J.Valek Construction in the amount of $113,590 and approves agreements with the Highover Homeowners Association (HOA) and property owner. Award of the contract is contingent on the City receiving the funding from the Highover Homeowners Association." City Council approval requires a simple majority vote of the City Council present. Park & Recreation Phone: 952.2271120 BACKGROUND Fax 952 22T1110 In 1997, the Highover Development was approved by the City Council. The R Center development included a large boulder wall at the entrance of the development to 23110 0 Coulter ter Boulevard oul Phone: 952.227.1400 preserve trees and for an aesthetic entry into the neighborhood. Through the Fax: 952.227.1404 development process, the City secured an outlot at the corner of Lake Lucy Road and Highover Drive for a future trail corridor. The trail however was never Planning & constructed and is not in the Trail Comprehensive Plan. The boulder wall is Natural Resources constructed on City property and within the City right of way. Only a small Phone: 952.227.1130 Fax: 952.2271110 portion of the boulder wall is on private property. The adjacent homeowner and the HOA maintain the City -owned property. Public Works 7901 Park Place DISCUSSION Phone: 952.227.1300 Fax: 952.227.1310 The spring of this year was recorded as one of the rainiest springs on record. The wet spring was capped off on June 19n with a 5" rain event in less than 6 hours. Senior Center This event caused soil around the wall to become over saturated which weakened Phone: 952.227.1125 Fax: 952.227.1110 the soil and caused the wall to fail. Some of the boulders fell on Highover Drive. City crews removed the boulders from the street. A portion of the wall continued Website to move after June 19`h so it was decided to take down the portion of the wall that www.ci.chanhassen.mn.us was still moving due to safety concerns. Since most of the wall is on City property a wall engineer was contacted to redesign the portion of the wall that failed. The new wall will include drain tile, Chanhassen is a Community for Life - Providing for Today and Planning for Tomorrow Todd Gerhardt Highover Boulder Wall Repair: Award Bid November 24, 2014 Page 2 geogrid and sand and good drainage rock to improve the strength of the wall. The wall will be constructed outside the right -of -way along Highover Drive. A portion of the failed wall will still need to be constructed on the City's outlot. See attached layout. Staff also reviewed an option to remove most of the wall and slope the area back. Removing the wall and regrading the area would create significant impacts to the adjacent property and require many mature trees to be removed. Staff received a quote in the amount of $91,150.00 for this work. The adjacent property owner objected to this option since the slope would come up against the foundation of the house, and make the backyard unusable. Staff has moved forward with the wall replacement option. Most of the wall reconstruction is eligible for FEMA funding. The portion of the wall that is on private property is not eligible for FEMA funding. The draintile and geogrid included in the design are only 15% eligible for mitigation reimbursement by FEMA. It is proposed the HOA and the homeowner pay for the wall on private property. The HOA has agreed to pay $8,000 and the adjacent property owner has agreed to pay $7,786.47 for the improvement. The property owner wishes to have their portion assessed. Terms of the assessment are 8 years at 3.25% interest. The City is proposing to pay for additional draintile and geogrid to strengthen the wall not on private property. The City portion for this work is $8,167.52. FEMA is expected to pay for the remaining cost of construction and indirect costs. FEMA will reimburse the City for these costs after the project is completed and the necessary paperwork is submitted. Below is the breakdown of the wall funding: Bidder Totals Homeowners Association $8,000.00 Property Owner $7,786.47 City Funded $8,167.52 FEMA $89,636.01 Total Construction Cost $113,590.00 Bids were received on October 2, 2014.
