Churches are listed as an interim use in the Industrial Park District regulations. In conjunction with the church, an adult day care facility, Prairie Adult Care, Inc., is proposing to co -locate as an accessory use to the church. The adult day care shall meet all the licensing requirements of the state and will be licensed for up to 30 clients. The day care will operate Monday — Friday from 7:00 a.m. to 5:00 p.m. 1 11 1 The church currently has a membership of 32 adult members. There are presently services on Sunday with the use of the offices the rest of the week. They would like to start mid -week programs on Wednesday evenings at some point as the congregation grows and additional programs are desired by its members. APPLICABLE REGULATIONS Chapter 20, Article IV, Conditional Uses Chapter 20, Article IV, Division 5, Interim Use Permits Chapter 20, Article XXII "IOP" Industrial Office Park District BACKGROUND The church initially began occupying this building for its business office. When they first contacted the city, they were advised that if they wanted to have their assembly in the building, they would need to receive an interim use permit. The 56,000 square -foot building was approved on December 2, 1985 and constructed in 1986 as the Opus Business Center II. There are 195 parking spaces surrounding the building with a proof of parking for an additional 29 spaces. (Site Plan Review #85-11) The Chanhassen Lakes Business Park was approved on July 2, 1979. ANALYSIS The applicant will be occupying approximately 2,900 square feet of the 56,000 square -foot building, which represents five percent of the building. The assembly area maximum capacity is 122 people. They have three classrooms. Based on the city's parking standards (1/3 seats and 1 per classroom), they would need a maximum of 44 parking spaces. The church would like the ability to rent additional space as their congregation grows. They share common hallways and restroom facilities with the rest of the building. Due to its hours of operation, the peak hours of use do not compete, generally, for the use of parking spaces with other tenants. The purpose and intent of allowing interim uses is: (1) To allow a use for a brief period of time until a permanent location is obtained or while the permanent location is under construction; and (2) To allow a use that is presently acceptable but that with anticipated development will not be acceptable in the future. Storefront churches allow a congregation to grow until it can viably occupy their own building. Many churches start out in this fashion. While allowing some ability to expand in place, it is necessary to provide some restrictions on the potential size of the congregation while it occupies industrial space, providing an incentive for the church to find its own permanent facility. City code addresses the criteria for churches in commercial or industrial districts as follows: Section 20-296. Churches. The applicant shall be issued a two-year IUP permit. Upon renewal of the permit the applicant shall demonstrate adequate parking, life safety, and adequate occupancy. Building permit(s) are required for alterations necessary to provide code -compliant exiting for an assembly occupancy (church). Once the use is permitted, the applicant will need to apply for a building permit for building code changes and a fire permit for the proposed adult day care. The Arboretum Business Park has established standards for churches within an industrial building that provide guidance by limiting such uses to six percent of the building and a maximum congregation of 200. Staff would propose that the following standards be used to determine the extent of the use of this building for church facilities, i.e., assembly or worship halls and associated office, meeting, and other required spaces, subject to the following criteria: 1. The church shall not occupy more than six percent (6%) of the building on Lots 1 and 2, Block 4, Chanhassen Lakes Business Park. 2. The church congregation may not exceed 150 adult members. RECOMMENDATION Staff recommends that the Planning Commission recommend approval of the interim use permit to allow a church in an office industrial building subject to the following conditions and adoption of the attached Findings of Fact and Recommendation: Planning Commission Bethel Fellowship Church Interim Use Permit — Planning Case 2015-24 December 1, 2015 Page 4 of 4 1. Building permit(s) required for alterations necessary to provide code -compliant exiting for an assembly occupancy (church). 2. The applicant shall be issued a two-year Interim Use Permit (IUP). The IUP may be extended thereafter subject to the applicant demonstrating adequate parking, life safety, and adequate occupancy. The applicant must annually in December report its adult membership. 4. The church may not occupy more than six percent of the building (3,360 square feet). 5. On December 1, 2015, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Jonathan Wall with Bethel Fellowship Church for an interim use permit for the property located at 1252 Park Road. The Planning Commission conducted a public hearing on the proposed interim use which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The proposed church use will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. f. The proposed church use will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. g. The proposed church use will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. h. The proposed church use will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. i. The proposed church use will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. j. The proposed church use will be aesthetically compatible with the area. k. The proposed church use will not depreciate surrounding property values. 1. We use our space on Sunday mornings for our worship services, and daily as our offices. Currently we have about 60-70 people that meet on Sunday mornings. This past Sunday our attendance was 62. During the day we have 1 to 2 people here in the offices. We do not currently have any mid -week programs but we are hoping to start a Wednesday night event later this year that could have up to 20 people. That is just a guess, but it is unlikely that we would get more than a third of our body to come out on a Wednesday night. We figure that this space will allow us to grow to around 150 people and we would like to be able to rent some of the spaces around us as we grow, but the future is not that easy to predict. We also are working with an adult day care, and hopefully they will move in with us in December. They are at about 20 people and I believe they are licensed for 30. They would then be using the space Monday through Friday during the day as well. I am not sure what else there is to say, If you have questions I would be happy to answer them.
