SUBJ: Official Mapping of TH 101 from Pioneer Trail (CSAH 14) to
Flying Cloud Drive (CSAH 61)
PROPOSED MOTION:
"The Chanhassen Planning Commission recommends that City Council approve
the official map of TH 101 from Pioneer Trail (CSAH 14) to Flying Cloud Drive
(CSAH 61)."
PROPOSAL/SUMMARY
The city is proposing to officially map the realigned TH 101 corridor from Pioneer
Trail (CSAH 14) to Flying Cloud Drive (CSAH 61). After an official map has been
adopted and filed, the issuance of building permits by the city shall be subject to the
provisions of the official mapping article. The city shall deny every application for a
permit to construct a new building or structure or expand an existing building or
structure within an area designated on the official map for street or other public
purposes. Whenever any street or highway is widened or improved or any new street
is opened, or any interest in lands for other public purposes is acquired by the city, the
city is not required in such proceedings to pay for any building or structure placed
without a permit or in violation of conditions of a permit within the limits of the
mapped street or outside of any building line that may have been established upon the
existing street or within any area thus identified for public purposes. The adoption of
an official map does not give the city any right, title, or interest in areas identified for
public purposes thereon, but the adoption of the map does authorize the city to
acquire such interest without paying compensation for buildings or structures erected
in such areas without a permit or in violation of the conditions of a permit.

BACKGROUND
Website City staff has been working with MnDOT and Carver County on preliminary design
www.ci.chanhassen.mn.us and environmental review activities for the reconstruction of TH 101 between Pioneer
Trail (CSAH 14) and Flying Cloud Drive (CSAH 61). The project includes the
reconstruction and widening of the existing two-lane rural section roadway to a four -
lane divided urban section roadway. We are proposing to adopt an official map to

preserve the right-of-way that is needed for the proposed improvements. Minnesota Statutes
require that the Planning Commission recommend approval of the official map to the City
Council. A public hearing is scheduled to be held at the November 23, 2015 City Council
meeting. Notices of this public hearing will be mailed to all affected property owners within the
corridor.
DISCUSSION
The reconstruction of this segment of TH 101 is needed to address various traffic capacity and
safety issues. The preliminary design and environmental review process has included the
following tasks:
• Determination of Alignment Alternatives - Five alternative alignments were developed and
refined based on stakeholder input.
• Evaluation of Alignment Alternatives - The five alternative alignments were compared and
evaluated considering various screening criteria.
• Selection of Preferred Alignment - A preferred alignment has been determined.
• Environmental Review - An Environmental Assessment Worksheet (EAW) was prepared and
reviewed for the preferred alignment.
• Stakeholder Engagement - Agency staff meetings, public open house meetings, and
individual and group property owner meetings have been conducted as a part of the
preliminary design and environmental review process.
The next step in the process is the adoption of an official map to preserve the future right-of-way
that is needed for the proposed improvements.
The proposed improvements will require the acquisition of right-of-way and/or easements from
21 parcels including both full and partial takings. The parcels range from residential homesteads
to commercial and undeveloped properties. Six parcels need to be acquired in their entirety. The
attached official map details the parcels that will be impacted by the project.
The preliminary design and environmental review work has prepared the project for final design
and ultimately construction; however, the project construction is not currently funded or
scheduled. Due to the uncertainty in the timing of the project construction, Chanhassen, Carver
County and MnDOT are exploring the potential use of the Metropolitan Council Right -of -Way
Acquisition Loan Fund (RALF) program to purchase land to protect it from future
development/redevelopment and to address potential hardship situations. The preparation and
approval of an official map is a requirement of the RALF process.

Staff recommends that the Planning Commission recommend approval of the official map for
TH 101 from Pioneer Trail (CSAR 14) to Flying Cloud Drive (CSAH 61).
