INTERIM USE PERMIT #2015-12
1. Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen
hereby grants an interim use permit for the following use:
To permit the removal of organic soils (peat) from the property and the stockpiling of soil
on the property. The estimated amount of cut from the site is 52,478 cubic yards of material.
The estimated amount of fill material being stockpiled is 91,000 cubic yards. The grading
plan was prepared by Ronald C. Hedlund, dated April 27, 2015, revised May 1, 2015.
2. Pro . The permit is for the following property situated in the City of Chanhassen,
Carver County, Minnesota, and legally described as shown on Exhibit A.
3. Conditions. The permit is issued to import fill to the site subject to the following
conditions:
a. Prior to grading within the pipeline easement the applicant must provide the pipeline
company a copy of the grading plan and obtain any necessary permits.
b. Before grading operations commence the applicant must provide the Engineering
Department with the proposed haul route. Any changes to the haul route must be
communicated as needed throughout the grading operation.
c. Before grading operations commence the applicant must provide adequate evidence that
the areas with the potential to meet the criteria for classification as jurisdictional wetland
are either;
1) not wetland due to failure to present with adequate hydrology, or
2) are delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city
for review and approval in accordance with the Minnesota Wetland Conservation
Act.
d. No excavation may occur within delineated wetlands that would not be considered no -
loss of wetland under MN Rules sections 8420.410, 8420.0415 and 8420.0420 or without
meeting proper sequencing and mitigation in accordance with the Minnesota Wetland
Conservation Act.
e. A security in the amount of $1,000.00 shall be provided for erosion control, vegetation
and site stabilization.
f The interim use permit shall terminate on November 1, 2016.
g. Before grading operations commence, the proposed grading area south of pipeline must
be delineated according to the methodologies set forth in the U.S. Army Corps of
Engineers Wetland Delineation Manual and a report must be submitted to the city for
review and approval in accordance with the Minnesota Wetland Conservation Act.
4. Termination of Permit. The City may revoke the permit following a public hearing for
violation of the terms of this permit.
5. Lapse. If within one year of the issuance of this permit the authorized construction has
not been substantially completed or the use commenced, this permit shall lapse, unless an extension
is granted in accordance with the Chanhassen Zoning Ordinance.
6. Criminal Penaltv. Violation of the terms of this conditional use permit is a criminal
misdemeanor.
7. This permit shall expire with the completion of the site improvements approved by this
permit.
