LEVEL OF CITY DISCRETION IN DECISION-MAKING: The City has limited discretion in approving or denying conditional use permits, based on whether or not the proposal meets the conditional use permit standards outlined in the Zoning Ordinance. If the City finds that all the applicable conditional use permit standards are met, the permit must be approved. This is a quasi judicial decision. The City's discretion in approving or denying a site plan is limited to whether or not the proposed project complies with Zoning Ordinance requirements. If it meets these standards, the City must then approve the site plan. This is a quasi-judicial decision. CD < CD (L. ~1 Abra Auto Body & Glass Planning Case #06-24 June 20,2006 Page 2 PROPOSAL/SUMMARY The applicant is requesting a conditional use permit to operate an Abra Auto Body and Glass at a site that is used for a Car-X Muffler and Brake Shop (auto services center) and an auto emission testing station. The site is surrounded by the following zonings and uses: N - BH, Highway 5; S- Lake Drive East, BH, vacant, and RSF, single-family homes; E - BH, Abra, Goodyear and car wash; and W - BH, McDonalds. The proposed use would be compatible with the uses immediately adjacent to the site which include auto repair establishments, a car wash and an auto-related restaurant. The pro~osed development expands on the auto related use of the site as well as Chan Haven Plaza 3f Addition. The applicant may continue to lease space to Car-X within the building. The proposed development will comply with the standards established for auto body repair businesses. The applicant's current operation is open from 8:00 a.m. to 6:00 p.m. Monday through Friday and 9:00 a.m. to 12:00 p.m. Saturday. Most repairs are completed on the same day and vehicles left overnight are stored in the building. Only vehicles towed in after hours would be stored outside in the area approved for such storage. Staff is recommending approval of the conditional use permit and site plan for the operation of an Abra Auto Body and Glass, on the proposed site subject to the conditions of the staff report. BACKGROUND On January 24,2000, the Chanhassen City Council approved Conditional Use Permit # 99-5 to permit a Car-X Muffler and Brake. On January 8, 1991, the Chanhassen City Council approved Conditional Use Permit #90-5 approving an emission control testing station in a Highway Business, BH, district; approved Site Plan Review # 90-11 for the emission control testing station; and approved the preliminary and final plat for Chan Haven Plaza 3rd Addition. APPLICABLE REGULATIONS Chapter 20, Article II, Division 6, Site Plan Review Chapter 20, Article IV, Division 2, Conditional Use Permits Section 20-302, Major Auto Repair and Body Shops Chapter 20, Article VI, Wetland Protection Chapter 20, Article XVIII, "BH" Highway and Business Services District Chapter 20, Article XXIII, Division 7, Design Standards for Commercial, Industrial and Office- Institutional Developments Abra Auto Body & Glass Planning Case #06-24 June 20, 2006 Page 3 GENERAL SITE PLAN/ARCHITECTURE ARCHITECTURAL COMPLIANCE Size portion Placement The entrance to the building is contained in a glass and aluminum curtain wall enclosure that projects to the east out from the existing building 16 feet as well as above the existing mansard roof one foot. The rear of the building expansion steps out 21.5 feet from the existing structure. 16 gauge silver anodized aluminum fascia and soffit are located above the building entrance and over the reflective insulated glass on the north end of the building. Material and detail The building material consists of 12-inch scored burnished concrete blocks with integral color tan. Three rows of accent bands of 8-inch by 8-inch glazed dark reddish-brown block run along the base of the building. Additionally, 16 accent squares (2 feet 8 inches by 2 feet 8 inches) of glazed blocks are located around the building. All doors and windows are black anodized aluminum with tinted reflective glass. The existing building is two-toned brick. However, the applicant transitions to the expansion area with both the glass curtain wall and an outdoor trash enclosure. Color Building colors include tan brick and block, brown brick, tan scored and burnished block, reddish-brown glazed block, black anodized aluminum window frames and overhead doors with a greenish tinted reflective glass and a dark brown metal cap flashing and mansard metal seam roof. Signage consists of gold letters. Height and Roof Design The height of the glass curtain wall entrance is 25 feet. The top of the existing mansard roof is 24 feet. The top of the parapet wall is 20 feet 8 inches. These elements allow the building