The plat of BEEHIVE HOME 2ND ADDITION will re-dedicate the D & U easements that were dedicated over drainage feature. The plat will relocated the perimeter D & U easements to con•espond with the new lots lines. The vacation will simplify the dedication of new drainage and utility easements and the relocation of the perimeter drainage and utility easement within one plat document. The preliminary plat is attached and staff will continue to work with the developer to ensure that the final plat incorporates all the required easement dedications. NOW, TH�REFORE, BE IT RESOLVED by the City Council of the City of Chanhassen: 1. The public drainage and utility easement legally described on the attached Exhibit A is hereby vacated. 2. The vacation shall not affect the authority of any person, corporation, or inunicipality owning or controlling the electric or telephone poles and lines, gas and sewer lines, water pipes, mains and hydrants thereon or thereunder, if any, to continue maintaining the same or to enter upon such way or portion thereof vacated to maintain, repair, replace, reinove, or otherwise attend thereto. 3. The City Manager is directed to file a certified copy of this Resolution with the County Auditor and County Recorder of Carver County. 4. This resolution shall be i•ecorded prior to but concun•ent with the recording of the final plat for BEEHIVE HOME 2ND ADDITION.
