DNR Waters has reviewed the bridge plans and found them to meet the requirements of Special Provision 41 of DNR Permit 494-6078. Therefore the plans dated 12-16-98 are hereby approved, with the following clarifications or conditions: 1. Cross-braces are to be installed at three spots along the retaining wall on both sides of the bridge in order to help maintain the design width of the approach to the bridge. 2. The area above the OHW of 956.1' (NGVD, 1929) under the new bridge shall be excavated to the depth of 955', allowing for a stable slope at the bridge abutments as discussed below, and allowed to get established with aquatic vegetation. 3. The bridge ends of the two approaches will be supported by either: (a) a retaining wail that runs perpendicular to the approach retaining walls shown on the plans, or(b)a 3:1 (horizontal to vertical)slope that is protected with vegetation or ungrouted, natural stone riprap, or(c)a combination of retaining wall and a sloped base. I have enclosed the General Plan and Elevation of the proposed bridge for my property on Lake Lucy in Chanhassen. Also enclosed is a portion of the original Schoell & Madson engineering drawing with the proposed bridge location highlighted for your review. The proposed timber bridge would be built by Wheeler Lumber, LLC of St. Louis Park, MN. I obtained information regarding this type of bridge and its manufacturer from Martha Reger of your office. She indicated that the DNR has installed Wheeler timber bridges on various DNR projects. Please let her know I appreciate the reference as the Wheeler folks appear to be quite knowledgeable about DNR issues and concerns, and, furthermore, have been very good to work with on this project. About the Timber Bridge: This timber bridge is a triple 24' span. 16' clear roadway superstructure having 4" x 10" timber rails, 8" x 8" curbs and 3" x 8" scuppers. The bridge is to be constructed on a horizontal curve to better fit the site and minimize wetland alteration. It is designed to HS-20 loading. Coming off of each corner will be 48' timber abutment retaining walls to contain the rip-rap and granular materials needed to ramp up to the deck of the bridge (approx. 3'). The parallel retaining walls will be attached to each other with cross-members at three different locations along the 48' so that they will not spread over time. All lumber used will be Coastal Region Douglas Fir with a creosote treatment to 12# retention. All hardware is hot dipped galvanized. I have included color pictures of a similar bridge that was recently installed to an island property in Lake Ida near Alexandria, MN. This bridge, however, is quite a bit larger measuring 210' x 20'. About the Piling: The bridge will set upon a Hubbell/Chance Helical-Pier System (alk/a, screw piling) to be installed by Atlas Foundation of Rogers, MN. Each abutment and each section seam will be supported by three pilings. Each pile will be installed to support 20 tons with a safety factor of two times, i.e., 40 tons. Each pile will be capped with a plate of tubular steel upon which the bridge will sit. I have noted with red dots on the plan where the pilings are to be placed. Wheeler indicated that the General Plan and Elevation drawing is typically what is provided to the DNR for its approval. Please let me know what other information or specifications, if any, you may need to approve this bridge design. I will be out of town from Wednesday, December 16th through Monday, December 21st. However, please leave me a message regarding your thoughts on 949-9091 as I will be checking it regularly. I hope to install the bridge during February while the frost is still in the ground hopefully, at the rate we're going!), and then complete the rest of the driveway by the end of March. The permittee is not released from any rules,regulations,requirements,or standards of any applicable federal,state,or local agencies;including,but not limited to,the U.S.Army Corps of Engineers,Board of Water and Soil Resources,MN Pollution Control Agency,watershed districts,water management organizations, county,city and township zoning. The permittee shall make no changes,without written permission previously obtained from the Commissioner of Natural Resources,in the dimensions,capacity, or location of any items of work authorized hereunder. 5. The pennittee shall grant access to the site at all reasonable times during and after construction to authorized representatives of the Commissioner of Natural Resources for inspection of the work authorized hereunder. 6. This Permit may be terminated by the Commissioner of Natural Resources at any time deemed necessary for the conservation of water resources of the state,or in the interest of public health and welfare,or for violation of any of the provisions of this permit, unless otherwise provided in the Special Provisions. 