MEMORANDUM
TO: Central Business District Committee, Bicentennial Commission,
Schoell and Madson , City Planner, Harry Pauly, Ann Koltyk and
Charles Kallestad.

SUBJ: Central Business District Parking Lot
The current parking plan by Harry Pauly and Ann Koltyk was presented
to the City Council on September 20 , 1976 (copy attached) . This plan
differs from that recommended by the Bicentennial Commission (also
attached) as regards to the amount of land maintained under City
ownership. The amount of land maintained under City ownership
is directly related then to the amount of land remaining which could
be leased or sold for private parking. In addition, the scope of the
project is directly related to the need for a greater or lessor amount
of City owned property.
During discussion of these relative factors by the council, alternatives
soon arose to the point of confusion. The council, in frustration,
tabled the issue requesting all parties involved to meet in a work
session to attempt to derive agreement.
Whether a joint agreement can be established is unknown to this office.
However, the council, in tabling this item, has asked me to call such
a meeting attempting to, at the minimum, insure that all parties
understand the position of each other. Personnally, I am fearful of
a widening gap developing between groups who I perceive to be operating
to better our community. I would request that you attend a meeting
which I have scheduled for Wednesday, September 29 , 1976 , 4 : 00 p.m. ,
at City Hall to discuss these items.

MEMORANDUM
TO: Mayor and City Council

SUBJ: Parking Lot Improvements , - Pauly -Koltyk Property,
West 78th Street
Pursuant to council direction, the city attorney and myself met with
Harry Pauly to review procedures for expediting the Pauly-Koltyk
parking lot proposal . The plan established basically provided for
two negotiated decisions required by the council and Harry Pauly and
Ann Koltyk :
•
1. Finalize the plan for the Old Village Hall site determining
the size and landscaping of such.
2 . A decision relative to the disposition of the balance of
the land held by the city.
In regards to the first issue, finalizing the size and landscaping
required for the Old Village Hall site, the Bicentennial Commission
has recommended that a green area of 130 feet by 70 feet be maintained
under the ownership of the city. Additionally, that no parking be
allowed adjacent to the westerly line of such city owned property
(see the Bicentennial proposal map attached) . In discussing this
iddue with Harry Pauly and Ann Koltyk , they have stated that the
proposal by the Bicentennial Commission is unacceptable to them.
They are proposing that the city retained property remain as shown
on their site plan and lot improvement diagram as shown on the attached
Pauly-Koltyk proposal . This item is being returned to the city council
for final review and decision.
After consideration of the size of the property the city will retain,
a decision is required as to the disposition of the balance of the
city land. The city could either consider sale of the property to
Harry Pauly and Ann Koltyk or leasing the property to them.
Staff is recommending that the council determine a lease amount for
the property and retain ownership. The specific amount of the lease
cannot be recommended by staff as such lease should include:
Mayor and Council -2- September 17, 1976
1. Lessees to make all site improvements as per city
specifications.
2. Lessees to bear all maintenance coats during term of lease
including snow and trash removal.
3. Failure to perform (2) - City has right to do work and
specially assess same vs. property owners, not including
city.
4 . City has parking rights for old Village Hall site.
5. No structures to be erected on any portion of total parking
lot without prior written approval of the city.
Should the council and the property owners involved be able to reach
a tenative agreement as to the size of the property which would
remain under city control for the old Village Hall and Ow decide
the amount of lease or sale for the remaining property, it is
recommended that the council set a public hearing date of October 18 ,
1976 , to hear public testimony regarding the proposed improvements .
Such authority should additionally include requiring the property
owners involved to complete final plans and specifications for the
improvements prior to the October 18, 1976 public hearing date and
authorizing the city attorney to prepare the lease or sale agreement
considering items 1 through 5 above.
