Retaining Walls Ltr 100818CITYOT CIIAI'IHASSXN Chanhasen is a Community for Life - Providing forToday and Planning forTomonow October 8, 2018 Mark Rausch Alliant Engineering, Inc. 733 Marquette Avenue, Suite 700 Minneapolis, MN 55402 Re: Retaining Walls in Foxwood Subdivision - Planning Case #16-13 Dear Mr. Rausch: In response to concerns raised about what structures may or may not be constructed within the 20- foot Bluff Creek Primary Zone setback within the Foxwood Subdivision, the city's position is as follows: 1) The city has designated the Bluff Creek Corridor Boundary as incidental to Outlots A and C. 2) The city granted Variance 2016-13, which reduced the 4O-foot setback to 20 feet from the Bluff Creek Primary Zone. Because of this variance, all structures shall be setback a minimum of 20 feet from Outlots A and C. 3) The city's definition of structure includes retaining walls and anything manufactured, built, constructed, or erected which is normally attached to or positioned on land. 4) The city recognizes that retaining walls located within the 20-foot Bluff Creek Pimary Zone setback may be required for the purposes of optimizing grading and drainage beyond those that were shown on Final Plat Submittal dated June 23, 2016. 5) The city may approve the construction of retaining walls within the 2O-foot Bluff Creek Primary Zone setback when it is determined by the city's Engineering Department that: a. The proposed wall is in line with the subdivision's approved grading plan. b. The proposed wall will not negatively impact Bluff Creek or any of the surrounding wetlands and buffer areas. 6) No other structure shall be permitted within the 20-foot Bluff Creek Primary Zone Setback. This document will be added to the Foxwood Subdivision's case file and shall be understood to govern the city's policy on retaining walls within the Foxwood Subdivision.
