Request for rezoning of property from A-2 to PUD-R; Subdivision
with variances of approximately 36.01 acres into 30 lots, 1 outlot,
and public right-of-way; and Site Plan Approval for 138 townhouses.
Applicant: Town and Country Homes
PARKS
The proposed Liberty at Creekside subdivision is located within the 2005 MUSA
area at the edge of Bluff Creek and is proposed to be developed into 138 residential
town homes. The city's Comprehensive Park Plan calls for one acre of usable park
space to be set aside for every 75 residents. Liberty at Creekside, as proposed, will
result in an estimated 350 new residents moving into Chanhassen. Therefore this
subdivision generates the need for 4 % acres of new parkland. However, the
Comprehensive Plan also recognizes that building a small park in every residential
subdivision is undesirable and would result in an unmanageable municipal park
system. To this end, the plan calls for neighborhood parks to be centrally located
within housing regions with a maximum distance of one mile between
neighborhood parks.
This pooling of resources and land in order to centrally locate parks in specific park
service areas results in the efficient use of limited capital and long term maintenance
dollars. In the case of the Liberty at Creekside proposal, the City is planning to
service neighborhood park needs at a location less than 1;2 mile to the north and
west. Therefore, the City will be seeking park fees in lieu of land dedication as a
condition of this subdivision.
TRAILS
A variety of pedestrian improvements should be incorporated into the proposed
Liberty at Creekside plat. Foremost is a ten-foot wide asphalt trail to be constructed
adjacent to and paralleling the Bluff Creek corridor. This important trail will need
to be constructed on the north side of Bluff Creek at this location. This trail is
currently not reflected in the plans submitted by the applicant. Additional pedestrian

PARKS
The three homes proposed for Minnewashta Creek Hill will have convenient access
to Roundhouse Park located less than one-half mile to the south of the property.
The park is eight acres in size and features a public swimming beach, fishing pier,
ice rink, warming house and shelter building, playground, basketball court, open
field, picnic area, benches and trail.
TRAILS
A popular section of the city's comprehensive trail system is located at the front on

PARKS
The proposed Chanhassen West Business Park is situated within the park service
areas of Stone Creek Park and the Chanhassen Nature Preserve. Stone Creek Park
is a seven-acre neighborhood park located across Galpin Boulevard. Amenities at
the park include a sliding hill, basketball court, playground, benches and trails. The
Chanhassen Nature Preserve is a loo-acre natural area featuring both wetland and
upland areas and a comprehensive pedestrian trial system.
TRAILS
An existing section of the city's Comprehensive TrailPlan parallels the eastern
border of the subject property. Future plans callfor a pedestrian trail on the north
side of Lyman Boulevard. Care should betakento protect sufficientright-of-way
for this future improvement.
PARK AND TRAIL CONDITIONS OF APPROVAL
In lieu of parkland dedication and trail construction, fullparkJees shall be collected

The Sever Peterson farm represents one of the properties located within the 2005
MUSA area that is currently being considered for development. The Peterson farm
is situated on Bluff Creek and is proposed to be developed into residential housing.

Now Ding, 39, faces a felony charge of first-degree criminal damage to
property and could face up to five years of prison and/or $10,000 in
fines for illegally cutting the trees valued at $21,600.
"The simple fact is it's clearly somebody trying to get a better view of a
natural resource by taking down trees," said Stuart Fox, the city's
manager of parks and natural resources.
Ding did not return six telephone messages and two e-mails from a
reporter seeking comment.
According to Fox, an anonymous citizen called the
parks office to complain that they'd seen Ding
cutting trees on city property in January 2004.
At that time, city inspectors told Ding's wife that
no one is allowed to cut trees on city property,
according to a police report.
More than a year later, in February of this year, police responded to
another call that trees were being cut on city property behind Ding's
home.

According to police, Ding admitted to cutting the trees that were 12 to
14 inches in diameter to get a better view of the lake, and he also
admitted that he knew the trees did not belong to him.
"He didn't seem to think there was anything wrong. I asked him what a
fence means to him," Fox said. "He cut down a lot of trees that weren't
his. As any landowner, the city wouldn't go onto anyone else's property
and start cutting down some body's trees."
Such cases are not isolated in Twin Cities history.
In 1980, Stephen D. Isaacs, editor of the Minneapolis Star at the time,
cleared a 30- foot gap by cutting down four trees and about 30 shrubs
on city property in Minneapolis in order to get a better view of Lake
Harriet from his home. He was charged with misdemeanors for
criminal damage to property and molestation of vegetation.
Fox said people are increasingly infringing on the 2,500 acres of city
parkland in Eden Prairie by cutting trees, creating gardens and
playgrounds, building retaining walls, fences and storage structures,
and storing boats.
Things aren't much better in Ramsey County, according to John
Moriarty, county natural resources specialist.
"It's very common for people that think they have the right to remove
things from public property," Moriarty said. "It happens quite often,
and it's a hard thing to prosecute unless somebody admits they cut the
trees down."
Ding still does not have a perfect view of the lake, according to
neighbor Michael Perpich, who said it looked as if Ding had only cut
up to Ding's side of the fence.
"I was really kind of surprised that someone raised as big of a fuss,"
Perpich said. "I walked in the back yard, and I still can't see the lake
from their back yard. You can't see a thing."
