SUMMARY OF REQUEST: Consider an amendment to the Conditional Use Permit to expand a communication tower. Box 489. 1600 Utica Ave. S., STE 475 Chanhassen, MN 55317 St. Louis Park, MN 55416 (763) 852-0576 or richard.krueger@,crowncastle.com PRESENT ZONING: Industrial Office Park District (IOP) 2020 LAND USE PLAN: Office Industrial uses ACREAGE: 0.023 acres, 1,000 square feet LEVEL OF CITY DISCRETION IN DECISION-MAKING: The city has limited discretion in approving or denying conditional use permits, based on whether or not the proposal meets the conditional use permit standards outlined in the Zoning Ordinance. If the city finds that all the applicable conditional use permit standards are met, the permit must be approved. This is a quasi-judicial decision. Notice of this public hearing has been mailed to all property owners within 500 feet. Planning Commission 7700 Quattro Drive - Planning Case 2018-03 January 16, 2018 Page 2 of 4 PROPOSAL/SUMMARY The applicant is requesting an amendment to CUP 2000-06 to permit a tower height of 87 feet, which is taller than the 75 feet height originally approved, to allow the co -location of antennas on the tower. APPLICABLE REGULATIONS Section 20-221 through 20-237 Conditional Uses Section 20-287 Communication transmission towers Section 20-907 Height Regulations Section 20-915 Antennas, satellite dishes and amateur radio towers Section 20-794 of the zoning ordinance permits commercial towers as regulated by article XXX as a conditional use in the IOP zoning district. Section 20-1500 through 20-1522 (Article XXX) regulates towers and antennas. BACKGROUND On December 11, 2000, the Chanhassen City Council approved Conditional Use Permit #2000-6 to permit the installation of a communication tower and site plan approval for up to a 75 foot monopole tower and equipment platform. In November 1996, the City of Chanhassen adopted Ordinance 259 pertaining to towers and antennas. This ordinance provided criteria for the design and location of wireless telecommunication facilities in the city. DISCUSSION The applicant is requesting an amendment to the Conditional Use Permit to allow a 15.2 foot tower extension with a three foot lighting rod on top of the existing 68.8 foot tower. Twelve additional antennas shall be installed on the tower with three groupings of four antennas in each sector at a centerline height of 80 feet. The applicant will also be installing an additional 14 feet by 9 feet 4 inch equipment platform to hold the communication cabinets. The 15 feet by 22 feet lease space is located to the rear of the existing building and is not visible from public right-of- way. A concrete sidewalk and stairs are being extended to provide access to the equipment. The original approval was for up to 75 foot tower and appurtenances. The existing tower is only 68.8 feet tall and has antenna arrays centered on a height of 65 feet. As a condition of approval, the tower was to be able to accommodate additional antennas for co -location. In addition, the tower was built to accommodate an additional antenna on the proposed tower below the proposed antennas. In essence, at least two additional antennas should be able to be attached to the tower. However, as the request shows, the 75 feet tower height does not accommodate the additional antennas above the existing antennas. Proposed monopole compared to ordinance requirements Existing communication towers in the community range in height from 69 feet to 150 feet in height. Antennas located on the tops of city water towers range from 66 feet to 135 feet. The proposed extension is well within the permitted tower height and is in compliance with City Code. Staff recommends that the Planning Commission approve the amendment to the Conditional Use Permit #2000-6 to permit the construction of an extension of the communication tower up to 90 feet monopole, plans prepared by Design 1, dated revised 04-10-17, subject to the following conditions: A building permit is required to construct the platform and tower extension; the tower must be designed for a 90 MPH wind load and include the effect of one-half inch of radial ice. 2. The original plans must be signed by a professional engineer licensed in the State of Minnesota. The contractor shall meet with the Inspections Division as early as possible to discuss plan review and permit procedures. 4. The applicant shall submit a detailed grading, drainage, and erosion control plan for staff review and approval. On January 16, 2018, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The Planning Commission makes the following: FINDINGS OF FACT 1. The property is currently zoned Industrial Office Park, IOP. 2. The property is guided in the Chanhassen Comprehensive Plan for Office Industrial uses. 3. The legal description of the property is Lot 1, Block 1, Quattro Addition, Hennepin County, Minnesota. 4. When approving a conditional use permit, the City must determine the capability of a proposed development with existing and proposed uses. The general issuance standards of the conditional use, Section 20-232, include the following 12 items: a. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. Finding: The proposed communication tower will not be detrimental to general welfare of the neighborhood. The proposed tower and accompanying equipment building would be compatible with the uses in the industrial park. b. Will be consistent with the objectives of the city's comprehensive plan and this chapter. Finding: The proposed use is consistent with the city's comprehensive plan, ordinance requirements for Highway 5 Corridor District, the IOP district regulations, and the tower ordinance. c. Will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. Finding: The proposed tower and accompanying equipment building would be compatible with the uses in the industrial park. The location minimizes adverse visual effects of towers through careful design and siting standards which attempt to screen and or camouflage towers from adjacent public and private property. d. Will not be hazardous or disturbing to existing or planned neighboring uses. Finding: The proposed tower will not be hazardous to existing or planned neighboring uses. e. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Finding: The proposed development is provided with adequate public services. f. Will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. Finding: The proposed development will not require excessive public services. The proposed tower extension will not be detrimental to the economic welfare of the community. g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. Finding: The proposed tower should not create conditions that are detrimental to persons, property or the general welfare of the community. h. Will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Finding: The proposed development will not interfere with traffic circulation. i. Will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. Finding: The proposed development will not destroy or damage natural, scenic, or historic features. j. Will be aesthetically compatible with the area. Finding: The proposed tower will be aesthetically compatible with the area. It extends an existing communication tower. 2 k. Will not depreciate surrounding property values. Finding: The proposed development should not depreciate surrounding property values. 1. Will meet standards prescribed for certain uses as provided in this article. Finding: The proposed development meets standards established for communication towers. 5. RECOMMENDATION The Planning Commission approves an amendment to the conditional use permit to permit the extension of the communication tower. Planning Commission — Per the Conditional Use Permit Application Checklist, there are twelve (12) criteria that must be addressed via a Statement of Compliance. The criteria are addressed below: a. If the tower base is over 20'-0' from the equipment shelter, a separate Lead 1 shall be established around each foundation, and the two Lead 1s shall be bonded with two parallel leads at least 6 feet apart horizontally. Connections between the two Lead 1s shall be bi-directional. All subgrade connections shall be by exothermic weld, brazed weld, or gas-tight UL467-listed compression fittings pre -filled with anti -oxidant compound. Subgrade connections shall not be 'cold galvanize' coated. Lead 1 shall be #2 solid bare tin -clad (SBTC) copper wire buried at local frost depth. Lead 1 bends shall be minimum 24" radius. 'Whip' lead bends may be of 12" radius. Ground rods shall be galvanized steel, 5/8"0, spaced ten feet apart, or as shown. Rods shall be kept min. 24 inches from foundations. SPECIAL CONSIDERATIONS FOR GROUND RODS When ground rods are not specified to be backfilled w/ Bentonite Slurry: If boulders, bedrock, or other obstructions prevent driving of ground rods, the Contractor will need to have drilling equipment bore o hole for ground rod placement. Hole to be backfilled w/ Bentonite Slurry. When specified with slurried Bentonite encasement, drilling equipment will be need to be used to be bore a hole for ground rod placement. Slurry shall be made from pelletized material ("Grounding Gravel'; powdered Bentonite is not allowed. If boulders, bedrock, or other obstructions are found, Contractor shall drill to the specified depth and provide Bentonite encasements. Surfaces that are galvanized or coated shall have coating(s) removed prior to bolting. Bolts shall be stainless steel with flat washers on each side of the connection and a lock washer beneath the fastening nut. Star -tooth washers shall be used between lug & dissimilar metal (copper -to -steel, etc) but are not required between tin -clad CU lugs & tin -clad CU bus bars. Lug tongues shall be coated with anti -oxidant compound, and excess compound wiped clean after bolting. The connection shall then be canted with cold -galvanizing compound, or with color -matching paint. Ground bars exposed to weather shall be tin -clad copper, and shall be clean of any oxidation prior to lug bolting. Galvanized items shall have zinc removed within 1" of weld area, and below lug surface contact area. After welding or bolting, the joint shall be coated with cold galvanizing compound. Ground bars are isolated electrically from tower bottoms and equipment shelters by their standoff mounts. Leads from each ground bar to the ground ring shall be a pair of #2 SBTC, each connected to Lead 1 bi-directionally with #2 SBTC 'jumpers'. Pairs of #2 SBTC may be required between ground bars. Leads shall be routed to ground bars as follows: • The Main Ground Bar (MGB), typically mounted inside on the equipment shelter 'back' wall. • The Entry Cable Port Ground Bars (ECPGB). mounted inside and outside on the equipment shelter walls beneath the transmission line port. Equipment Shelter and Other General Requirements: • Extend new Lead 21B up to shelter halo, remaking two-way connections as needed. Generator -equipped shelters have 6 such connections. Connections within the shelter shall be by compression; NEVER weld inside the shelter. • Each vertical support pipe of the exterior cable bridge. Bridge end shall be kept at least 6" from the tower structure. The cable bridge shall be jumpered to the vertical support pipes with #2 SBTC at each vertical support pipe. • Opposite comers of the roof shield over the equipment shelter. • Each HVAC unit shield, if separate (may be 'jumpered' to main roof shield). • Each HVAC package unit. " Commercial electric meter box. " Generator receptacle, if present. • Steel building skid, if shelter is metal frame. * Each air intake or exhaust 'fan vent louver. " Each generator vent hood or louver. " Generator exhaust stack, external. " Opposite comers of generator support frame, if separate from shelter. • Generator fuel tank, if separate from generator unit. • Host building rain gutter, downspouts, and roof flashings within 25 feet. • Telco MPOP (Main Point of Presence), if external to equipment shelter.
