EXECUTIVE SUMMARY
The Minnetonka School District is requesting an interim use permit to grade
approximately 3,400 cubic yards of material to construct an infiltration basin on
the Minnetonka Middle School West property to address existing erosion
problems and prevent future erosion and sedimentation into the downstream DNR
State Protected Water (132 W).
ACTION REQUIRED
City Council approval requires a majority of City Council present.
PLANNING COMMISSION SUMMARY
The Planning Commission held a public hearing on February 7, 2006, to review the
proposed development. The Planning Commission voted 6 to 0 to approve the
proposed project subject to the conditions of the staff report. The Planning
Commission minutes are item la of the February 27, 2006, City Council agenda.
One question that a neighbor asked was whether trees would be replaced. The
applicant does not intend to replace the trees that washed out. Those trees would be
within MnDOT right-of-way as well as within the electric company easement.
A second question was asked related to the drainage area involved. Staff has
included the drainage area map to this memo. The area involved includes the south
half of the building and a portion of the field. It does not include the bus area or the
parking lot north of the school and fields.
RECOMMENDA TION
Staff and the Planning Commission recommends adoption of the revised motion
on pages 4 and 5 of the Planning Commission staff report approving the Interim
Use Permit #06-03 to permit the grading of approximately 3,400 cubic yards for a
infiltration basin and drainage swales, plans prepared by Larson Engineering of
Minnesota, dated December 19, 2005.

Thank you for the opportunity to review Minnetonka Middle School West. MnjDOT's staff
has reviewed the site plan and has the following comments:
Right of Way,
The site plan does not adequately identify Trunk Highway 41 Right of Way. The final plat
should identify the Right of Way by reference to the appropriate plat(s) and in place
monuments. The distances from the acquisition center line and offset dimensions from the
center line to the edge of the plat should also be identified. Access Control is not marked on
the plat. Access Control should also be identified in the Final Plat. Please direct questions
concerning these issues to Soosan Nichols (651- 634-2166) in MnjDOT's Right of Way
section.
Surface Water Runoff
A drainage permit will be required. Drainage information has been submitted and a
drainage permit is currently pending (Permit #D-2005-11756). Please direct questions
regarding drainage issues to Bryce Fossand (651-634-2408) of MnjDOT's Water Resources
Engineering Section.

PROPOSAL
The Minnetonka School District is requesting an interim use permit to grade approximately 3,400 cubic
yards of material to construct an infiltration basin on the Minnetonka Middle School West property to
reduce downstream erosion and sedimentation along Highway 41.
Staff is recommending approval of the interim use permit subject to the conditions of the staff report.
APPLICABLE REGUATIONS

BACKGROUND
On June 9,2003, City Council approved Interim Use Permit #2003-2 to permit grading in excess of 1,000
cubic yards to install a storm water pond and reconfigure the bus circulation route and parking area on the
north side of the school.
ANAL YSIS
GRADINGIDRAINAGEIEROSION CONTROL
The applicant is requesting an interim use permit to grade approximately 3,400 cubic yards of material
to construct an infiltration basin on the existing school property to reduce downstream erosion and
sedimentation along Highway 41.
The site drains from east to west, via an existing swale and two storm sewer lines, toward the existing
ditch along Highway 41. The swale is proposed to be filled and the 125-foot long existing southern
storm sewer will be removed. The plans show a proposed infiltration basin with three rows of 4-inch
draintile. The infiltration basin will receive drainage from the east side of the site and the existing
building's roof and discharge to the Highway 41 ditch through an 8-inch PVC pipe. The applicant must
verify that the existing 24-inch culvert along Highway 41 has sufficient capacity before replacing the
pri vate drive entrance.
The applicant should be aware that if the fill is coming from and/or going to another site in Chanhassen,
a separate grading permit will be required for the other property. Staff has not yet received a proposed
haul route as required. Staff is recommending that the applicant provide a proposed haul route for
review and approval. The hauling operation is anticipated to begin as soon as permit approval is
obtained. Permitted hours of operation will be 7:00 a.m. to 6:00 p.m., Monday through Friday, and 9:00
a.m. to 5:00 p.m. on Saturday with no work permitted on Sunday or legal holidays. The applicant
should be aware that any off-site grading will require an easement from the appropriate property owner.
Erosion control has been shown on the plan in accordance with the City's Standard Detail Plates. Staff
recommends that an erosion control blanket be installed on the sides of the infiltration basin. All

