Prepared By Kate Aanenson, Community Development Director, AICP File No: Planning Case 2017-10 PROPOSED MOTION "The City Council approves extension of the preliminary plat and extinguishes the final plat for Avienda, but allows for grading as stated in the conditions of approval from the City Council staff report dated June 25, 2018." Approval requires a Simple Majority Vote of members present. SUMMARY The City Council approved the final plat and grading permit for Avienda subject to the conditions of the staff report dated June 25, 2018. Since the final plat approval, the applicant wants to proceed with just the grading permit. In order to proceed per city ordinance, the applicant must extinguish the final plat approval and receive an extension of the preliminary plat. Attached is a letter requesting extension of the preliminary plat and extinguishing the final plat approval. BACKGROUND Avienda is a PUD zoning district and the developer anticipates making some internal changes to the project. Their plan is to review these changes with the City Council in a work session. The changes will require an amendment to the PUD which requires a public hearing before the Planning Commission and approval by the City Council. The grading plan which was approved on June 25, 2018 will be followed as well as the conditions of approval that are applicable with the grading plan; this includes security. Grading of the site will take several months, during that time the developer will be working through the PUD amendment. RECOMMENDATION Approve extension of the preliminary plat and extinguish the final plat. ATTACHMENTS: Extension Letter Avienda Draft Changes March 14, 2019 Kate Aanenson City of Chanhassen 7700 Market Boulevard PO Box 147 Chanhassen, MN 55317 RE: Avienda Grading Permit Dear Kate, Our Level 7 Development, LLC team is working to address the conditions of the grading permit approval granted by the City Council on June 25, 2018 so that the grading permit may be issued and grading can begin on site. We have been working to finalize our development plans for the Avienda project and look forward to presenting an updated plan at a future Council Work Session. The Council granted approval of our Preliminary Plat, Rezoning, Conditional Use Permit and Wetland Alteration permit on July 10, 2017. The Final Plat was approved on June 25, 2018. While we are working on revisions to the approved plans, we request an extension of our preliminary approvals until December 31, 2019 and hereby give notice that we do not intend to file the final as approved. We request administrative approval of the preliminary approvals and withdraw the final plat as you requested in order to proceed with the issuance of the grading permit and review of the revised PUD plans. While we understand that we are entitled under the July 2017 approvals, we are excited about the revisions that we will be presenting to the Council later this month and look forward to submitting these modified plans for approval this spring.
