Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen hereby grants an interim use to permit the following use: A Church use in the industrial office building located at 1252 Park Road. 2. Prop The permit is for the following property situated in the City of Chanhassen, Carver County, Minnesota, and legally described as: Lot 2, Block 4, Chanhassen Lakes Business Park. 3. Conditions. The permit is issued to permit a church to operate in the building subject to the following conditions: a. Building permit(s) required for alterations necessary to provide code -compliant exiting for an assembly occupancy (church). b. Once the use is permitted, the applicant will need to apply for a building permit for building code changes and a fire permit for the proposed adult day care. c. The applicant shall be issued a two-year Interim Use Permit (IUP). The IUP maybe extended thereafter subject to the applicant demonstrating adequate parking, life safety, and adequate occupancy. The applicant must annually in December report its adult membership. d. The church may not occupy more than six percent of the building (3,360 square feet). e. The interim use shall terminate and the church shall be required to relocate from the building once its adult membership exceeds 150. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of this permit. 5. Lapse. If within one year of the issuance of this permit the authorized use has not been commenced, this permit shall lapse, unless an extension is granted in accordance with the Chanhassen Zoning Ordinance. 6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal misdemeanor.