disturbed areas as a result of construction are required to be sodded or reseeded and mulched within two
weeks of site grading.
An interim use permit expires one year from the date of approval from the City Council. The permit
may be renewed, however, on an annual basis subject to City Council approval. The applicant will need
to request a formal extension 45 days prior to the expiration date. Financial security to guarantee
restoration and erosion control measures will be required with the permit.
STORM WATER MANAGEMENT
The applicant should provide a cross section for the filtration area showing the elevation of the draintile
and the trenches, as well as a cross section of the trench and details of the material used. The drain tile
trenches should be lined with drainage fabric (4% to 6% open space) and filled with pea rock at a depth
of at least 18 inches and 3 feet wide. The bottom of the entire filtration basin should be backfilled with a
mixture of 50% coarse clean sand, 25% compost, 25% loamy topsoil for a minimum depth of 6 inches
(from approximately 1034.5 to 1035.0). The rest of the area should be top-dressed with native topsoil.
CB-l should be revised to be an open beehive inlet at an approximate elevation of 1037 for handling
large storm event runoff if the calculations for rate control work out to avoid overwhelming the filtration
area and having long periods (greater than 72 hours) of ponding.
EROSION AND SEDIMENT CONTROL
Erosion control blanket/turf reinforcement mat (MnDOT Category 5) should be used for restoration of
the exposed slope from the emergency overflow to the ditch along Highway 41 within 7 days of final
grade. The blanket should be specified and a detail provided. Erosion control blanket will also be
needed for any exposed soils south of the private drive within 24 hours of final grade. A seed mix for
shaded, wooded areas is needed. A seed mix should be specified in the plan with the rate of application.
A seed mix for the filtration area and slopes will also be needed. The rip rap at the flared-end section at
the south end of the 24-inch pipe south of the private drive should be replaced.
Runoff from the storm sewer system from the school should be controlled during construction. The
water should be conveyed through a non-erosive means to the Highway 41 ditch through the job site. A
temporary slope drain or bypass pipe may be an option. (This could be a flexible temporary pipe placed
down the slope to the ditch with energy dissipation at the discharge point.) Erosion control blanket
category 2 or 3 is needed for the filtration area within 24 hours of connecting the 18-inch PVC to the
basin. The blanket must be applied following a seeding. Remaining exposed soils on site must be
mulched and seeded or sodded within 14 days of final grade.
The silt fence used must be a City of Chanhassen Type 1 silt fence; monofilament silt fence with metal
T -posts, 6-foot maximum spacing and 3 plastic zip ties in the top 8 inches of the fabric. The silt fence
specified for the filtration area should be labeled as "Installed after drain tile installation." A rock
construction exit pad is needed from the bituminous edge 40 to 50 feet long into the job site. Street
sweeping will be needed within 24 hours should soil be tracked upon paved surfaces. Catch basin inlet
control should be provided for the catch basins adjacent to the school building if tracking of soil
becomes a problem on the paved surfaces.

1. The applicant shall provide the City with a cash escrow or letter of credit in the amount of $5,600.00 to
guarantee erosion control measures and site restoration and compliance with the interim use permit.
2. Verify the existing 24-inch culvert has sufficient capacity before replacing the private drive entrance.
3. The applicant must provide a proposed haul route for review and approval.
4. If fill is coming from and/or going to another site in Chanhassen, a separate grading permit will be
required for the other property.
5. All disturbed areas as a result of construction are required to be reseeded and mulched within two
weeks of site grading.
6. An erosion control blanket must be installed on all sides around the infiltration basin. All disturbed
areas as a result of construction are required to be sodded or reseeded and mulched within two weeks
of site grading.
7. Submit a full size drainage area map.
8. Add City Detail Plates Nos. 3101, 3102, 3103, 5300, 5301 and 5302.
9. Show rock construction entrance per Detail Plate No. 5301. The applicant shall construct and
maintain a rock construction access to the site. Access to the site shall be restricted to this access
point only.
10. The applicant shall obtain and comply with all permit requirements of the Watershed District and
MnDOT.
11. Revise the existing storm sewer flow direction in all plans to match.
12. The applicant shall supply the City with a mylar as-built survey prepared by a professional engineer
upon completion of filling and/or excavation to verify the grading plan has been performed in
compliance with the proposed plan.
13. A plumbing permit must be obtained before installing the storm sewer piping.

INRE:
Application of Minnetonka School District for an Interim Use Permit to permit the grading of
approximately 3,400 cubic yards for the creation of a storm water retention pond - Planning Case
No. 06-03.
On February 7, 2006, the Chanhassen Planning Commission met at its regularly
scheduled meeting to consider the application of Minnetonka School District for an interim use
permit for the property located at 6421 Hazeltine Boulevard (Highway 41). The Planning
Commission conducted a public hearing on the proposed interim use which was preceded by
published and mailed notice. The Planning Commission heard testimony from all interested
persons wishing to speak and now makes the following:
FINDINGS OF FACT
1. The property is currently zoned Office & Institutional District, 01.
2. The property is guided by the Land Use Plan for Public/Semi-Public use.
3. The legal description of the property is: Part of the SW lA of the NW lA of Section 3,
Township 116, Range 23, Carver County, Minnesota.
4. When approving an interim use permit the City follows the standards for conditional use
permits. The City must determine the capability of a proposed development with existing
and proposed uses. The city makes the following findings:
a. The proposed use will not be detrimental to the public health, safety, comfort,
convenience or general welfare of the neighborhood or the city, but will enhance
drainage and erosion issues in the area.
b. The proposed use will be consistent with the objectives of the city's comprehensive
plan and the Chanhassen City Code.

c. The proposed use will be designed, constructed, operated and maintained so to be
compatible in appearance with the existing or intended character of the general
vicinity and will not change the essential character of that area.
d. The proposed use will not be hazardous or disturbing to existing or planned
neighboring uses.
e. The proposed use will be served adequately by essential public facilities and services,
including streets, police and fire protection, drainage structures, refuse disposal, water
and sewer systems and schools; or will be served adequately by such facilities and
services provided by the persons or agencies responsible for the establishment of the
proposed use.
f. The proposed use will not create excessive requirements for public facilities and
services and will not be detrimental to the economic welfare of the community.
g. The proposed use will not involve uses, activities, processes, materials, equipment
and conditions of operation that will be detrimental to any persons, property or the
general welfare because of excessive production of traffic, noise, smoke, fumes, glare,
odors, rodents, or trash.
h. The proposed use will have vehicular approaches to the property which do not create
traffic congestion or interfere with traffic or surrounding public thoroughfares.
1. The proposed use will not result in the destruction, loss or damage of solar access,
natural, scenic or historic features of major significance.
J. The proposed use will be aesthetically compatible with the area.
k. The proposed use will not depreciate surrounding property values.
