INTERIM USE PERMIT #2014 -01
1. Permit. Subject to the tenus and conditions set forth herein, the City of Chanhassen
hereby grants an interim use permit for the following use:
Interim Use Permit to allow site grading in excess of 1,000 cubic yards to allow a parking lot
expansion and stonnwater improvements for Minnetonka Middle School West, ISD 276, located
6421 Hazeltine Boulevard.
2. Pro pert . The permit is for property situated in the City of Chanhassen, Carver County,
Minnesota, and legally described as follows:
LEGAL DESCRIPTION
The Southwest Quarter (SW 1/4) of the Northwest Quarter (NW 1/4) of Section
Three (3), Township One Hundred Sixteen (116), Range Twenty Three (23) West,
according to the U. S. Government Survey thereof, excepting therefrom the
35/100ths acres conveyed by deed recorded in the office of the Register of
Deeds of Carver County, Minnesota, In Book 8 of Deeds, page 400, and that port
thereof conveyed by deed recorded in the office of the Register of Deeds of
Carver County, Minnesota, In Book 41 of Deeds, page 322, and subject to the
right, title and interest of the State of Minnesota in that strip of land conveyed
by dead recorded In the office of the Register of Deeds of Carver County,
Minnesota, in Book 33 of Deeds, page 25.
Also that part of Lot E. Bardweil Acres, not conveyed by said deed recorded in
the office of the Register of Deeds of Carver County, Minnesota, in Book 41 of
Deeds, page 322.

3. Conditions. The permit is issued subject to plans dated November 27, 2013 prepared
by Inspec, Inc. and the following conditions:
a. New retaining wall(s) exceeding 48 inches in height will require a professional design
and building permit.
b. "No Parking Fire Lane" signage and yellow painted curbing will be required. Contact
Chanhassen Fire Marshal for exact location of signs and curb to be painted yellow.
c. The applicant shall install a minimum of six deciduous trees.
d. The interior width of the landscape islands or peninsulas shall be 10 feet.
e. All parking stalls shall be marked with painted lines not less than four inches wide in
accordance with the approved plan.
f. Staff recommends the applicant installs forebays at each curb cut.
g. All seed mixes shall be from the MN State Seed Mix list.
h. Seed mix 25 -141 shall be replaced within the filtration swale with 33 -262 or its
equivalent.
i. The plan shall call out MNDOT 3877 Filter Topsoil Borrow or shall otherwise limit the
clay content to less than 5% of the topsoil portion.
j. The applicant must develop an operations and maintenance manual addressing the
anticipate inspection and maintenance schedule for the filtration Swale as well as
measures to assure that the swale functions according to design. This must be provided to
the city and provisions must be included to allow for City staff to inspect as is required
under the Municipal Separate Storm Sewer System permit issued in August of 2013.
k. Inlet protection shall be called out and installed at all catch basins and catch basin
manholes.
1. Inlet protection shall be called out and installed at all curb cuts into the filtration swale
until the swale is fully stabilized.
m. Remove all references to a filter sock around the underdrain as is shown in detail 11 on
page C5.
n. The applicant must apply for and receive coverage under the NPDES permit. Proof of
this must be provided to the City.
o. The plans shall be revised to note the style of the existing grated manhole covers and, if
they are to be upgraded, note the new style.
p. A $5,000 escrow for restoration and erosion control will be required with the permit.
q. The applicant must provide a proposed haul route for review and approval.
r. An as -built grading plan is required once site grading is complete.
s. The applicant shall show the retaining wall on the grading plan.
t. The plan must follow all applicable state and federal guidelines
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lapse. If within one year of the issuance of this permit the authorized construction has
not been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
