Issue Paper on Administrative Subdivisions
This issue paper is intended to bring your attention to a number of administrative
lot splits we have encountered lately. Staff is presenting this item to familiarize
you with the process.
A subdivision refers to the actual separation of a
parcel of land into two or more platted lots. This
type of request requires a public hearing. The
creation of a new lot dictates the need for City
Council approval.

If a property line is adjusted or moved without
creating a new lot, staff can approve such request
administratively. These applications are exempt
from the subdivision process. No public hearing is
required.

subdivision as an example. This subdivision was created in 1927. The
dimensions of each individual lot are 20 feet by 100 feet. A number of total lots
under single ownership can range between one lot to 30+ lots. The County

typically identifies these lot combinations under a single Parcel Identification
Number (Pill). This number is issued by the County and is for tax purposes only.
Having one Pill for 10 lots does not mean there is only one lot. If an individual
chose to sell 5 of the 10 lots, he/she may do so without proceeding through a
subdivision process, since the lots are already platted. Should the buyer decide to
build a home on these lots, he/she must meet the required setbacks and hard
surface coverage stipulated in the zoning ordinance. If a variance is required to
build a home, it would constitute a self-created hardship and the City can deny the
request.
The only exception to administrative subdivisions is if a combination of lots has
been declared a Zoning Lot under the process spelled out in the zoning ordinance
and the County notified of such. The City Code states:
Lot, zoning means a single tract of land which consists of one or more lots of
record and, which at the time of filing for a building permit, is designated by its
owner or developer as a tract to be used, developed or built upon. as a separate
unit under single ownership or control. A zoning lot mayor may not coincide
with a single lot of record, but in no case shall a zoning lot include only a portion
of a lot of record.
Section 20-903 of the Zoning Ordinance pertaining to Zoning Lots states:
(a) The designation of a zoning lot shall be approved by the city planner if it
complies with the lot requirements of the district in which it is located and
has a single tax identification number.
(b) Interior lot lines within a zoning lot shall be disregarded in applying
setbacks and other zoning ordinance standards.
(c) After designation of a zoning lot the lot may not be subdivided without
complying with the city's subdivision regulations.
As stated earlier, this is an informational item that staff wanted you to be aware
of. No action is required.
