Findings of fact signedCITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA FINDINGS OF FACT AND RECOMMENDATION IN RE: Application of Crown Castle Services and Marilyn Beddor for an amendment to a Conditional Use Permit for a communication tower extension on property zoned Industrial Office Park. On January 16, 2018, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application. The Planning Commission conducted a public hearing on the proposed conditional use permit preceded by published and mailed notice. The Planning Commission makes the following: FINDINGS OF FACT 1. The property is currently zoned Industrial Office Park, IOP. 2. The property is guided in the Chanhassen Comprehensive Plan for Office Industrial uses. 3. The legal description of the property is Lot 1, Block 1, Quattro Addition, Hennepin County, Minnesota. 4. When approving a conditional use permit, the City must determine the capability of a proposed development with existing and proposed uses. The general issuance standards of the conditional use, Section 20-232, include the following 12 items: a. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. Finding: The proposed communication tower will not be detrimental to general welfare of the neighborhood. The proposed tower and accompanying equipment building would be compatible with the uses in the industrial park. b. Will be consistent with the objectives of the city's comprehensive plan and this chapter. Finding: The proposed use is consistent with the city's comprehensive plan, ordinance requirements for Highway 5 Corridor District, the IOP district regulations, and the tower ordinance. c. Will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. Finding: The proposed tower and accompanying equipment building would be compatible with the uses in the industrial park. The location minimizes adverse visual effects of towers through careful design and siting standards which attempt to screen and or camouflage towers from adjacent public and private property. d. Will not be hazardous or disturbing to existing or planned neighboring uses. Finding: The proposed tower will not be hazardous to existing or planned neighboring uses. e. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Finding: The proposed development is provided with adequate public services. f Will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. Finding: The proposed development will not require excessive public services. The proposed tower extension will not be detrimental to the economic welfare of the community. g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. Finding: The proposed tower should not create conditions that are detrimental to persons, property or the general welfare of the community. h. Will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. Finding: The proposed development will not interfere with traffic circulation. i. Will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. Finding: The proposed development will not destroy or damage natural, scenic, or historic features. j. Will be aesthetically compatible with the area. Finding: The proposed tower will be aesthetically compatible with the area. It extends an existing communication tower. k. Will not depreciate surrounding property values. Finding: The proposed development should not depreciate surrounding property values. 1. Will meet standards prescribed for certain uses as provided in this article. Finding: The proposed development meets standards established for communication towers. 5. The planning report #2018-03, dated January 16, 2018, prepared by Robert Generous, et al, is incorporated herein. RECOMMENDATION The Planning Commission approves an amendment to the conditional use permit to permit the extension of the communication tower.
