Mike Thompson called the meeting to order, in the absence of
Chairman Conrad, at 7:30 p.m.
Replat Request, Two Single Family Residential Lots, Lot 1, Block
1, Minnewashta Creek First Addition, David Hanisch, Public
Hearing.

Waibel presented the staff report and stated that the request was
to subdivide the property to create a single family detached
residential building site to the south of the existing residence.
He also stated that the subdivision of this lot would meet all
the requirements of the ordinances and required setbacks.
Waibel also added that the existing residence has a horseshoe
type driveway with its southerly alignment accessing Minnewashta
Parkway at a point approximately 30 feet south of the proposed
Lot 2. He stated that if this access is planned to continue to
be used by the existing residence, the applicant should be
advised that appropriate access easement arrangements should be
made.
Waibel also wanted the Planning Commission to note that staff
received a letter from a neighbor, Vince Decker, expressing his
opposition to this replat request.
David Hanisch: I don't think there is any validity in Mr.
Decker's statement about decreasing the value of his property
because he won't be able to see the lake. Two homes were built
right in front of my view of the lake and I don't think it has
decreased the value of my property at all.

Tom Merz: will both accesses be off of your cul-de-sac or are
you splitting the property on Minnewashta?
David Hanisch: Minnewashta Parkway is my access.

David Hanisch: Mr. Decker's back yard abuts my lot. He lives on
Leslee Curve. So if I hurt any of his view looking on Lake
Minnewashta it would be from his back yard.
Tom Merz: He has an option to buy the property?
David Hanisch: He has already expressed that interest.
Tom Merz: Is it for sale?
David Hanisch: Well I don't know what I'm going to do with it.
Originally I was going to build a house on there and sell it.
I'm not certain right now.
Ruth Menton: I am two lots away from the Hanisch's and I'm
representing the Riley's and the Decker's tonight. Neither one
of the families could be here due to other obligations and we are
opposed to this property being divided because we do not believe
that it fits in with the other properties that is around there.
It's just a long strip basically. They may have the square
footage but it is a very narrow strip and it's not going to
aesthetically fit in the neighborhood.

David Hanisch: My lot is 2 acres and I have the biggest lot on
the whole side of the block. The lot that is going to be broken
off is larger than anyone of the three (Menton's, Riley's or
Decker's) lots.
Ruth Menton: I would agree with that, but I guess because of the
way it is being sudivided, I am concerned with that. I realize
it meets the requirements of the square footage, it's just the
narrowness, it's just a very unusual shape. I suppose you could
squeeze a house in there, a real modern type that goes the length'
of it. I think that's more what we are concerned with is what is
going to end up in there.
S. Albee moved, seconded by B. Ryan, to close the public hearing,
all voted in favor and the motion carried.
The Commissioners felt that both lot sizes were adequate for the
neighborhood, and that he could be asking to subdivide down to
17,000 or 18,000 square feet instead of 26,000.

J. Thompson moved, seconded by s. Albee to recommend approval of
the Preliminary Plat for Minnewashta Creek Fourth Addition as
depicted on Lot Surveys Co. Inc. Preliminary Plat dated received
Chanhassen Community Development Department July 20, 1983 with
the condition that a sewer and water unit assessment be placed on
proposed Lot 2, Block 1 as per the North Service Area Public
Improvement Project Policy.

tit Residential Area Identification Sign Variance Request, Pleasant
Hill Addition, Curt Ostrom.

Mr. & Mrs. Curt Ostrom
Waibel explained that the applicant is seeking a sign location
and height variance for the residential area identification sign
for the Pleasant Hills Addition. The sign is proposed to be
located in the right-of-way at the southwest corner of the inter-
section of Murray Hill Road and Melody Hill Road.
Waibel stated that the sign ordinance does not allow for the
placement of signs within public right-of-way or over public
easements and also requires signs in residential districts to be
setback 10 feet from the public right-of-way. He added that in
order for the applicant to place this sign or any other sign at
this intersection without a variance, he will need to receive
permission or purchase land from abutting property owners so that
the sign may be erected and setback at least 10 feet from the
right-of-way.

