SUMMARY OF REQUEST: The City is proposing the rezoning of the property from RSF, Single
Family Residential District, to 01, Office and Institutional. The property is used for Fire Station #2.
Notice of this public hearing has been mailed to all property owners within 500 feet.
LEVEL OF CITY DISCRETION IN DECISION-MAKING:
The City has a relatively high level of discretion in approving rezonings, PUD's, and amendments to
PUD's because the City is acting in its legislative or policy making capacity. A rezoning or POO, and
amendment thereto, must be consistent with the City's Comprehensive Plan.

PROPOSAL SUMMARY
As required by the 1995 amendment to the Metropolitan Land Planning Act, the city is required
to bring land use and zoning into compliance. The proposal to rezone the City's Fire Station to
Office & Institutional from Residential Single Family is one of the few rezonings that can be
undertaken without a great need to hold an informational public hearing, since the city is only
legitimizing the use of the property for a public facility.
BACKGROUND
Fire Station #2 was constructed in 1981.
REZONING
Rezoning of the property from RSF to 01 is consistent with the city's adopted comprehensive plan
land use designation of Public/Semi-Public. Fire stations are only permitted in the 01 district.
DISCUSSION
Approval of the rezoning of the property from Single Family Residential to Office & Institutional is
consistent with the past approval of the development of the property as a fue station and
designation of the property for public/semi-public use. This amendment will bring the zoning and
use into compliance with the land use designation of the property.
PLANNING COMMISSION UPDATE
The Planning Commission held a public hearing on November 14,2000, to review the proposed
rezoning of the property located at 6400 Minnewashta Parkway ITom Single Family Residential,
RSF, to Office & Institutional, 01. The Planning Commission voted unanimously to recommend
approval of the proposed rezoning.
Staff would like to note that all the calls regarding the proposed rezoning from those notified by
mail or through the public notice in the paper were not opposed to the rezoning once the reason for
the rezoning was explained.
RECOMMENDATION
Staff recommends that the City Council adopt the following motion:
"The City Council approves the ordinance rezoning Chanhassen Fire Station #2 located at 6400
Minnewashta Parkway, from Single Family Residential, RSF, to Office & Institutional, 01."

AND RECOMMENDATION

Rezoning
On November 14, 2000, the Chanhassen Planning Commission met at its regularly
schedule meeting to consider the application of the City of Chanhassen for rezoning property
from Single Family Residential, RSF, to Office & Institutional, 01. The Planning Commission
conducted a public hearing on the proposed rezoning preceded by published and mailed notice.
The Planning Commission heard testimony from all interested persons wishing to speak and now
makes the following:
FINDINGS OF FACT
1. The property is currently zoned Single Family Residential, RSF.
2. The property is guided in the Land Use Plan for Public/Semi-Public.
3. The legal description of the property is: Part of Lot 2, Schmid's Acre Tracts
described as follows: Commencing at the most southerly corner of Lot 2, thence
northeasterly on the southeasterly line of Lot 2 413.94 feet to the point of
beginning, thence northwesterly deflecting to the left 71 degrees 260.53 feet,
thence northeasterly deflecting to the right I 1 1 degrees 287.73 feet, thence
southeasterly deflecting to the right 70 degrees 66.75 feet to the southeasterly line
of lot 2, thence southwesterly along the southwesterly line 279.04 feet to the point
of beginning.

4. The Zoning Ordinance directs the Planning Commission to consider six (6)
possible adverse affects of the proposed amendment. The six (6) affects and our
findings regarding them are:
a) The proposed action has been considered in relation to the specific policies and
provisions of and has been found to be consistent with the official City
Comprehensive Plan.
b) The proposed use is or will be compatible with the present and future land uses of
the area.
c) The proposed use confonns with all perfonnance standards contained in the
Zoning Ordinance.
d) The proposed use will not tend to or actually depreciate the area in which it is
proposed.
e) The proposed use can be accommodated with existing public services and will not
overburden the city's service capacity.
1) Traffic generation by the proposed use is within capabilities of streets serving the
property.
5. The planning report REZ #2000-02 dated November 14,2000, prepared by Robert
Generous is incorporated herein.
RECOMMENDATION
The Planning Commission recommends that the City Council approve the
rezoning.