to step vertically to add interest to the building. Mechanical equipment must be screened. No wooded fences are permitted on the roof. Facade transparency 50 percent of the first floor elevation that is viewed from Highway 5 consists of 16 gauge silver anodized aluminum fascia and soffit over reflective insulated glass. The west elevation contains a double row oflandscaping, one on this site and a second on the McDonald's site. The east elevation consists of the curtain wall entrance, the existing building and the overhead doors to the building. The existing building is not being altered. Abra Auto Body & Glass Planning Case #06-24 June 20, 2006 Page 4 Site Furnishing The developer is providing site landscaping that enhances the appearance of the project. Loading areas, refuse area, etc. Overhead doors are limited to the east and south ends of the building. A trash enclosure is proposed west of the existing building. This area is further screened by the use of evergreens on the south side ofthe parking lot. The drop offlocation for damaged vehicles will be limited to the parking stalls in the southwest comer of the lot behind the evergreens. Landscaping The site coverage, at 63 percent hard cover, is two percent below what is permissible under the BH zoning district. The applicant complies with the wetland setbacks. Minimum requirements for landscaping for the Abra Auto Body and Glass development include 2,487 square feet of landscaped area around the parking lot, 10 trees for the parking lot, 5 landscape islands and bufferyard plantings along all property lines. The applicant's proposed as compared to the requirements for all landscape requirements is shown in the following table. The applicant shall protect all existing trees to be preserved during grading and construction. Any trees damaged, removed or killed that were to be saved shall be replaced by the applicant prior to final inspection for the site. The majority of the parking is located to the east of the building, adjacent to the parking for Goodyear. The parking lot is being screened through the use of landscaping. Parking is also provided south of the existing building. The developer has provided wider drive aisles of 47 feet and 30 feet. They would normally be required to be 26 feet to accommodate tow truck movement within the site. Detailed occupancy and building area related code requirements cannot be reviewed until further information is provided. The addition is required to have an automatic fire extinguishing system. The proposed expansion must comply with Minnesota Accessibility Code (MSBC 1341 required). The plans must be prepared and signed by design professionals licensed in the State of Minnesota. In order to meet with the Chanhassen Fire Department/Fire Prevention Division, the builder must comply with the following fire prevention policies: 04,06,07,29,34,36,40,47,49 and 52. STREETS AND SITE CIRCULATION Site access will still be via the private drive which extends from Lake Drive East. The access aligns with the car wash access to the south. Access to the site is provided via a private street shared with the other auto related uses. The site is served from Lake Drive East which is a collector road in the City's comprehensive plan. Based on the Trip Generation, 6th Edition, by the Institute of Transportation Engineers, average trip generation rates for automobile care centers during a.m. and Abra Auto Body & Glass Planning Case #06-24 June 20, 2006 Page 6 p.m. peak hours are 3.22 and 4.01 per 1,000 square feet, respectively. This represents approximately 60 to 74 trips per hour, which would be within the capacity of the site entrance. The pavement width throughout the site is based on the turning radius requirements for vehicles that will service the business, such as garbage truck and delivery vehicles. GRADING/DRAINAGE/ EROSION CONTROL The developer proposes to keep the existing building and re-grade the remainder of the site to accommodate a new paved surface. The impervious surface coverage on the site will be slightly increased. The developer's engineer must verify that the existing stormwater pond southwest of the site has adequate dead and live storage for the additional impervious surface. The developer's engineer must submit data showing that the proposed runoff rate and volume to the existing storm sewer on the north side of the site will not exceed the existing rate and volume. Erosion and Sediment Control A temporary cover of mulch and temporary seed is needed within 14 days of rough and or final grade for any exposed soils or if any exposed soils are not actively worked within a 14-day time period. During installation of the proposed storm sewer infrastructure