CHANHASSEN CITY HALL APPROVED ON ;'::i~~ Members Present: Chairman Art Partridge, Carol Watson, Ladd Conrad, Walter Thompson, and Jim Thompson Members Absent: Howard Noziska and Mike Thompson Staff Present: Bob Waibel, Bill Monk and Becky Foreman Plan Amendment, Preliminary Development Plan, Final Development Plan, and Site Plan Review, CPT Inc., Public Hearing: Waibel read the staff report to the Planning Commission. He reviewed the actions that have been taken on the lot in the past. The property owners within 350' were notified of this meeting and no one was present. Dave Sellegren, a representative of Park Two, stated that they had called a meeting with the neigh- borhood sending out 142 notices and only 9 people came to the meeting. The neighbors main concern was the traffic but that was explained to their satisfaction that traffic will not be as bad as they thought. e Sellegren stated that the overland drainage pattern to the southeast would be maintained and a retention pond would be constructed to catch the water from the hard surfaces. Regarding the vegetation, CPT plans to preserve as many trees as possible. Staff recommended that they plant several additional conifers by the frontage road west of the proposed building. CPT indicated that they would do that. CPT is going to provide 1 parking space per every employee on the main shift, that should provide for more than they need. They will have approximately 330 employees on the main shift. A motion was made by W. Thompson seconded by Watson to close the public hearing for the reason that CPT has met with the neighbors prior to this meeting and none of the neighbors came to the meeting so they must not have any problems with CPT's proposal. All voted in favor and the motion was carried. Conrad asked if the intersections will be a problem based on future growth? Sellergren indicated that the Engineers have looked into this and they feel that the intersections are built to handle the growth. e J. Thompson asked if CPT's new building will effect the sewage capacity that Metro has set for Chanhassen? Bill Monk, City Engineer, indicated that this proposal will not put us over the number by Metro Council. 330 employees is the quivalent to approximately 30 homes. Sellergren indicated that it will be 30% of 22 acres. Partridge asked what the exterior lighting will be like. Waibel indicated that it is to be consistent with Chanhassen's. The lights will be on the building and in the parking lots, the lighting is more for security reasons rather than for advertising. W. Thompson made a motion seconded by Conrad to recommend to the City Council to approve the Plan Amendment and final development plan, phase 1 of CPT with staffs recommendations as listed on July 1, 1981 Planning Report along with Exhibit A dated June 18, 1981 with the exception that condition #3 be changed from curve to curb. All voted in favor and the motion was carried. e Approval of Minutes: J. Thompson made a motion seconded by Watson to move to the approval of minutes section since the Planning Commission was ahead of schedule. All voted in favor and the motion was carried. Conrad stated that at meetings where the public is giving their comments the Planning Commission has to make sure that they state their names. W. Thompson made a motion, seconded by Conrad to approve the minutes of June 17, 1981. Partridge, W. Thompson and Conrad voted aye, Watson and J. Thompson abstained, motion carried. A motion was made by Watson seconded by W. Thompson to accept the minutes of June 24, 1981. All voted in favor and the motion was carried. Motion made by J. Thompson, seconded by Conrad to note the minutes of the June 15, 1981 City Council Meetings. All voted in favor and the motion carried. W. Thompson made a motion seconded by Conrad to note the City Council minutes of June 22 and 24, 1981. All voted in favor and the motion was carried. e Planning Commission Minutes July 8, 1981 Page 3 Park Two, Final Development Plan and Site Plan Review: e Steve Krenz, a representative from Park Two, stated that if this plan went along with the city's flood plain and Watershed Districts then the DNR would approve the plan also. Partridge explained that all the proposed uses for Park Two do not fall under the P-3 classification, some are listed in the C-3 catagory. partidge asked if the property could be zoned C-3? Waibel indicated that maybe the planning Commission could amend P-3 to allow service stations. But that may be setting a precedent. P-3 allows for industrial with some com- mercial uses but service stations aren't allowed. Watson asked if the Planning Commission could