Vacate all existing public drainage and utility easements within the Gateway 2nd
Addition (East Water Treatment Plant) site.
BACKGROUND
The existing public drainage and utility easements were granted to the City as a part
of the Gateway East plat in 2001.
The Gateway 2nd Addition Plat was preliminarily approved by the City Council April
25, 2005,
DISCUSSION
The underlying outlot of the east water treatment property was originally platted as a
part of the Gateway East plat. As with all plats, standard drainage and utility
easements along the lot lines were granted to the City. With the construction of the
proposed water treatment plant, new drainage and utility easements have been
dedicated to the City. In order to remove the old easement encumbrances on the new
lots, the City will need to vacate the old easements.
RECOMMENDA TION
Staff recommends that the City Council adopt the following motion:
"The Chanhassen City Council approves a resolution vacating the existing public
drainage and utility easements as defined on the attached vacation description.

May 9, 2005, the duly qualified and acting Deputy Clerk of the City of Chanhassen, Minnesota;
that on said date she caused to be mailed a copy of the attached notice of Notice of Public
Hearing for Vacation of Easements in Gateway East Second Addition - Vacation File No.
05-02 to the persons named on attached Exhibit "A", by enclosing a copy of said notice in an
envelope addressed to such owner, and depositing the envelopes addressed to all such owners in
the United States mail with postage fully prepaid thereon; that the names and addresses of such
owners were those appearing as such by the records of the County Treasurer, Carver County,
Minnesota, and by other appropriate records.