7.Construction work authorized under this permit shall be completed on or before date specified above. The permitiete may request an extension of time to complete the project, stating the reason thereof,upon written request to the Commissioner of Natural Resources. S.In all cases where the permittee by performing the work authorized by this permit shall involve the taking,using,or damaging of any property rights or interests of any other person or persons,or of any publicly owned lands or improvements thereon or interests therein,the permittee,before proceeding,shall obtain the written consent of all persona,agencies,or authorities concerned,and shall acquire all property,rights and interests needed for the work. 9.This permit is permissive only. No liability shall be imposed by the State of Minnesota or any of its officers,agents or employees,officially or personally,on account of the granting hereof or on account of any damage to any person or property resulting from any act or omission of the permittee or any of its agents, employees,or contractors. This permit shall not be construed as estopping or limiting any legal claims or right of action of any person other than the state against the permittee,its agents,employees,or contractors,for any damage or injury resulting from any such act or omission,or as estopping or limiting any legal claim or right of action of the state against the permittee,its agents,employees,or contractors for violation of or failure to comply with the permit or applicable provisions of law. 10. Any extension of the surface of public waters resulting from work authorized by this permit shall become protected waters and left open and unobstructed for use by the public. 11. No material excavated by authority of this permit nor material from any other source,except as specified herein, shall be placed on any portion of the bed of said waters which Lies below(as indicated above.) 12. Where the work authorized by this permit involves the draining,filling or burning of wetlands not subject to DNR jurisdiction,the permittee shall not initiate any work under this permit until the permittee has obtained official approval from the responsible governmental unit as required by the Minnesota Wetlands Conservation Act of 1991. SPECIAL PROVISIONS 1. The detailed plans and specifications for the bridge (including approaches, abutments and foundation work, and related construction) and mitigation excavation shall be submitted to the Regional Hydrologist for review and approval prior to construction. Specific conditions the design must incorporate include: a. No filling below the ordinary high water elevation of 956.1' (NGVD, 1929) for Lake Lucy except for the placement of the bridge pilings, piers or abutments, b. The bridge dimensions must meet all conditions/requirements (i.e. , safety and fire protection) of the City of Chanhassen, and c. The bridge (including approaches, abutments and foundations work, and related construction) , must be designed by a registered professional engineer. 2. Excavated materials must be deposited or stored in an upland area, in a manner where the materials will not be redeposited into the protected water by reasonably expected high water or runoff. 3. No activity affecting the bed of the protected water may be conducted between April 1 and June 30, to minimize impacts on fish spawning and migration. If work during this time is essential, it shall be done only upon written approval of the Area Fisheries Manager, at 612-772-7950. 4. Temporary dewatering for construction, in excess of 10,000 gallons per day or 1 million gallons per year, is authorized by this permit provided the following conditions are met: a. A plan for the dewatering shall be submitted to the Regional Hydrologist for written prior approval. b. All necessary erosion and sedimentation control measures shall be taken to prevent transportation of sediment, including those noted in Special Provision 5.e. of this permit. Permittee shall comply with the conditions of the Riley-Purgatory-Bluff Creek Watershed District as set forth in their letter dated December 1, 1993. specifically: a. Compliance with the Board of Water and Soil Resources Administrative Guideline: Interim Program of Wetland Regulation, including designation and mitigation requirements and guidelines for implementation of Laws 1991, Chapter 160. b. All erosion control measures shown on the plans must be installed prior to commencement of grading operations and be maintained until all areas altered on the site have been restored. If silt fence is used, the bottom flap must be buried and the maximum allowable spacing between posts is 4 foot on center. All posts must be either 2 inch x 2 inch pine, hardwood, or steel fence posts. If hay bales are used, all bales must be staked in place and reinforced on the downstream side with snow fence. c. All areas altered because of construction must be restored with seed and disced mulch, sod, wood fiber blanket, and the driveway restored at a minimum with gravel within two weeks from the completion of construction or no later than September 15, 1994 (or later with Watershed District approval) . d. Upon completion of construction and restoration of areas disturbed, the permit applicant is responsible for the removal of all erosion control measures installed throughout the site. e. Should dewatering of the construction area be necessary and sump pumps are used, the District will require that all pumped water be discharged through a sedimentation facility prior to reaching protected waters. f. The District must be notified in writing a minimum of 48 hours prior to commencement of construction. 6. The permittee shall monitor all disturbed areas for the presence of purple loosestrife and control the plant as described in the enclosed pamphlet titled "Purple Loosestrife Alert. " The DNR aquatic plant manager should be contacted at 772-7950 for permit needs and additional information. 7. Upon completion of the authorized work, the permittee shall submit representative photographs and any as-built surveys, as appropriate, of the project area to DNR Metro Region Waters (1200 Warner Road, St. Paul, MN 55106) . 8. The permittee is authorized to maintain the approved work to the dimensions herein described. Prior to commencing any maintenance work, the permittee must advise the Department of Natural Resources of the extent and method of maintenance. Maintenance work must not be commenced unless or until the permittee receives written approval of the Department.
