SUMMARY MINUTES
NOVEMBER 21, 2017
Chairman Aller called the meeting to order at 7:00 p.m.
MEMBERS PRESENT: Andrew Aller, Steve Weick, Nancy Madsen, John Tietz, and Mark

PUBLIC HEARING:
7721 ERIE AVENUE: VARIANCE HARCOVER, FRONT YARD SETBACK AND REAR
YARD SETBACK.
MacKenzie Walters presented the staff report on this item. Chairman Aller asked about the
history of granting variances for detached garages in the neighborhood. Commissioner Tietz
asked about the possibility of having a two wheel line driveway rather than a full driveway as a
means to reduce impervious coverage. Commissioner Randall asked if attaching the garage and
linking the driveways together could help reduce the variance. Commissioner Madsen asked if
the variances granted within 500 feet were for daily use or storage garage. The applicants, Rick
and Liz Nustad discussed the need for the storage garage to store their 1969 Mack Firetruck.

Chairman Aller opened the public hearing. Jack Atkins, 220 West 78 Street stated he was in
favor of approving this variance. Chairman Aller closed the public hearing. After discussion
amongst commission members, the following motion was made.
Randall moved, Madsen seconded that the Chanhassen Board of Appeals and Adjustments
table Planning Case 2017-20 with a 60 day extension. All voted in favor and the motion
carried unanimously with a vote of 5 to 0.

204 WEST 78 STREET: VARIANCE FOR HARD SURFACE COVERAGE AND
FRONT YARD SETBACK.

MacKenzie Walters presented the staff report for this item. Commissioner Weick asked about
snow removal on the sidewalk. Commissioner Madsen asked for clarification of the turn around
connected with the driveway. The applicant Josh Pickard explained the need for the variances.

Chairman Aller opened the public hearing. Jack Atkins, 220 West 78 Street spoke in support of
the request. Chairman Aller closed the public hearing. After comments and discussion by
commission members, the following motion was made.
Weick moved, Madsen seconded that the Chanhassen Board of Appeals and Adjustments
approves a 3 foot front yard setback variance for a pergola and a 1.5 percent hard cover
variance for an expanded driveway subject to the following conditions of approval and
adopts the attached Findings of Fact and Decisions:
1. The applicant shall construct stormwater BMP(s), such as rain barrels at downspouts to
treat all runoff created by all impervious surface over 25 percent.
2. The applicant shall grant the City an easement for the public sidewalk.
All voted in favor and the motion carried unanimously with a vote of 5 to 0.
CODE AMENDMENTS: CONSIDER AMENDMENTS TO CHAPTER 1 “GENERAL
PROVISIONS”; CHAPTER 7 “BUILDINGS AND BUILDING REGULATIONS”;
CHAPTER 18 “SUBDIVISIONS”; AND CHAPTER 20 “ZONING” OF THE
CHANHASSEN CITY CODE REGARDING THE FOLLOWING:
A. DRIVE THROUGHS: MODIFY MINIMUM STACKING DISTANCE AND
CLASSIFY AS CONDITIONAL USE.
B. PRIVATE STREET: SIGN GUIDELINES.
C. STREET DESIGN: GUIDELINES.
D. ADULT DAYCARE: DEFINE AND ALLOW IN APPROPRIATE DISTRICTS.
E. PUD SETBACKS: ALLOW INCREASED FLEXIBILITY.
F. LOT COVERAGE: UPDATE ASSOCIATED DEFINITIONS, IMPERVIOUS
AND PERVIOUS SURFACES, AND TERMINOLOGY.
MacKenzie Walters presented the staff report for each code amendment. In regards to drive
throughs Commissioner Tietz asked for clarification on how banks with multiple windows would
be handled. In discussing private street sign guidelines, Commissioner Randall asked about the
color of signs for private versus public. Commissioner Tietz asked for clarification of the
definition of functionally impaired adults under adult daycare. Commissioner Randall suggested
changing the wording from impaired adults to vulnerable adults. Commission members
discussed the need for the definition of pervious pavement to be as specific as possible.
Chairman Aller opened the public hearing. No one spoke and the public hearing was closed.

Planning Commission Summary – November 21, 2017
Madsen moved, Randall seconded that the Chanhassen Planning Commission recommends
that the City Council adopt the attached ordinances amending Chapters 1, 7, 18 and 20 of
the Chanhassen City Code with clarification of the definition for adult daycare, colors of
street signage and incorporating the use of MnDOT’s Roadway Design Manual. All voted
in favor and the motion carried unanimously with a vote of 5 to 0.
APPROVAL OF MINUTES: Commissioner Weick noted the verbatim and summary
Minutes of the Planning Commission meeting dated October 17, 2017 as presented.
COMMISSION PRESENTATIONS. None.
ADMINISTRATIVE PRESENTATIONS. Kate Aanenson discussed future Planning
Commission agenda items and Planning Commission vacancies.
Commissioner Weick moved to adjourn the meeting. All voted in favor and the motion
carried unanimously with a vote of 5 to 0. The Planning Commission meeting was
adjourned at 8:35 p.m.
