CC Minutes 10-11-21CHANHASSEN CITY COUNCIL REGULAR MEETING MINUTES OCTOBER 11, 2021 Mayor Ryan called the meeting to order at 7:00 p.m. The meeting was opened with the Pledge of Allegiance. COUNCIL MEMBERS PRESENT: Mayor Ryan, Councilman Campion, Councilman McDonald, Councilwoman Rehm, and Councilwoman Schubert. COUNCIL MEMBERS ABSENT: None. STAFF PRESENT: Laurie Hokkanen, City Manager; Matt Unmacht, Assistant City Manager; Charlie Howley, Public Works Director/City Engineer; Kelly Strey, Finance Director; Ari Lyksett, Communications Manager; Don Johnson, Fire Chief; Kate Aanenson, Community Development Director; Jerry Ruegemer, Park & Recreation Director; Kim Meuwissen, City Clerk; and Andrea McDowell Poehler, City Attorney. PUBLIC PRESENT: MN State Representative Greg Boe 1846 Plymouth Lane Ryan Quade 6354 Oxbow Bend Mayor Ryan asked the City Council if there were any modifications or additions to the agenda. There were no changes to the published agenda. PUBLIC ANNOUNCEMENTS: None. CONSENT AGENDA: Councilman McDonald moved, Councilman Campion seconded that the City Council approve the following consent agenda items pursuant to the City Manager’s recommendations: 1. Approve City Council Minutes dated September 27, 2021 2. Receive Planning Commission Minutes dated September 21, 2021 3. Receive Park and Recreation Commission Minutes dated August 24, 2021 4. Approve Claims Paid October 11, 2021 5. Approve a Request to Amend Conditional Use Permit (CUP) 88-17 to Expand an Existing Outdoor Storage Area at 7851 Park Drive (Lakeshore Equipment) 6. Resolution 2021-57: Approve 2022 Service Agreement for Joint Assessment with Carver County Assessor 7. Resolution 2021-58: Approve Replacement of Fire Department Self Contained Breathing 8. Resolution 2021-59: 2021 Fleet Purchase City Council Minutes – October 11, 2021 2 All voted in favor and the motion carried unanimously with a vote of 5 to 0. VISITOR PRESENTATIONS. 1. Representative Greg Boe State Representative Greg Boe, representing District 47B which is a good portion of Chanhassen, Victoria, and all of Chaska, shared a summary of the 2021 legislative session with the City Council, stating they finished the annual budget on time as it needs to be done by July 1 and got it done without any tax increases. The Statewide education budget was also passed and increased spending for the education system by 4.45% which is the largest increase in 15 years, also without a tax increase. Mr. Boe noted they also ended the peacetime emergency powers; he thinks that is important because he is a big believer in local control. He continues to work for small businesses as many are struggling to find and retain adequate work force and keep their head above water after the negative impact of Covid-19. He asked the public to continue to support local businesses, bars, restaurants, and all types. Mr. Boe stated there were many efforts in the last year to restrict law enforcement and their ability to do their jobs. He is pleased to say that some of the most onerous language was not passed, but there were also some bills that should have passed and did not. One bill called for an increase in penalty for anyone committing a crime with a gun for the benefit of a criminal gang which did not pass, and another called for an increase in penalty for anyone caught with a gun who is not legally allowed to have a gun which also did not pass. Mr. Boe said many of the border communities are struggling as surrounding states are hesitant to send law enforcement into Minnesota on a joint response request because of the problems in Minnesota, the laws they have and the laws they are not passing. He wants to be sure they continue to support their law enforcement. Mr. Boe highlighted bills he co-authored this year including funding for Highway 212 and House File 1544 which is on the bonding tour stop. 2. Ryan Quade has been a resident since 2018 and said boat storage brings him before the City Council tonight. He has had a boat since he could drive, and has lived in Mound, Orono, and other areas across the west metro. He has always had the ability to store his boat outside and struggles with the decision and current law in place regarding boat storage where it is required to be on the side of the home. He has had discussions with neighbors and they do not understand why it could be stored to the side of one’s home versus in the driveway. He would ask the City
