PROPERTY IS LOCATED AT THE SOUTHWEST CORNER OF LYMAN AND POWERS BOULEVARDS. APPLICANT: LEVEL 7 DEVELOPMENT, LLC. Chairman Aller outlined the process for reviewing a Concept Planned Unit Development. Kate Aanenson presented the staff report on this item. Alyson Fauske addressed issues pertaining to water resources. Speaking on behalf of Level 7 Development, Darren Lazan with Landform Professional Services reviewed the work that’s been done to date and explained that they are looking for resident and commission feedback to proceed forward with updating the AUAR. After thanking the applicant for holding open houses for residents, Chairman Aller asked if Planning Commission Summary – February 17, 2015 feedback gained from those open houses will be shared with city staff. Commissioner Undestad asked for an explanation on why the 40 acre parcel has dropped off of the application. Commissioner Weick asked for clarification of the term anchor. After asking for clarification of what defines a big box, Chairman Aller opened the meeting for public comments. Stephen Silverman, 18519 Pathfinder Drive, Eden Prairie voiced his support and explained that there aren’t many options in the Twin Cities like what is being proposed in this concept. P.J. Degane, Reflections Road stated this would be a great amenity to have in Chanhassen especially with the easy access off of Highway 212, and liked the conservation area acting as a buffer to the residential neighborhood. Joseph Shamla, 1691 Mayapple Pass expressed concern with the amount of cut through traffic that’s going to be using Bluff Creek Drive to get to this mall because residents in the Pioneer Pass neighborhood need to cross Bluff Creek to go to their park. Becky Fluegge, 1671 Mayapple Pass stated that she is a proponent of this concept because they moved out here for not only the small town feel but to be a part of an up and coming suburb. She echoed Mr. Shamla’s safety concerns. Charles Gust, 1941 Commonwealth Boulevard expressed concern with bringing in competition to existing businesses. Toby Collador, 1833 Cottongrass Court voiced support for bringing additional retail to the 212 area in Chanhassen and illustrated safety concerns with increased traffic on Bluff Creek Drive. Sylvia Deyoung, 9220 Allendale Lane explained that when she and her husband moved back to the Twin Cities from San Francisco 5 years ago, why they chose Chanhassen and that she would welcome something that would be convenient for her family to walk to but expressed concern with traffic, safety, and increased crime associated with this type of development. Andy Kim, 9070 Degler Circle asked that the commission and council take the time to read all the emails that have been sent and keep the citizens in mind while reviewing this proposal. Brad Sundstrom, 1808 Marigold Court voiced his support for what’s being proposed with this lifestyle center. John Gilbert, 1641 Jeurissen Lane stated he was aware of the development plans when he built his home and supports the planned unit development, but has concerns with the survey, AUAR, and questioned the economic impacts. Jeff Franz, 8950 Sunset Trail expressed safety concerns with Lyman Boulevard, especially when school is in session and does not see where he is benefiting from this development. Zhexin Zhang, 1455 Bethesda Circle expressed safety concerns with Bluff Creek Boulevard, the proposed high density residential area, and the possibility of a hotel going in. Rod Franks, 1675 Hemlock Way voiced concern with replicating services already provided in downtown Chanhassen. Chairman Aller closed the public hearing. Darren Lazan addressed the issues of permitted uses, traffic concerns and including the 40 acre parcel in the AUAR process. Commissioners Undestad, Weick and Chairman Aller provided comments on what they expect from the developers in proceeding with the process. Hokkanen moved, Yusuf seconded that the Chanhassen Planning Commission provides the City Council with comments and feedback on the Concept Planned Unit Development along with the following staff comments: 1. If the Planning Commission supports the concept plan, the Regional Commercial Zoning District shall be followed. 2. To receive Regional Commercial zoning, the ordinance requires that the property be under one owner and be developed under a Planned Unit Development. The developer is 2 Planning Commission Summary – February 17, 2015 required to demonstrate that they are meeting the vision of the 2030 Comprehensive Plan as well as the intent of the zoning district. 3. The AUAR will need to be updated for the entire 118 acre site. 4. As part of the AUAR update the developer shall provide a full Traffic Impact Analysis (TIA) based on the proposed land uses. The study shall include the following:  Updated current and 20 year projected traffic volumes  Analysis of turning movements  Level of service analysis, including recommendations for improvements should the projected level of service fall below the acceptable level  Analysis of existing and proposed turn lanes to the development and recommendations for stacking lengths 5. Landscaping requirements shall be as follows: In Commercial/Office areas:  Parking lot landscaping requirements  Bufferyard landscape requirements  Foundation plantings  Boulevard trees along public streets In Residential areas:  Tree Preservation/Canopy Coverage requirements  Bufferyard requirements  Foundation plantings  Boulevard trees along public streets In the Bluff Creek Overlay District:  Entire wooded area in southwest corner within Primary Corridor therefore should be identified for preservation 6. Future right-of-way needs for Lyman and Powers Boulevards will need to be addressed, especially in the areas of the intersections. 7. Walk and trail locations need to be determined and accommodated along the roadways, adequate right-of-way or easements need to be preserved. 8. Utilities will need to be addressed during design. 9. A park dedication requirement either in the form of land dedication or the payment of park fees, or a combination of both will be a component of any agreed upon conditions of approval for the proposal. Park fee credit is not granted for the inclusion and/or construction of private recreation amenities. 3 Planning Commission Summary – February 17, 2015 10. All proposed structures and spaced within the PUD need to be connected by a combination of pedestrian walkways, sidewalks and trail to these existing pedestrian trail corridors. Existing trail improvements include the Lyman Boulevard Trail, the Powers Boulevard trails and the Bluff Creek Boulevard trails. Consideration should be given to providing a pedestrian connection through the preserved woodlands to the Camden Ridge development via Miranda Way. 11. The buildings are required to have automatic fire extinguishing systems. 12. Building plans must be prepared and signed by design professionals licensed in the State of Minnesota. 13. Soil evaluation (geo-technical) report required. 14. Retaining walls over four feet high must be designed by a professional engineer and a permit must be obtained prior to construction. All voted in favor and the motion carried unanimously with a vote of 6 to 0. Chairman Aller called a recess at this point in the meeting. APPROVAL OF MINUTES: Commissioner Weick noted the verbatim and summary Minutes of the Planning Commission meeting dated February 3, 2015 as presented. ADMINISTRATIVE PRESENTATIONS. Kate Aanenson provided updates on action taken th by the City Council at their February 9 meeting, thanked Commissioner Tennyson who announced she was resigning from the Planning Commission, and outlined the schedule for upcoming meetings. Undestad moved, Yusuf seconded to adjourn the meeting. All voted in favor and the motion carried unanimously with a vote of 6 to 0.
