SUMMARY OF REQUEST: The applicant is requesting an amendment to the existing sign criteria for the Medical Arts Buildings Phase I and II. Notice of this public hearing has been mailed to all property owners within the required 500 feet. Staff is recommending approval of the request with conditions. If it meets these standards, the City must then approve the site plan. This is a quasi - judicial decision. PROPOSAL /SUMMARY The applicant is requesting an amendment to the sign criteria for the Medical Arts Buildings Phases I and II. The current criteria limits the number of signs on the north and south elevations of each building. The applicant is requesting the signs be limited to a sign band rather than a fixed number of signs. The site is located at the northwest comer of the intersection of Great Plains Boulevard and West 78a` Street. Access to the site is gained via West 781 Street. Based upon the foregoing, staff is recommending approval of the sign plan amendment. APPLICABLE REGULATIONS Chapter 20, Article II, Division 6, Site Plan Review Chapter 20, Article XXVI. — Signs On May 22, 1989, the City Council approved the preliminary plat and site plan application for the Medical Arts Buildings. The site plan review was approved with two buildings to be built in two phases. Phase I building was completed in 1990 and Phase II in 1992. Due to the size of the building and potential number of offices within the building, the City wanted to insure a detailed sign plan was in place. This plan limited the number of signs within a designated strip as well as the number of signs allowed on each building. ANALYSIS When these buildings were constructed, Ridgeview Medical was the major occupant of the building. Since then, the medical office built their own building and left the site. The space within the Medical Arts Buildings has been reconfigured and leased to a number of smaller businesses. Staff often receives requests for signs on these buildings and informs the applicant that the allotted number of signs permitted on the building has been used. Staff contacted the management company for the site and advised them to request an amendment to the criteria governing this site. The existing location of the sign strip would remain unchanged and all the applicable regulations remain the same. The only recommended change is removing the limit on the number of signs on the building. This is a practice that can be observed on all buildings within the City of Chanhassen. Staff underlined and highlighted pthe criterion that is recommended to be deleted. An exhibit will be added showing the location of the sign band where signs may be located. Medical Arts Building Phase I a. Wall Mounted Signs: 1. Signs are only allowed within a continuous 27" high band near the roof line on the north and south sides of the building, including the projections over entries. Signs shall be attached directly to the building siding and not project above or below the designated sign area. 2. All signs shall be comprised of individual letters and/or logos. Letters shall not exceed 12" in height and logos shall not exceed 24" in height. 3. The total number of signs allowed on the building is ten, five on the north and five on the south side of the building. 4. Signs along the north elevation of the building shall not be illuminated during non - business hours. Signs along the south elevation may be illuminated during any hour. b. Free Standing Signs: Monument Sign: One Single Sided monument sign for building identification (not tenant identification) may be placed in the southwest yard between the building and the sidewalk. The top of the sign may not exceed 4 feet in height. The dimensions of the sign may not exceed 2 feet high by 14 feet wide. The copy shall have a maximum height of one foot and be internally illuminated. c. General: 1. One non - illuminated temporary real estate sign which advertise sale of the building or space for lease within the building. The area of the sign shall not exceed 12 square feet nor exceed 5 feet in height nor be located less than 10 feet from the property line. The sign shall be removed within seven days following sale, lease, or rental of the property. 2. The applicant must obtain a sign permit prior to erecting any signage on site. 3. Stop sign shall be installed at the exit point proposed on West 78th Street." A tenant may have no more than two signs with the building having a maximum of 14 signs total on the north and south sides Copy is restricted to the tenant's nroner name or service offered. 4. Signs on the north and south elevations shall be illuminated. The lights of the signage on the north side of the building, facing the Heritage Park Apartments, shall be turned off when business hours are over. b. Free Standing Signs: Monument Sign: One single sided monument sign for building identification (not tenant identification) may be placed in the southwest yard between the building and the sidewalk. The top of the sign may not exceed 4 feet in height. The dimensions of the sign may not exceed 2 feet high by 14 feet wide. SIGN PLAN FINDINGS In evaluating a sign plan, the City shall consider the development's compliance with the following: (1) Permanent and temporary signs have a direct impact on, and a relationship to, the image of the community; Planning Commission Medical Arts Buildings Signage — Planning Case 2014 -34 November 28, 2014 Page 6 of 6 (2) The manner of installation, location and maintenance of signs affects the public health, safety, welfare and aesthetics of the community; (3) An opportunity for a viable identification of community business and institutions must be established; (4) The safety of motorists, cyclists, pedestrians and other users of public streets and property is affected by the number, size, location and appearance of signs that unduly divert the attention of drivers; (5) Installation of signs suspended from, projecting over, or placed on the tops of buildings, walks or other structures may constitute a hazard during periods of high winds and an obstacle to effective firefighting and other emergency service; (6) Uncontrolled and unlimited signs adversely impact the image and aesthetic attractiveness of the community and, thereby, undermine economic value and growth; (7) Uncontrolled and unlimited signs, particularly temporary signs, which are commonly located within or adjacent to public right -of -way, or are located at driveway /street intersections, result in roadside clutter and obstruction of views of oncoming traffic. This creates a hazard to drivers and pedestrians and also adversely impacts a logical flow of information. Finding: The proposed amendment to the sign plan will be consistent with the sign ordinance. All signs must receive a sign permit prior to installation. The sign band area will limit the total signage permitted on the building. RECOMMENDATION Staff recommends the Planning Commission adopt the following motion: The Planning Commission recommends the City Council approve the attached Sign Plan for the Medical Arts Buildings Phase I and II located on Lots 1 & 2, Block 1, Medical Arts Addition." The Planning Commission conducted a public hearing on the proposed sign plan preceded by published and mailed notice. In the early 1990's both 470 and 480's Sign Plan was established. At that time the buildings were occupied by very few tenants as each tenant occupied a significant amount of the buildings square footage thus making the original sign plan's intent work well. Since that time the buildings have seen a significant change in the tenant mix and the amount of tenants that occupy the building. Gone are the large tenants that occupied a majority of the building. What has blossomed today are some great small businesses that take up many small suites in the building. Therefore, our request is to update the sign plan for both buildings in order to give our small businesses the ability to advertise their name on the exterior of the building in order to be even more successful. Attached are images of the sign areas of the building that are being underutilized at this time based on the current sign plan requirement. We ask that the sign plan allow both 470 and 480's buildings to have 12 signs on the exterior sign area that faces W 781h Street and 12 signs on the exterior sign area that faces the parking lot (north side of the building). We are not requesting any other changes to the plan. The north side signage would remain non - illuminated and the south side (W 78th St.) would still have the option to illuminate.
