conflict with easements of record; and g. The proposed subdivision is not premature. A subdivision is premature if any of the following exists: 1. Lack of adequate storm water drainage. 2. Lack of adequate roads. 3. Lack of adequate sanitary sewer systems. 4. Lack of adequate off -site public improvements or support systems. 5. Site Plan Findings: a. The twin home project is consistent with the elements and objectives of the city's development guides, including the comprehensive plan, official road mapping, and other plans that may be adopted; b. The twin home project is consistent with this division; c. The twin home project preserves the site in its natural state to the extent practicable by minimizing tree and soil removal and designing grade changes to be in keeping with the general appearance of the neighboring developed or developing areas; d. The twin home project creates a harmonious relationship of building and open space with natural site features and with existing and future buildings having a visual relationship to the development; e. The twin home project creates a functional and harmonious design for structures and site features, with special attention to the following: 1. An internal sense of order for the buildings and use on the site and provision of a desirable environment for occupants, visitors and general community; 2. The amount and location of open space and landscaping; 3. Materials, textures, colors and details of construction as an expression of the design concept and the compatibility of the same with adjacent and neighboring structures and uses; and 4. Vehicular and pedestrian circulation, including walkways, interior drives and parking in terns of location and number of access points to the public streets, width of interior drives and access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking. The twin home project protects adjacent and neighboring properties through reasonable provision for surface water drainage, sound and sight buffers, preservation of views, light and air and those aspects of design not adequately covered by other regulations which may have substantial effects on neighboring land uses. 6. The planning report #2014 -04 dated February 18, 2014, prepared by Robert Generous, et al, is incorporated herein. 2 RECOMMENDATION The Planning Commission recommends that the City Council approve subdivision and site plan amendment for Lakeside 8 1 Addition.
