PROPOSAL/SUMMARY
The applicant is requesting an Interim Use Permit to permit the r•einoval of organic soils (peat)
from the propei-ty and the stockpiling of soil on the property in anticipation of the eventual
development of the site. The estimated amount of cut fi�om the site is 52,478 cubic yards of
material. The estimated amount of fill material being stockpiled is 91,000 cubic yards.

BACKGROUND
On September 1 l, 1995, the City approved Interim Use Pel7nit#95-3 for the placement of 36,000
cubic yards of fill material on the site.
In 1957, the Holaseks, Betty and Earl, founded the nursery and greenhouse on the property which
operated until the end of 2014.
ANALYSIS
Chadwick Group, Inc. has submitted an application to excavate up to 52,478 cubic yards on the
property located at 8610 Galpin Boulevard. Historically the site has been used as a greenhouse
operation. This operation has since ceased and the site will likely be redeveloped in the near
future. In anticipation of this the applicant has identified areas on the site that contain soils that
are unsuitable for building pads, parking and other site developinent ainenities. These soils are
proposed to be excavated. The applicant pi-efers to remove the excavated material from the site.
In the event that an off-site location is not found for the inaterial the applicant has identified two
stockpile areas.
Two areas are proposed to be excavated, each to a depth of approximately 10 feet. The northern
excavation consists of approximately 25,300 cubic yards of cut; approximately 27,200 cubic
yards of cut is expected fi•om the southern excavation.
Two stockpile areas are identified in the northwest corner of the property. The stockpiles will
contain material suitable to make the appropriate soils corrections on the site. The larger
stockpile in the northwest coi-ner would be about 30 feet lugh within a 340-foot by 340-foot area.
A second stockpile to the east would be about 20 feet high within a 200-foot by 350-foot area.
There are currently buildings within the proposed stockpile areas. A deinolition permit has been
issued to remove all of the buildings froln the site.
An underground pipeline bisects the property and some of the proposed earthwork is in close
proximity to the pipeline. The applicant confirmed that the pipeline company has an easeinent
over this utility. Prioi•to gi-ading within the pipeline easement the applicant must provide the
pipeline company a copy of the grading plan and obtain any necessary pez-mits.
Access to the site for the grading operation will be from the existing driveway at Lyman
Boulevard. Before grading operations commence the applicant must provide the Engineering
Department with the proposed haul route. Any changes to the haul route must be communicated
as needed throughout the grading operation.

This site is tributary to Lake Hazeltine which is included on the Section 303D list for impaired
water bodies. Care should be taken during any activities on the site to i�npr•ove the quality of
runoff from the site, thereby improving the water quality of Lake Hazeltine.

from February of 2015 around the
buildings and November of 2005 in the agricultural field area. The 2005 borings revealed
several areas with peat layers as deep as 24 feet. In some cases, water was observed within the
borings but no time was allowed to obseive the static water elevation. Aerial photographs were
reviewed for the area back to 1937. In several of these photographs the area presents with
signatures indicative of wetland conditions.
Because of this data, it is not possible to conclude that wetland does not exist on site.
Observation of three parameteis is required in order for an area to be classified as a wetland:
hydric soils, a dominance of hydrophilic vegetation under"normal conditions" and hydrology.
Based upon the U.S. Army Corps of Engineers Wetland Delineation Manual (Corps Manual),
soils and vegetation appear to be met. However, there is some question as to whether hydrology
would be inet. Staff inet with the applicant and it was decided that piezometers shall be installed
by the applicant in the questionable areas and obsei-ved by city staff for a reasonable time to
detennine if hydrology is present as defined in the Corps Manual.
If the area is found to have hydrology, a delineation of the wetland areas will be requu•ed and any
activities must be in compliance with the MN Wetland Conservation Act and the Federal Clean
Watei-Act. If thei•e is an absence of adequate hydrology then the excavation can proceed as
planned. The Wetland Consetvation Act does allow for excavation in Type l, 2 and 6 wetlands
as long as the excavation does not convert the area to deep water habitat or other non-wetland
cover type. However, the applicant would not be able to fi11 in the excavated areas at a later date
without that being considered a wetland impact.

RECOMMENDATION
Staff recommends that the Planning Commission approve the I�iterim Use Permit to pennit site �i
grading up to 52,478 cubic yards of excavation and 91,000 cubic yards of stockpile as shown on 'I
the plans prepared by Ronald C. Hedlund, dated Api-il 27, 2015, revised May 1, 2015, subject to
the following conditions and adoption of the attached Findings of Fact and Recommendation:
1. Prior to grading within the pipeline easement the applicant must provide the pipeline
coinpany a copy of the grading plan and obtaul any necessary permits.
2. Before grading operations commence the applicant must provide the Engineering Department
with the proposed haul route. Any changes to the haul route must be communicated as
needed throughout the grading operation.
3. Before grading operations commence the applicant must provide adequate evidence that the
areas with the potential to meet the criteria for classification as jurisdictional wetland are
either;
a. not wetland due to failure to present with adequate hydrology, or
b. are delineated according to the inethodologies set forth in the U.S. Army Coips of
Engineers Wetland Delineation Manual and a report must be submitted to the city for
review and approval in accordance with the Minnesota Wetland Conservation Act.
4. No excavation may occur within delineated wetlands that would not be considered no-loss of
wetland under MN Rules sections 8420.410, 8420.0415 and 8420.0420 or without meeting
proper sequencing and mitigation in accordance with the Minnesota Wetland Conservation
Act.
5. A security in the ainount of$1,000.00 sha11 be provided for erosion control, vegetation and
site stabilization.
6. The interim use permit shall tei7ninate on November 1, 2016.

