Re: Subdivision Request for 685 Carver Beach Road - Planning Case 05-15
Dear Mr. O'Kelly:
This letter is to discuss the subdivision of your property and City ordinances
pertaining to this issue.
Your property consists of 24 lots under single ownership (Lots 2969-2980 and
Lots 3018-3029). You wish to separate the property into two parcels. Parcel A
which contains a single family home (Lots 2974-2980 and 3023-3029) will have
an area of 28,000 square feet and Parcel B (lots 2969-2973 and lots 3018-3022)
will have an area of 20,000 square feet. Parcel B will house a future home. Since
these lots are existing lots of record, you may place Parcel B under a separate
Parcel Identification Number (PIN). You can obtain the PIN through the Carver
County Auditor's Office. A subdivision is not required for your request; therefore, I
am returning your application fee totaling $875.00.
One issue I need to discuss deals with Parcel B. Based upon the information that
you have submitted, the lot area, width and depth is in compliance with City
ordinances. However, this parcel contains a wetland and appears to have some steep
grades. During our conversations, I explained that the City has bluff and wetland
protection ordinances. You believe that the slopes do not meet the bluff definition.
The City code requires a registered land surveyor to make that determination. Also,
the wetland appears to extend along the entire westerly portion of the property.
Required wetland setbacks must be maintained. It is your belief that Parcel B
contains a buildable area that will be able to meet the required wetland setback. The
City code requires all wetlands to be delineated by a wetland delineator.
Any development of the lot must comply with current City zoning ordinances
including bluffs and wetlands.