S. Albee stated that she objects to this sign because you're
going to get every neighborhood wanting a sign. She felt a real
estate sign is effective if removed when the lots are sold.
J. Thompson stated that there are so many signs now in neigh-
borhoods and felt that it was beneficial and a very attractive
sign. He would like to see the trees clipped to a certain degree
so that the sign could sit back far enough and still be
recognized. He doesn't object to this request because there are
signs out there now and thinks they are beneficial to the neigh-
borhood.
Waibel stated that the sign ordinance does not discourage these
signs, however it does require they be out of the right-of-way.
B. Ryan asked the applicant who was going to maintain the sign in
three to five years down the road?
The applicant stated that they are going to live in the addition
and are going to take care of it. He stated that the sign will
be made out of cedar and stained, not painted. He felt the
people that live in the area would keep it up should they move.
S. Albee moved to deny the sign permit request based on the
information submitted by staff since it sets precedent and it is
in a City right-of-way and it is not necessary.

J. Thompson moved, seconded by Merz, to recommend that the City
Council grant the variance for the sign request at Pleasant Hill
Addition due to the fact that we (City) asked the applicant to
not cut down trees on the property and that the applicant design
the sign so that it more closely meets the sign height and width.
It would provide aesthetics for the neighborhood and it would be a
benefit and is not precedent setting. Also with the condition
that the sign be maintained and repaired at the discretion of
the City Engineer.
Vote in favor: J. Thompson, T. Merz and B. Ryan. M. Thompson
abstained. S. Albee, naye. Motion carried.
S. Albee stated that she was opposed because she felt the sign
should not be put in the right-of-way and it was not necessary
except for possibly a temporary real estate sign.
Zoning Ordinance Amendment Request, Natural Green Inc.
Waibel summarized the report that this item was reviewed by the
Commission in March and at that time it was tabled until more
information was available about the access design alternatives
and vehicle storage screening. He stated that staff had received
the attached correspondence from MnDOT specifying their minimum
4It requirements for the upgrading of the Natural Green access.
Waibel added that staff recommends that guideline #5 of the Staff
Report of March 4, 1983 be maintained.
J. Thompson moved, seconded by Merz that the Planning Commission
recommend the City and Natural Green enter into negotiations on
a stipulated agreement to be utlimately determined by the court
and that the considerations of said negotiation include the
following suggested guidelines:
1. That Natural Green be permitted to continue its operation for
ten years from the date of adoption of the stipulated
agreement.
2. That Natural Green not enlarge, alter, or expand its use from
its present levels of operation.
3. That Natural Green upgrade their access on Trunk Highway 5 in
accordance with the letter from MnDOT Project Manager Evan R.
Green dated received Chanhassen Community Development
Department July 27, 1983.

4. That all vehicles and equipment used in the business,
excluding employees vehicles, be stored in the area north of
the existing barn on the property and be fully screened from
view of public roads and surrounding residences.

5. That sales of products on the premises are not made to the
general public.
6. That all non-natural matter or material stored within 350
feet of a public road or existing residences shall be
screened from public view by a compact hedge or other opaque
natural growth or within a fence made of natural material of
a natural earthtone color.
7. That business identification signage is not to exceed 12
square feet in area.
8. That the site is to be posted "No Public Sales".
Approval of Minutes
J. Thompson moved, seconded by Merz to approve the minutes of
July 27, 1983 as written. J. Thompson, T. Merz, B. Ryan, and M.
Thompson voted in favor and the motion carried. S. Albee
abstained.
J. Thompson moved, seconded by B. Ryan to adjourn the meeting.
All voted in favor and the motion carred. Meeting adjourned at
8:45 p.m.
