John Chadwick SIGNED. If enclosures are not as noted, kindly notify us at once. CITY OF CHANHASSEN CARVER AND HENNEPIN COUNTIES, MINNESOTA CONDITIONAL USE PERMIT #06-09 1. Permit. Subject to the terms and conditions set forth herein, the City of Chanhassen hereby grants a conditional use permit for the following use: Peterson Jacques Farm to develop "Pioneer Pass", an 81-lot single-family home development within the Bluff Creek Overlay District with a variance for encroachment into the primary zone to construct a storm water pond. 2. Property. The permit is for property situated in the City of Chanhassen, Carver County, Minnesota, and legally described as follows: All that property within the Plat of Pioneer Pass 3. Conditions. The permit is issued subject to the following conditions: a. Dedication of OutIots A and G shall be made to the city or a conservation easement shall be established over said outlots. b. Any areas on the property that meet the City's criteria for bluffs (i.e., slope greater than or equal to 30% and a rise in slope of at least 25 feet above the toe) shall be preserved. In addition, all structures shall maintain a 30-foot setback from the bluff and no grading may occur within the bluff impact zone (i.e., the bluff and.Iand located within 20 feet from the top of a bluff). The plans shall be revised to show any areas meeting the City's bluff criteria. c. No alterations shall be permitted within the primary corridor or within the first 20 feet of the setback from the primary corridor without a variance. All structures must meet the 40-foot setback from the primary corridor. 4. Termination of Permit. The City may revoke the permit following a public hearing for violation of the terms of this permit. 1 5. Lapse. If within one year of the issuance of this permit the authorized construction has not been substantially completed or the use commenced, this permit shall lapse, unless an extension is granted in accordance with the Chanhassen Zoning Ordinance. 6. Criminal Penalty. Violation of the terms of this conditional use permit is a criminal misdemeanor.