to the existing storm sewer, temporary caps or plugs may be needed until the installation of the pipes and inlets are complete to prevent sediment from entering the storm sewer. Plans should include a designated concrete washout area and/or plans on how the development will handle the concrete wash water. All perimeter controls and inlet protections must remain in place until 70% of the area is permanently protected by vegetative cover. Wimco-type or other comparable inlet controls should be used and installed within 24 hours of installation ofthe inlets. Additional existing catch basins immediately adjacent to the project must be protected as well. The proposed silt fence along Wetland A should be Type 2 silt fence, as specified in Chanhassen Standard Detail Plate 5300. Type 1 silt fence may be used for the remainder ofthe site. The grading plan should be revised to show the proposed silt fence following the grading limits for the site and should be located outside ofthe required 16.5-foot wetland buffer. All perimeter controls should be inspected by the city and the SWCD prior to grading. Rock construction entrances are typically a minimum of75 feet in length; however, due to existing site conditions, a 75-foot rock construction entrance is not feasible. The applicant should make certain that all construction equipment uses the entire length of the rock Abra Auto Body & Glass Planning Case #06-24 June 20, 2006 Page 7 construction entrance and that the entrance is properly maintained to minimize soil tracking onto streets. Street cleaning of soil tracked onto public streets shall include daily street scraping and street sweeping as needed. WETLANDS Existing Wetlands One aglurban wetland exists on-site. Alliant Engineering delineated the wetland in May 2006. Wetland A is a Type 3 wetland located in the southwest comer ofthe property. The wetland is dominated by reed canary grass and narrow-leaved cattail. No wetland impact is proposed for this basin. A wetland buffer 16.5 to 20 feet in width (with a minimum average width of 16.5 feet) should be maintained around Wetland A. Wetland buffer areas should be preserved, surveyed and staked in accordance with the City's wetland ordinance. The applicant should install a minimum of 4 wetland buffer edge signs, under the direction of City staff, before construction begins and should pay the City $20 per sign. All structures should maintain a 40-foot setback from the edge of the wetland buffer. OTHER AGENCIES The applicant shall apply for and obtain permits from the appropriate regulatory agencies (e.g., Riley-Purgatory-BluffCreek Watershed District, Minnesota Pollution Control Agency (NPDES Phase II Construction Site Permit), Minnesota Department of Natural Resources (for dewatering), Army Corps of Engineers, Minnesota Department of Transportation (for discharge into their storm water infrastructure), Minnesota Department of Health) and comply with their conditions of approval. UTILITIES The developer proposes to wet tap the existing 6-inch watermain within the private drive. The developer must obtain the necessary approvals from the adjacent property owner for disturbing the private drive. The existing service must be abandoned at the main. The wet tap must occur outside the operating hours of the businesses which access the private drive. The business hours noted on June 5, 2006 are as follows: Car Wash: Monday - Friday 7:30 am - 8 pm Saturday 8 am - 6 pm Sunday 10 am - 5 pm Goodvear: Monday - Friday 7 am - 8 pm Saturday 7:30 am - 5 pm ABRA: Monday - Friday 8 am - 6 pm Abra Auto Body & Glass Planning Case #06-24 June 20, 2006 Page 8 Saturday 9 am - 12 pm Based on these observations, the wet tap must occur outside of the construction hours allowed by City Ordinance. The developer's contractor must submit a written request to the City Engineer for the proposed construction time and date for the wet tap. Sanitary sewer service to the proposed building addition will be extended from the existing service within the site. LIGHTING/SIGNAGE The applicant is proposing light poles and base with a total height of 28 feet and a shoebox style light fixture. City code permits pole heights up to 30 feet. Wall-mounted lights are also proposed around the building. All lighting is proposed as high-pressure sodium lamps. The lighting must be shielded to prevent off-site glare. The applicant is proposing to reface the pylon sign along the Highway 5 frontage. The sign area is 63.25 square feet. City code would permit signs up to 16 feet high with 64 square feet of sign area. The applicant is proposing an eight-foot tall monument sign on Lake Drive East. City code permits up to 64 square feet of sign area for such signage. Pylon