Homes, the property owner of the Shively Addition, to vacate a portion of an existing public right-of-way and all drainage and utility easement within the existing plat of Shively Addition; and WHEREAS, the existing public right-of-way and drainage and utility easement was dedicated to the City as a part of the Shively Addition plat in 1990; and WHEREAS, a condition in the development contract required the vacation of a portion of the existing right-of-way for Crestview Lane.(Drive); and WHEREAS, the dedicated right-of-way and drainage and utility easement on the plat are being superceded by the realigned right-of-way and drainage and utility easements within the Crestview Addition Plat approved on May 9,2005; and WHEREAS, the applicant is requesting the City vacate the right-of-way and easement area which would run through the middle of the proposed new lots. NOW, THEREFORE, BE IT RESOLVED that the Chanhassen City Council hereby approves vacating a portion of the public right-of-way for Crestview Lane (Drive) and a portion of the drainage and utility easement at 2150 Crestview Drive as defined in the attached vacation description.
