We have recently executed an agreement to sell the smaller parcel to Chestnut Group LLC and in order to record the deed, the City Clerk certification is required by Carver County. Attached are a survey and a map of the two parcels. Also I have attached the deed to Chestnut Group that we are asking that the City Clerk certify. The history of these parcels is that the City of Chanhassen created the two parcels by acquiring through eminent domain the right of way for Lyman Blvd. This action occurred in 1995 and at that time the two separate parcels were created. Under Mn Statues 272.162 "If an unexecuted instrument is presented to the municipality and any of the conditions for certification by the municipality as provided in this subdivision exist, the unexecuted instrument must be certified by the clerk of the municipality". Those conditions are: (a) that the municipality's subdivision regulations do not apply; (b) that the subdivision has been approved by the governing body of the municipality; or (c) that the restrictions on the division of taxes and filing and recording have been waived by resolution of the governing body of the municipality in the particular case because compliance would create an unnecessary hardship and failure to comply would not interfere with the purpose of the regulations. Since the subdivision of the property was create by the City's own actions the subdivision regulations either do not apply or the previous actions of the governing body of initiating the right of way acquisitions approved the split. The total estimated project cost is $224,600.00. 3. ASSESSMENTS. Parcel A shall be specially assessed $39,500.00 and Parcel B shall be specially assessed $20,300.00. The assessments shall be paid over an 8 year period, together with interest at.a rate of seven percent (7%) per year on the unpaid balance. The first installment shall be due and payable with taxes in 2007. The Property Owner waives any and all procedural and substantive objections to the Public Improvement and the special assessments, including but not limited to hearing requirements and any claim that the assessments exceed the benefit to the Subject Property.
