Appeal Letter 1.4.1801/04/2018 NOTICE OF APPEAL RE: 7052 Minnewashta Parkway variances Case # 2-17=19 Dear Ms. Aanenson and Mr. Generous. RECEIVED JAN -4 2018 CHANHASSAN INSPECTIONS Applicant Nathan Kirt, and owner Daryl Kirt appeal the decision of the Chanhassen Planning Commission, as the Board of Adjustment and Appeals purportedly approving a 10 foot wetland buffer variance and a 30 foot wetland buffer setback variance. Applicant and Owner did not apply for the variance which was purportedly approved. Staff, months after Applicant's and Owner's variance requests were submitted, concocted and propounded substituted variances The variances requested by Applicant and Owner were necessary to permit reasonable use of the subject property for residential construction in conformity with the underlying plat, given the constraints placed on the lot by (i) intervening taking of easement(s) for a corner lift station, (ii) erroneous designation of Lake St. Joe as a natural lake, and the consequential erroneous designation of the adjoining wetland as "outstanding". If the variance granted by applicant and owner are not granted, all reasonable economic use of the property will have been taken by the governmental regulatory activity.
