As you know, in May of 2005, the Minnesota Department of Transportation (Mn/DOT) executed a Joint Powers Agreement (Mn/DOT Contract No. 88009) with the SMTC. In this Agreement, Mn/DOT agreed to convey to SMTC the property required to construct the new TH 101 Park and Ride Lot and additional transit oriented development. In return, SMTC agreed to pay the appraised market value of $525,000 for the parcel in Wetland credits needed for the construction of new US 212. The Wetland credits were transferred on December 22"d, 2005. The enclosed DRAFT drawing of the TH 101 Park and Ride site, dated February 7, 2006, shows the approximate Right of Way limits in green highlighted markings. Please note that this differs slightly from the previous DRAFT drawing dated January 30th, 2006. The 100 foot sight corner at MN 101 and CSAH 18 has been removed and has been replaced with a 10 foot setback per the request of Paul Oehme, Chanhassen City Engineer. Reference measurements from the north, west, and south lot lines are also given. These are preliminary dimensions at this time and please be advised that these dimensions may change for the final conveyance. MnlDOT will finalize the Right of Way limits when the Design-Build construction is complete at this site. This is estimated to be during the summer of 2006. Pending successful completion of the Design-Build construction at that time, conveyance of the TH 101 Park and Ride property should happen on or about October of 2006. MnlDOT understands that SMTC needs to proceed with platting and obtaining City approvals for the TH 101 Park and Ride site in order to meet the required Bond Accelerated Project Transit Advantage (BAPTA) project completion dates. As the fee owner of this property, we have no objections to SMTC initiating this approval process. Mn/DOT will be conveying the above mentioned property to SMTC later this year as described above. Lyman Boulevard o 10ft for an urban town home concept. 50 ft building and parking · Highway 101 north of the 101 access 35 ft building and parking o 20 ft for building. This distance will allow a more urban edge in front of the retail buildings. The proposed plan includes enhanced landscaping and pedestrian amenities along the street edge. · Highway 101 south of the 101 access 50 ft building and parking o 20 ft for building. The concept is to continue the urban town home edge around the corner from Lyman, while maintaining a greater setback at the corner of Lyman and 101. · Highway 212 excluding transit and ramps 50 ft building and parking o 45 ft for building. The urban edge concept of the retail buildings moved them slightly closer to the on-ramp ROW . Easterly Project Property Line o No change . 100 ft building and parking . South of 101 access 50 % . Commercial and Transit Facility 70 % o No change in total coverage. The total coverage has been calculated based on the allowable coverage of the housing property (50%x housing site area) and allowable coverage of the transit! commercial (70% x transit! commercial site area). The total allowable, based on this weighted average, is 64.5%. The actual total coverage is 62.5% BUILDING HEIGHT . Maximum Residential Building/Structure Height o No change 35 or 3 stories, whichever is less . Maximum Commercial Building/Structure Height o No change 1 story . Maximum Park and Ride Ramp excluding the 25 ft or 3 stories elevator shaft and stairwell. o 35 ft or 3 levels (2 stories). Excluding elevator and stairs. MnDOT final design raised the busway and on-ramp grade elevation, which in turn made it impractical to have the first level of the deck one-half level below the entrance grade from 101. The first level was raised to match the busway elevation. The maximum height proposed will also allow higher spandrel panels on the upper level to more effectively shield headlights of cars. PARKING · An item not addressed in the PUD was the parking bay dimension. The proposed plan indicates a parking bay dimension of 60 ft (18 ft stall, 24 ft aisle, 18 ft stall). City code generally requires a 26 ft aisle. The proposed parking bay is typical for parking structures and has been used successfully for other suburban parking structures in the Twin Cities metro area.
