Findings of Fact CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA FINDINGS OF FACT AND RECOMMENDATION IN RE: The application of the City of Chanhassen Planning Case No. 06-17 On May 16,2006, the Chanhassen Planning Commission met at its regularly scheduled meeting to consider the application of the City of Chanhassen for a wetland alteration permit for filling 0.72 acres of wetland for the construction of a public street and roundabout in the Chanhassen 2005 MUSA Area. The Planning Commission conducted a public hearing on the proposed development which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak. The Planning Commission now makes the following: FINDINGS OF FACT 1) The properties are currently zoned RR (Rural Residential). 2) The properties are guided by the Land Use Plan for Residential Low Density, Residential Medium Density, Office/Industrial and Parks/Open Space. 3) The properties are located in Chanhassen, Minnesota (Sections 22 and 27, Township 116 North, Range 23 West), Carver County. 4) Three wetlands on the subject properties are proposed to be impacted. 5) The total amount of wetland impact proposed is 0.72 acres. 6) The replacement of wetland at a 2: 1 ratio will be accomplished through the creation of wetlands on the subject properties. 7) Section 20-404 of the City Code stipulates that there should be no net loss of wetlands. Finding: The project proposes wetland replacement through the construction of wetlands on-site therefore there will be no net loss of wetlands. 8) Section 20-407 of the City Code requires an applicant for a wetland alteration permit must demonstrate compliance with the sequencing requirements set forth therein. Finding: The proposed project is compliant with the sequencing requirements. 9) Section 20-408 of the City Code requires a wetland alteration permit for the construction of new streets within wetlands. Finding: Upon receipt of a wetland alteration permit, the project will be in compliance with this requirement. 10) The planning report for Planning Case #06-17, dated May 16,2006, prepared by Lori Haak is incorporated herein. RECOMMENDA TION The Planning Commission recommends that the City Council approve the Wetland Alteration Permit for Planning Case #06-17 for the filling of 0.72 acres of wetland for the construction of a public street and roundabout in the Chanhassen 2005 MUSA Area - BLUFF CREEK BOULEVARD ROUNDABOUT. ADOPTED by the Chanhassen Planning Commission this 16th day of May, 2006. CHANHASSEN PLANNING COMMISSION
