LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City has limited discretion in approving or denying interim use permits, based on whether or not the proposal meets the use standards outlined in the Zoning Ordinance. Staff is recommending approval of the APPLICABLE REGUA TIONS Chapter 7, Article III, Excavating, Mining, Filling and Grading Chapter 20, Article IV, Division 2, Conditional Use Permits Chapter 20, Article IV, Division 5, Interim Use Permits BACKGROUND On June 9,2003, City Council approved Interim Use Permit #2003-2 to permit grading in excess of 1,000 cubic yards to install a storm water pond and reconfigure the bus circulation route and parking area on the north side of the school ANALYSIS GRADINGillRAINAGE/EROSION CONTROL The applicant is requesting an interim use permit to grade approximately 3,400 cubic yards of material to construct an infiltration basin on the existing school property to reduce downstream erosion and sedimentation along Highway 41 The site drains from east to west, via an existing swale and two storm sewer lines, toward the existing ditch along Highway 41. The swale is proposed to be filled and the 125-foot long existing southern storm sewer will be removed. The plans show a proposed infiltration basin with three rows of 4-inch draintile. The infiltration basin will receive drainage from the east side of the site and the existing building's roof and discharge to the Highway 41 ditch through an 8-inch PVC pipe. The applicant must verify that the existing 24-inch culvert along Highway 41 has sufficient capacity before replacing the private drive entrance. The applicant should be aware that if the fill is coming from and/or going to another site in Chanhassen a separate grading permit will be required for the other property. Staff has not yet received a proposed haul route as required. Staff is recommending that the applicant provide a proposed haul route for review and approval. The hauling operation is anticipated to begin as soon as permit approval is obtained. Permitted hours of operation will be 7:00 a.m. to 6:00 p.m., Monday through Friday, and 9:00 a.m. to 5:00 p.m. on Saturday with no work permitted on Sunday or legal holidays. The applicant should be aware that any off-site grading will require an easement from the appropriate property owner. Staff Erosion control has been shown on the plan in accordance with the City's Standard Detail Plates recommends that an erosion control blanket be installed on the sides of the infiltration basin. An interim use permit expires one year from the date of approval from the City Council. The permit may be renewed, however, on an annual basis subject to City Council approval. The applicant will need to request a formal extension 45 days prior to the expiration date. Financial security to guarantee restoration and erosion control measures will be required with the permit. STORM WATER MANAGEMENT The applicant should provide a cross section for the filtration area showing the elevation of the draintile and the trenches, as well as a cross section of the trench and details of the material used. The drain tile trenches should be lined with drainage fabric (4% to 6% open space) and filled with pea rock at a depth of at least 18 inches and 3 feet wide. The bottom of the entire filtration basin should be backfilled with a mixture of 50% coarse clean sand, 25% compost, 25% loamy topsoil for a minimum depth of 6 inches (from approximately 1034.5 to 1035.0). The rest of the area should be top-dressed with native topsoil. CB-l should be revised to be an open beehive inlet at an approximate elevation of 1037 for handling large storm event runoff if the calculations for rate control work out to avoid overwhelming the filtration area and having long periods (greater than 72 hours) of ponding. EROSION AND SEDIMENT CONTROL Erosion control blanket/turf reinforcement mat (MnDOT Category 5) should be used for restoration of the exposed slope from the emergency overflow to the ditch along Highway 41 within 7 days of final grade. The blanket should be specified and a detail provided. Erosion control blanket will also be needed for any exposed soils south of the private drive within 24 hours of final grade. A seed mix for shaded, wooded areas is needed. A seed mix should be specified in the plan with the rate of application A seed mix for the filtration area and slopes will also be needed. The rip rap at the flared-end section at the south end of the 24-inch pipe south of the private drive should be replaced. Runoff from the storm sewer system from the school should be controlled during construction. The water should be conveyed through a non-erosive means to the Highway 41 ditch through the job site. A temporary slope drain or bypass pipe may be an option. (This could be a flexible temporary pipe placed down the slope to the ditch with energy dissipation at the discharge point.) Erosion control blanket category 2 or 3 is needed for the filtration area within 24 hours of connecting the 18-inch PVC to the basin. The blanket must be applied following a seeding. On February 7, 2006, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Minnetonka School District for an interim use permit for the property located at 6421 Hazeltine Boulevard (Highway 41). The Planning Commission conducted a public hearing on the proposed interim use which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1 The property is currently zoned Office & Institutional District, 01. 2 The property is guided by the Land Use Plan for Public/Semi-Public use. 3 The legal description of the property is: Part of the SW 1,4 of the NW 1,4 of Section 3, Township 116, Range 23, Carver County, Minnesota. 4 When approving an interim use permit the City follows the standards for conditional use permits. The City must determine the capability of a proposed development with existing and proposed uses. The city makes the following findings: a. The proposed use will not be detrimental to the public health, safety, comfort, convenience or general welfare of the neighborhood or the city, but will enhance drainage and erosion issues in the area. b. The proposed use will be consistent with the objectives of the city's comprehensive plan and the Chanhassen City Code. 1 c. The proposed use will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. d. The proposed use will not be hazardous or disturbing to existing or planned neighboring uses. e. The proposed use will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. f. The proposed use will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. g. The proposed use will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. h.
