FINDINGS OF FACT
AND ACTION
INRE:
Application of Americana Community Bank!Attracta Sign for a Variance to place a
non-illuminated sign on a bank drive-thru canopy without street frontage on property
zoned Central Business District (CBD) - Planning Case No. 05-28.
On September 6,2005, the Chanhassen Planning Commission met at its regularly
scheduled meeting to consider the Application of Americana Community Bank! Attracta Sign
for a Variance request to place a non-illuminated sign on a bank drive-thru canopy. The
Planning Commission conducted a public hearing on the proposed variance that was
preceded by published and mailed notice. The Planning Commission heard testimony from
all interested persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Central Business District (CBD).
2. The property is guided by the Land Use Plan for Commercial.
3. The legal description of the property is: Lot 1, Block 1, Market Street Station.
4. The City Council, upon the recommendation of the Planning Commission, may grant a
variance from the requirements of this article where it is shown that by reason of
topography or other conditions, strict compliance with the requirements of this article
would cause a hardship; provided that a variance may be granted only if the variance
does not adversely affect the spirit or intent of this article.
Finding: Americana Community Bank has two street frontages and already has wall
signage on both frontages. One frontage is Market Street; this sign is
visible from Highway 5 and to northbound traffic along Market
Boulevard. The other frontage is Market Boulevard; this sign is visible to
both north and south bound traffic along Market Boulevard. In addition,
Americana Community Bank is allowed one monument sign to be placed
on Market Boulevard. The sign permit application for this sign is
currently being circulated. The granting of a variance will adversely affect
the spirit and intent of this article. The applicant has adequate visibility
with these approved signs and does not need additional signage.

ACTION
The Chanhassen Planning Commission denies the request for relief from City ordinances
in order to place a non-illuminated sign on a bank drive-thru canopy without street frontage.
ADOPTED by the Chanhassen Planning Commission on this 6th day of September, 2005.