and monument signs must maintain a 12.5- foot setback from the property lines. The applicant is also proposing individual dimensioned channel-lettered wall signage on the north and east building elevations. While the applicant illustrates the signage, they do not provide the information regarding the sign dimensions and the wall area necessary to determine compliance with city ordinance. Such signage must comply with city code as to size. A separate sign permit shall be required for each sign proposed on the site. CONDITIONAL USE PERMIT Body repair shops must comply with the following standards: Sec. 20-302. Major auto repair and body shops. (1) No unlicensed or inoperable vehicles shall be stored on premises except in appropriately designed and screened storage areas. (2) All repair, assembly, disassembly and maintenance of vehicles shall occur within closed building except minor maintenance including, but not limited to, tire inflation, adding oil and wiper replacement. (3) No public address system. (4) No sales, storage or display of used automobiles or other vehicles such as motorcycles, snowmobiles, or all-terrain vehicles. (5) Disposal of vehicle fluids shall comply with PCA regulations. (6) Facilities for the collection of waste oil must be provided. Abra Auto Body & Glass Planning Case #06-24 June 20, 2006 Page 9 RECOMMENDATION Staff recommends that the Planning Commission adopt the following two motions: A. "The Planning Commission recommends approval of Planning Case #06-24 for Site Plan approval for a 14,430 square-foot expansion to a 4,074 square-foot building, plans prepared by Alliant Engineering, Inc., dated 5/19/06, subject to the following conditions: 1. The applicant shall enter into a site plan agreement with the City and provide the necessary security to guarantee erosion control, site restoration and landscaping. 2. The addition is required to have an automatic fire extinguishing system. 3. The plans must be prepared and signed by design professionals licensed in the State of Minnesota. 4. The expansion must comply with Minnesota Accessibility Code (MSBC 1341 required). 5. A separate sign permit shall be required for each sign proposed on the site. 6. The lighting must be shielded to prevent off-site glare. 7. The builder must comply with the following fire prevention policies: 04,06,07,29,34,36, 40,47,49 and 52. 8. The applicant shall protect all existing trees to be preserved during grading and construction. Trees with less than 60% canopy shall be replaced before landscaping financial guarantees are released. 9. Mechanical equipment must be screened. No wooded fences are permitted on the roof. 10. Wetland buffer areas shall be preserved, surveyed and staked in accordance with the City's wetland ordinance. On June 20, 2006, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of Abra Auto Body - Chanhassen for a site plan review for the property located at 60 Lake Drive East. The Planning Commission conducted a public hearing on the proposed site plan was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak and now makes the following: FINDINGS OF FACT 1. The property is currently zoned Highway Business District, BH. 2. The property is guided by the Land Use Plan for commercial use. 3. The legal description ofthe property is: Lot 1, Block 1, Chan Haven Plaza 3rd Addition. 4. Site Plan: a. Is consistent with the elements and objectives ofthe city's development guides, including the comprehensive plan, official road mapping, and other plans that may be adopted; b. Is consistent with the site plan requirements; c. Preserves the site in its natural state to the extent practicable by minimizing tree and soil removal and designing grade changes to be in keeping with the general appearance of the neighboring developed or developing or developing areas; d. Creates a harmonious relationship of building and open space with natural site features and with existing and future buildings having a visual relationship to the development; e. Creates a functional and harmonious design for structures and site features, with special attention to the following: 1 1. An internal sense of order for the buildings and use on the site and provision of a desirable environment for occupants, visitors and general community; 2. The amount and location of open space and landscaping; 3. Materials, textures, colors and details of construction as an expression ofthe design concept and the compatibility ofthe same with adjacent and neighboring structures and uses; and 4. Vehicular and pedestrian circulation, including walkways, interior drives and parking in terms of location and number of access points to the public streets, width of interior drives and