Burton: Okay. I wasn't sure if we needed to do that if you accepted it but, that's fine. I don't know the
procedures.
Conrad: Only if! don't, then you vote on them separately. But as long as I do.
Burton: I don't think we have to. But in any event we can vote on the whole package.
Conrad moved, Kind seconded that the Planning Commission recommends approval of
Conditional Use Permit #2000-6 to permit the installation of a communication tower and site plan
approval for a 75 foot monopole and equipment platform, Sprint PCS, plans prepared by AEC
Engineering, dated 8/30/00, subject to the following conditions:
I. A building pennit is required to construct the platfonn and tower; the tower must be designed for
an 80 mph wind load and include the effect of one-half inch of radial ice.
2. The plans must be signed by a professional engineer licensed in the State of Minnesota.
3. The contractor shall meet with the Inspections Division as early as possible to discuss plan
review and pennit procedures.
4. The applicant shall submit a detailed grading, drainage, and erosion control plan for staff review
and approval.
5. The proposed use for the 12 foot wide gate opening must be shown on the grading plan and will
be used for access through the passage between the buildings.
6. The tower shall be of a color that blends in with the sky.
7. A letter of intent committing the tower owner and his or her successors to allow the shared use of
the tower if an additional user agrees in writing to meet reasonable tenns and conditions for
shared use shall be submitted to the city.
8. The tower be designed to be capable of accommodating future co-location.
9. Confirmation of the rejection by Eden Prairie of the site on their water tower.
10. The two conifers proposed for landscaping are other than Colorado Spruce.
All voted in favor and the motion carried unanimously.

Kind: I do have one actually. Sorry.
Burton: Go ahead.
Kind: I usually do. I thought this was a no brainer, and it really is but, if we granted a conditional use
permit for the fire station, would that be sufficient to bring it into compliance?
Generous: It's not permitted in the district.
Kind: Okay. I'm just thinking what if it's not a fire station in the future, is this the zoning we would
want for that parcel?
Generous: High visibility. We could use it for a library.
Kind: I think it's probably appropriate because of it's proximity to Highway 7.
Generous: We're actually looking for, in the future we'll probably have a Fire Station 3 that's location
more south. Long term to help serve that area of the community as it develops. It's a long way from
downtown to the north side of Lake Minnewashta.
Kind: It makes total sense to me. It was just another way I thought that we could legitimize the use.
Generous: No, it's not permitted in the district.
Kind: Sorry Matt.
Burton: That's alright. I kind of expect it. Any other. I'd be disappointed if you didn't have a question.
Any other questions for staff? Okay, and I don't think we have an applicant here because you are the
applicant. I guess we'll open it to public hearing.
Sacchet moved, Sidney seconded to open the public hearing. The public hearing was opened.
Burton: You didn't want to comment on that did you?
Debbie Lloyd: ... future use, you question it. Just one little piece ofland but.
Kind: It seems appropriate to be office industrial, it really does.
Generous: Institutional.
Kind: Do you want to come up here?
Debbie Lloyd: No.
Sacchet moved, Sidney seconded to close the public hearing. The public hearing was closed.

Sacchet: So we're basically saying what we decided before is indeed what we decided?
Generous: Correct.
Sacchet: Okay, that should be easy.
Conrad: Well we decided where it would, we said it could go there but we didn't agree with the design.
Kind: Right. Right. But it's in compliance with our zoning. Bob, just out of curiosity, what was the
approved design for the Lake.
Generous: Building with the block.
Kind: So it didn't get upgraded or changed or beautified as we recommended?
Generous: Right.
Kind: Bummer. I'd like that on the public record.
Conrad: The standard holds true for others but not for us.
Burton: So we're being asked to approve this resolution that's attached?

AN ORDINANCE AMENDING CHAPTER 20 OF THE
CHANHASSEN CITY CODE, THE CITY'S ZONING ORDINANCE,
BY REZONING CERTAIN PROPERTY
THE CITY COUNCIL OF THE CITY OF CHANHASSEN ORDAINS:
Section 1. Chapter 20 of the Chanhassen City Code, the City's zoning ordinance, is hereby
amended by rezoning all property from Single Family Residential, RSF, to Office & Institutional,
01 located at 6400 Minnewashta Parkway, Chanhassen Fire Station #2 and described as follows:
Part of Lot 2, Schmid's Acre Tracts described as follows: Commencing at the
most southerly corner of Lot 2, thence northeasterly on the southeasterly line of
Lot 2 413.94 feet to the point of beginning, thence northwesterly deflecting to
the left 71 degrees 260.53 feet, thence northeasterly deflecting to the right 111
degrees 287.73 feet, thence southeasterly deflecting to the right 70 degrees
66.75 feet to the southeasterly line of lot 2, thence southwesterly along the
southwesterly line 279.04 feet to the point of beginning.
Section 2. The rezoning of this property is subject to all conditions of City Council
approval.
Section 3. The zoning map of the City of Chanhassen shall not be republished to show the
aforesaid zoning, but the Clerk shall appropriately mark the zoning map on file in the Clerk's Office
for the purpose of indicating the rezoning hereinabove provided for in this ordinance, and all of the
notations, references, and other infonnation shown thereon are hereby incorporated by reference
and made a part of this ordinance.
Section 4. This ordinance shall be effective immediately upon its passage and publication.
