Re: Avienda Wetland Conservation Act Application – Supplemental Information
Dear Mr. Gerhardt:
The Avienda project team is pleased to submit supplemental information regarding the Avienda
Wetland Conservation Act Replacement Plan Application. We look forward to working with
you and others to complete the application approval process.
First, for the Avienda project it is appropriate to allow flexibility in the application of sequencing
steps under the Minnesota Wetland Conservation Act pursuant to Minnesota Rules Part
8420.0520 subpart 7a. We hereby request that flexibility, and submit the attached memorandum
from Kjolhaug Environmental Services Company and related attachments in support of the
request.
Second, in order for the City to have a complete record for its decision, we submit the attached
June 5, 2017 memorandum to the U.S. Army Corps of Engineers. It includes important
information and analysis regarding the project. Please note that attached document is complete
except for Attachments A to F, which the City already has in its record.
The Wetland Conservation Act Replacement Plan Application and the supporting documents the
City has received clearly support a positive action on the Avienda application. With those
submissions Avienda has demonstrated full compliance with Wetland Conservation Act
sequencing requirements as well as all other requirements for wetland replacement plan
approval. If the City desires to focus its analysis and recommendation for approval on the
application of sequencing flexibility, approval under that option is certainly warranted.
The current decision deadline expires on December 10th, 2017. We request that the deadline date
be extended another 60 days from December 10, 2017, so that our application may be considered
for approval at the December 18th, 2017 City Council meeting.
