A RESOLUTION VACATING PORTIONS OF PUBLIC RIGHT-OF-WAY AND
DRAINAGE & UTILITY EASEMENTS AT 2150 CRESTVIEW DRIVE
PLANNING CASE (V ACA TION) FILE NO. 05-02
WHEREAS, the City received a request from Lecy Bros. Homes, the property owner of the
Shively Addition, to vacate a portion of an existing public right-of-way and all drainage and utility
easement within the existing plat of Shively Addition; and
WHEREAS, the existing public right-of-way and drainage and utility easement was
dedicated to the City as a part of the Shively Addition plat in 1990; and
WHEREAS, a condition in the development contract required the vacation of a portion of
the existing right-of-way for Crestview Lane.(Drive); and
WHEREAS, the dedicated right-of-way and drainage and utility easement on the plat are
being superceded by the realigned right-of-way and drainage and utility easements within the
Crestview Addition Plat approved on May 9,2005; and
WHEREAS, the applicant is requesting the City vacate the right-of-way and easement area
which would run through the middle of the proposed new lots.
NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby
approves vacating a portion of the public right-of-way for Crestview Lane (Drive) and a portion of
the drainage and utility easement at 2150 Crestview Drive as defined in the attached vacation
description.
Passed and adopted by the Chanhassen City Council this 27th day of June, 2005.