access points, general interior circulation, separation of pedestrian and vehicular traffic and arrangement and amount of parking. f. Protects adjacent and neighboring properties through reasonable provision for surface water drainage, sound and sight buffers, preservation of views, light and air and those aspects of design not adequately covered by other regulations which may have substantial effects on neighboring land uses. 5. Conditional Use Permit: a. Will not be detrimental to or enhance the public health, safety, comfort, convenience or general welfare of the neighborhood or the city. b. Will be consistent with the objectives ofthe city's comprehensive plan and this chapter. c. Will be designed, constructed, operated and maintained so to be compatible in appearance with the existing or intended character of the general vicinity and will not change the essential character of that area. d. Will not be hazardous or disturbing to existing or planned neighboring uses. e. Will be served adequately by essential public facilities and services, including streets, police and fire protection, drainage structures, refuse disposal, water and sewer systems and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. f. Will not create excessive requirements for public facilities and services and will not be detrimental to the economic welfare of the community. g. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, odors, rodents, or trash. 2 h. Will have vehicular approaches to the property which do not create traffic congestion or interfere with traffic or surrounding public thoroughfares. 1. Will not result in the destruction, loss or damage of solar access, natural, scenic or historic features of major significance. J. Will be aesthetically compatible with the area. k. Will not depreciate surrounding property values. 1. Will meet standards prescribed for certain uses as provided in this article 6. RECOMMENDATION The Planning Commission recommends that the City Council approve the conditional use permit and site plan review. Chanhassen City Planning has asked us to design the building addition so that it complements the area and looks like it ties the overall building together in an aesthetically pleasing manner. We have visited the site and reviewed picmres of the brick and attempted to choose a complimentary block color which the elevation represents. The existing Car-X building is a brick building that was built in 1991. The exterior brick is in good condition and looks good. The Brick on the building is a mixture of two tones - light and dark. Because of the age of the brick it would be difficult ifnot impossible to match exterior finishes. The approach taken has been to modify the building width at the point of the new building to break up / separate the building. . The new building addition is naturally broken up by the width, and height change and the roofline where the buildings join is lowered. . On the East side we have separated the buildings with a glass entrance. . On the West side we have extended the building 21 feet and blended in an enclosed trash area. . On the North side we have provided glass architecture and design, These changes dramatically separate the building so that changes in the exterior walls of the building are not apparent. In order to comply with the Chanhassen Fire Department/Fire Prevention Division, I have the following fire code or city ordinance/policy requirements. The site plan is based on available information submitted at this time. If additional plans or changes are submitted, the appropriate code or policy items will be addressed. Fire Marshal must witness the flushing of underground sprinkler service line, per NFP A 13 2002 10.1 0.2.1 2. A [mal inspection by the Fire Marshal before a Certificate of Occupancy is issued. 3. Fire Department access roads shall be provided on site during all phases of construction. The construction of these temporary roads will conform with the Chanhassen Fire Department requirements for temporary access roads at construction sites. Details are available. 4. Onsite fire hydrants shall be provided and in operating condition during all phases of construction. 5. The use of liquefied petroleum gas shall be in conformance with NFPA Standard 58 and the Minnesota Uniform Fire Code. A list of these requirements is available. (See policy #33-1993) 6. All fire detection and fire suppression systems shall be monitored by an approved UL central station with a UL 72 Certificate issued on these systems before final occupancy is issued. 7. An 11" x 14" As Built shall be provided to the Fire Department. The As Built shall be reproducible and acceptable to the Fire Marshal. (See policy #07-1991). 