Request for an Interim Use Permit for grading of the property to remove peat and stockpile
fill material on the pi•operty located at 8610 Galpin Boulevard.
On June 2, 2015, the Chanhassen Plaruung Coinmission met at its regularly scheduled
meeting to consider the application of Chadwick Group, Inc. and Holasek Fai-�ns, LP for an
Interim Use Pei�nit for grading operation. The Planning Cominission conducted a public hearing
on the proposed developinent preceded by published and mailed notice. The Planning
Cominission heard testiinony from all interested persons wishing to speak and now makes the
following:
FINDINGS OF FACT
1. The property is cul�eiltly zoned A-2, Agt-icultural Estate District.
2. The property is guided in the Land Use Plan for Office Industrial uses.
3. The legal description of the property is shown on the attached Exhibit A.
4. When approving an interim use pei7nit the City must determine the capability of a proposed
development with existing and proposed uses. The general issuance standards of the
conditional use Section 20-232, include the following 12 items:
a) The proposed grading operation will not be detr7mental to or endanger the public health,
safety, colnfort, convenience or general welfare of the neighborhood or the city. All
reasonable and appropriate erosion control measures shall be used to protect the public.
b) The proposed grading operation will be consistent with the objectives of the city's
comprehensive plan and the zoiung chaptei•and shall coinply with the grading requirements
of Chapter 7 of the City Code.
c) The proposed g1-ading operation will be designed, constl-ucted, operated and maintained so
to be compatible in appearance with the existing or intended character of the general
vicinity and will not change the essential character of that area.
d) The proposed grading opei-ation will not be hazardous oi•disturbing to existing or planned
neighboring uses.

e) The proposed grading opei-ation will be seived adequately by essential public facilities and
seivices, including streets,police and fire protection, drainage structures,refuse disposal,
water and sewer systems and schools; oi-will be served adequately by such facilities and �
services provided by the persons or agencies responsible for the establishment of the
proposed use.
fl The proposed g�•ading operation will not create excessive requirements for public facilities
and seivices and will not be detrimental to the economic welfare of the coininunity.
g) The proposed grading operation will not involve uses, activities, pi•ocesses,materials, �
equipment and conditions of operation that will be detrimental to any persons,property or ;
the general welfare because of excessive production of traffic,noise, smoke, fumes, glare, �'
odors,rodents, or trash. �I
h) The proposed grading operation will have vehicular approaches to the property which do
not create traffic congestion or intei-fere with traffic or sui7•ounding public thoroughfares.
i) The proposed gcading operation will not result in the destruction,loss or damage of solar
access,natural, scenic or historic features of major significance.
j) The proposed gr�adii�g operation will be aesthetically compatible with the ai-ea.
k) The proposed grading operation will not depreciate sui7•ounding property values.
1) The pr•oposed grading operation will meet standai-ds prescribed for cei�tain uses as provided
in Chapter 7,Articles III, of the Chanhassen City Code.

RECOMMENDATION
The Plamung Commission recommends that the City Council approve the proposed

Interim Use Permit—Soil Correction
Holasek Greenhouse Parcel
Narrative
The site has significant deposits of high organic peat soil. This soil is unsuitable for building purposes.
The material does have a use in soil blends particularly the high clay content soils found in the area. The
idea is to put to good use, that which Mother Nature created, and make for better gardens in the area.
By undertaking this operation at this time, it allows for an orderly usage of the material. If left until the
development stage, it will have to be moved in a hurry and will likely be in the way. Each of those
factors are a detriment to site development.
Wetlands—there is a marsh at the far south west corner of the site. This is nowhere near the areas that
will be disturbed. There is a hill separating the area of operations and the marsh.
Runoff—The peat deposit is located in low areas on the farm. The natural drainage pattern is in to this
area. Remaving soil will further lower the site. It is not expected that there will be detrimental erosion,
(as water runs down hill). Normal rains would drain into the site, not off of or away from the site.
Neighborhood Impact—The site is bounded by a railroad, and industrial districts both in Chanhassen and
Chaska. It is located on Lyman Bivd. CR 18 and the entrance is signalized making for an excellent, safe
entrance and exit for this operation and future uses of the site. The land is graded for office industrial
uses and is currently zoned A-2, Ag Estate.
Hours of Operation—While many of the neighboring uses may have 24 hour operations, it is expected
this would be a 7am to 7pm operation.
Conclusion:
We would like to get started just as soon as possible so we could get the good soil to folks this year. It
will be beneficial to the site, reducing future costs and allowing greater site utilization. In order to
complete, we must begin.
