GRANT OF PERMANENT EASEMENT
ANDREI OSINSKY, hereinafter referred to as "Grantor", in consideration of One Dollar
($1.00) and other good and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, does hereby grant unto the CITY OF CHANHASSEN, a municipal corporation
organized under the laws of the State of Minnesota, the Grantee, hereinafter referred to as the
"City", its successors and assigns, forever, a permanent easement for public drainage and utility
purposes over, across, on, under, and through land situated within the County of Carver, State of
Minnesota, as described on the attached Exhibit "A" and depicted on the attached Exhibit `B".
INCLUDING the rights of the City, its contractors, agents, servants, and assigns, to enter
upon the easement premises at all reasonable times to construct, reconstruct, inspect, repair, and
maintain said public drainage and utility systems over, across, on, under, and through the easement
premises, together with the right to grade, level, fill, drain, and excavate the easement premises, and
the further right to remove trees, bushes, undergrowth, and other obstructions interfering with the
location, construction, and maintenance of said public drainage and utility systems.
The above named Grantor, for himself, his heirs, successors and assigns does covenant with
the City, its successors and assigns, that he is well seized in fee title of the above described

easement premises; that he has the sole right to grant and convey the easement to the City; that there
are no unrecorded interests in the easement premises; and that he will indemnify and hold the City
harmless for any breach of the foregoing covenants.

Parcel A:
An easement for drainage and utility purposes over under and across the west 10.00 feet, the
northwesterly 10.00 feet, the northeasterly 10.00 feet and the southeasterly 5.00 feet of the
following described parcel:
Lots 2 and 3 and the Northwesterly 16.54 feet of Lot 4 all in Block 6 RED CEDAR POINT LAKE
MINNEWASHTA, according to the recorded plat thereof Carver County Minnesota. Together
with that part of the Southwesterly half of vacated Hancock Place which lies Southeasterly of the
Northeasterly extension of the Northwesterly line of said Lot 2 and which lies Northwesterly of the
Northeasterly extension of the Southeasterly line of the Northwesterlyl6.54 feet of said Lot 4.
Parcel B:
An easement for drainage and utility purposes over under and across the northwesterly 5.00 foot,
the northeasterly 10.00 feet the south 10.00 feet and that part of the following described parcel
which lies southeasterly of the northwesterly 11.03 feet of lot 6, described below:
Lots 5 and 6 and that part of Lot 4 which lies Southeasterly of the Northwesterly 16.54 feet thereof
all in Block 6 RED CEDAR POINT LAKE MINNEWASHTA according to the recorded plat
thereof Carver County Minnesota. Together with that part of the Southwesterly half of vacated
Hancock Place which lies Southeasterly of the Northeasterly extension of the Southeasterly line of
the Northwesterly 16.54 feet of said Lot 4 and which lies Northerly of a line beginning at the most
easterly corner of said Lot 6; thence easterly to the point of intersection of the Southeasterly
extension of the Southwesterly line of Lot 40, Block 1, said plat and the Northerly Right of Way