zone the lots individually with restrictions? Frank Beddor, the applicant, indicated that at the last meeting it was the concensus of the Planning Commission that the lots fronting County Road #17 be spot zoned commercial and the back lots zoned for industrial. Beddor also indicated that he would like to locate a common drive between lots 2 & 3, block I with a right turn only and a common drive for lots 1 & 2, block 2. Lot 2, block 2 will be land locked if no access is permitted onto #17. e Russ Larson, City Attorney, suggested that the Planning Commission consider zoning the commercial lots C-2 instead of C-3 because the uses are a little more restrictive. Service stations are permitted as a conditional use under C-2. Partridge asked Larson if spot zoning is acceptable. Larson stated that the proposed commercial uses seems to be compatable with the industrial\uses he feels it would be acceptable. Waibel indicated to the Planning Commission that the Public Hearing was published in the paper as a rezoning to P-3, which may have to be republished. Watson made a motion seconded by Conrad to recommend to the City Council to rezone the entire parcel to P-3, Planned Com- munity Development District, with the exception of Lots I, 2, 3, Block I and Lots I & 2, Block 2 and Lot 2, Block 3 which shall be zoned C-2, Commercial District. Ayes - Watson, Partridge, W. Thompson, Conrad, Nays - J. Thompson. Motion was carried. J. Thompson indicated that he was concerned about commercial uses in an industrial zone. e Planning Commission Minutes July 8, 1981 Page 4 e Waibel indicated that he was concerned about the pedestrian path to Chanhassen Business Park and that no access to Highway #5 or #17 should be granted, all accesses should be onto Park Road. Lots 2, Block I is land locked, wants to minimize u-turns. Daryl Fortier, a Park Two representative, indicated that the County stated that they do not like median breaks any closer to Highway #5 than 300'. Partridge asked if the Planning Commission could require no exit signs onto #17. Waibel stated that they would probably be violated and #17 access should be limited. Beddor indicated that if the lots couldn't have an access onto County Road #17 that would create a hardship for the lots. J. Thompson suggested that they eliminate entrances totally from #17. Lot 2, Block 2 could be worked out with a cul-de-sac through Lot I. Fortier indicated that that would take up quite a bit of the land. J. Thompson indicated that maybe Lot I & 2, Block 2 should be only 1 lot instead of 2, then it wouldn't be land locked. e A motion was made by J. Thompson seconded by Conrad to not allow any curb cuts on County Road #17 except for Park Road. J. Thompson and L. Conrad voted aye, Watson, W. Thompson and Partridge voted nay. Motion failed. A motion was made by J. Thompson, second by Watson that Block 1 be allowed a right turn only access located between Lots 2 and 3 and curb cut shall not be located closer than 300 feet from the intersection. All voted in favor and the motion was carried. Fortier indicated that Lot 2, Block 3 has only approximately 50% of building area. W. Thompson made a motion, second by Watson that Lot 2, Block 3 accept the road pattern drawn in on Exhibit A with I curb cut as a right out onto County Road #17 and to be not closer than 300 feet from the intersection of County Road #17 and Hwy #5. All voted in favor and the motion was carried. W. Thompson made a motion to return this site plan to the arch- itect for further study on Lots 1,2,3,and 4 of Block 2. All voted in favor and the motion was carried. e Partridge made a comment stating that he would like to note to the City Council that staff was not given adequate time for a complete review of proposed site plan and further that the Planning Commission recommendations are in opposition with the staff's feelings that there be no curb cuts onto County Road #17. e e - Planning Commission Minutes July 8, 1981 Page 5 Fortier indicated that the a two phase plan but one. front of the parking lot. Thompson to recommend to the City Council approval of the proposed site plan of Lot 1, Block 3 with review by the City Staff regarding parking, drainage, lighting, landscaping and engineering and also with consideration to conditions raised in the Planning Report dated June 5, 1981 and July 8, 1981 and the City Engineer's Report dated July 5, 1981. All voted in favor and the motion was carried. Hazardous Waste Site Selection Process Update: Waibel and Partridge informed the Planning Commission of the latest statis of Chanhassens involvement in the search process. Meeting was adjourned at 12:00 a.m.
