If the city finds that all the applicable standards are met, the permit must be approved. This is a quasi-judicial decision. Notice of this public hearing has been mailed to all property owners within 500 feet. PROPOSAL/SUMMARY The applicant is proposing more than 1,000 cubic yards of grading for site improvements that include parking lot alterations, storm water improvements and the grading of a hockey rink site. The original 32 acres of property for Bandimere Community Park were acquired in 1988 after a park improvement referendum in which two of four questions passed. Nine years later, another park referendum was approved authorizing the initial construction of the park. Most recently, another 4.5 acres of land has been added to the park along with a new main park entrance being constructed. DISCUSSION The applicant is requesting an interim use permit to grade more than 1,000 cubic yards for site improvements. A small southwest portion of the site drains toward a wetland south and west of the proposed grading area. The proposed grading plan would largely maintain the existing drainage patterns. Two treatment basins are proposed, one within the new parking lot island and one north of the ice rink. The plan does not show all new impervious directed toward the treatment basins, but attempts to collect untreated runoff from existing impervious to treat the required amount of runoff. The grading plan, hydrologic map and storm water model shall be revised to be consistent with each other. The plan must obtain appropriate permits from the Riley Purgatory Bluff Creek Watershed District. The slopes of the stormwater pipe outlets into the wetland will likely require modification to accomplish rate control per the Watershed District's permitting process. Per conversations between staff the engineer for this application, the proposed slope from the parking lot to the wetland will not be as steep as shown in the plan set. The plan set must be revised to show the correct proposed slope. A buffer must be established and maintained around the wetland and monuments must be installed The plan shall be revised to show the first floor elevation of the proposed warming house. Emergency Overflow locations and elevations shall be shown on the grading plan. UTILITIES The plan shall be revised to show the locations of draintile cleanouts. LANDSCAPING Minimum landscaping requirements for the parking lot expansion at Bandimere Park include installing a landscape peninsula and 2 overstory trees. One peninsula has been provided as well as 6 overstory trees. Planning Commission Bandimere Park Interim Use Permit — Planning Case 2016-16 June 21, 2016 Page 4 of 4 RECOMMENDATION Staff recommends that the Planning Commission approve the interim use permit to permit grading in excess of 1,000 cubic yards to include parking lot alterations, storm water improvements and the grading of a hockey rink plans prepared by Hoisington Koegler Group, Inc, dated May 20, 2016 subject to the following conditions: 1. The grading plan, hydrologic map and storm water model shall be revised to be consistent with each other. 2. The plan must obtain appropriate permits from the Riley Purgatory Bluff Creek Watershed District. 3. The plan set must be revised to show the correct proposed slope from the parking lot to the north wetland 4. A buffer must be established and maintained around the wetland and monuments must be installed 5. The plan shall be revised to show the first floor elevation of the proposed warming house. 6. Emergency Overflow locations and elevations shall be shown on the grading plan. 7. Autumn Blaze maples shall not be included in the planting plan. An alternate species, approved by the city, shall be provided. 8. Signed, professional design and building permit required for any retaining walls exceeding 48 inches in height. ATTACHMENTS 1. The Planning Commission conducted a public hearing on the proposed interim use was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Agricultural Estate District, A-2. 2. The property is guided by the Land Use Plan for Parks and Open Space use. 3. The legal description of the property is: Those parts of the Southwest Quarter of the Southwest Quarter of Government Lot 4, Section 24, and of the Northwest Quarter of the Northwest Quarter Government Lot 1, Section 25,Township 116 North, Range 23 West of the Fifth Principal Meridian, which lies Easterly and Northeasterly of the center line of State Highway No. 101, and Westerly and Northwesterly of the Plat of Bandimere Heights 2nd Addition, According to the Recorded Plat thereof. 4. Section 20-232: a. The proposed grading for park improvements will not be detrimental to, but will enhance the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. b. The proposed grading for park improvements will be consistent with the objectives of the city's comprehensive plan and the zoning ordinance. c. The proposed grading for park improvements will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. The proposed grading will provide another exercise opportunity for community members. d. The proposed grading for park improvements will not be hazardous or disturbing to existing or planned neighboring uses. Part of the improvements are to provide for storm water treatment. e. The proposed grading for park improvements will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Part of the improvements include the provision for storm water retention and treatment. f. The proposed grading for park improvements will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. g. The proposed grading for park improvements will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. The grading operation will occur during daylight hours. h. The proposed grading for park improvements will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Park of the improvements include the expansion of the parking lot. i. The proposed grading for park improvements will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. j. The proposed grading for park improvements will be aesthetically compatible with the area. k. The proposed grading for park improvements will not depreciate surrounding property values. 1. The proposed grading for park improvements will meet standards prescribed for certain grading operations as provided in the city code. The proposed uses are permitted in the zoning district. 5. Any interested party is invited to attend the meeting. • Staff prepares a report on the subject application that includes all pertinent information and a recommendation. These reports are available by request. At the Planning Commission meeting, staff will give a verbal overview of the report and a recommendation. The item will be opened for the public to speak about the proposal as a part of the hearing process. The Commission will close the public hearing and discuss the item and make a recommendation to the City Council. The City Council may reverse, affirm or modify wholly or partly the Planning Commission's recommendation. Rezonings, land use and code amendments take a simple majority vote of the City Council except rezonings and land use amendments from residential to commerciallndustrial. • Minnesota State Statute 519.99 requires all applications to be processed within 60 days unless the applicant waives this standard. Some applications due to their complexity may take several months to complete. Any person wishing to follow an item through the process should check with the Planning Department regarding its status and scheduling for the City Council meeting. • A neighborhood spokesperson/representative is encouraged to provide a contact for the city. Often developers are encouraged to meet with the neighborhood regarding their proposal. Staff is also available to review the project with any interested person(s). • Because the Planning Commission holds the public hearing, the City Council does not. Minutes are taken and any correspondence regarding the application will be included in the report to the City Council.