8. An approved lock box shall be provided on the building for fire department use. The lock box should be located by the Fire Department connection or as located by the Fire Marshal. 9. High-piled combustible storage shall comply with the requirements of Article #23 of the Minnesota International Fire Code. High-piled combustible storage is combustible materials on closely packed piles more than 15' in height or combustible materials on pallets or in racks more than 12' in height. For certain special-hazard commodities such as rubber tires, plastics, some flammable liquids, idle pallets, etc. the critical pile height may be as low as 6 feet. 10. Fire lane signage shall be provided as required by the Fire Marshal. (See policy #06-1991). 11. Maximum allowed size of domestic water service on a combination domestic/fire sprinkler supply line policy must be followed. (See policy #36-1994). BOX 147 CHANHASSEN, MN 55317 (952) 227-1150 FAX: (952) 227-1190 CHANHASSEN FIRE DEPARTMENT POLICY SAFETY SERVICES FLAMMABLE AND COMBUSTIBLE LIOUIDS SPRAY FINISHING AREAS AND SPRAY BOOTHS The installation and maintenance of all spray fmishing equipment and booths shall comply with the Minnesota State Fire Code (MSFC), including the following: Size and Location The aggregate area of spray booths shall not exceed 10% of the floor area or basic allowable area allowed for group H-2 occupancy without area increases. Individual booths shall not exceed the lesser of the aggregate size or 1500 square feet. Booths shall be constructed of noncombustible materials. A three-foot clear space is required around all spray booths unless booth can be adequately maintained and it is located against non-combustible exterior wall or I-hour partition. Ventilation Air velocity at open face of booth or booth cross section shall not be less than 100 lineal feet/minute. Termination point of exhaust ducts must comply with MSFC 1504.2.6. Exhaust ventilation systems shall be interconnected to the spraying equipment such that spraying cannot take place unless the ventilation system is operating. Make up air shall be provided and so located as to prevent re-circulating of exhaust air as required by the Fire code and Mechanical Code. Exhaust system intake air ducts shall be provided within six inches of the floor in the spray booth to assist with the ventilation of flammable vapors. Electrical Flammable and combustible liquid spraying areas are classified as Class I, Division I or Class II, Division I hazardous locations by the electrical code. All wiring and equipment must be of an explosion proof type and be approved for hazardous locations. Spray Finishing/Spray Booth Page 1 of3 Electrical wiring and equipment outside of but within 5 feet horizontally or 3 feet vertically of openings in a spray booth or spray room shall be approved for Class I, Division 2 or Class II, Division 2, whichever is applicable. Metal parts of spray booth, exhaust ducts and piping systems shall be electrically grounded in accordance with the National Electrical Code. Fixed lighting in compliance with MSFC Section 1504.5 must be used for illuminating the booth. Automatic Fire Extin2uishin2 System Automatic fire extinguishing system sprinklers or nozzles are required in the spray area, immediately behind the filters, and throughout the duct(s) so as to provide 100 percent coverage. The sprinkler contractor must submit plans and hydraulic calculations for review and issuance of a fire permit. A separate indicating type control valve shall be provided isolating the spray booth sprinkler system from the rest ofthe building's sprinkler system. The valve shall be equipped with a tamper switch and wired to the supervisory alarm side of the fire alarm system. Sprinkler heads shall be protected from spray residue by a lightweight plastic (.003 inch) or paper bag. Activation of a sprinkler head within the spray booth shall activate an interior audible/visual fire alarm device. The Fire Inspector must approve device location. Portable Fire Extin2uisher One 4A60BC rated fire extinguisher must be located with 30 feet of each spray booth. Elimination of I2nition Devices and Accumulations of Combustibles Open flame or spark producing devices shall not be located within 20' of a booth opening. NO SMOKING and NO WELDING signs must be conspicuously posted in the area where spray booths are located. Excessive residue accumulations on booth, ducts, and exhaust fan blades must be promptly removed. Listed disposal cans with lids must be provided for disposal of soiled shop rags. Flammable and Combustible Liquids Flammable and combustible liquid container storage exceeding ten gallons must be located within a UL listed flammable liquids cabinet.
