The access will also be used for a future City lift station. The applicant is proposing to replace wetland impacts on-site through the construction of 0.83 acres (36,104 square feet) of new wetland, in combination with 0.87 acres (37,921 square feet) of credit through stormwater ponding and upland buffer creation. APPLICABLE REGUA TIONS Sec. 20-404. No net loss. To achieve no net loss of wetland, except as provided under section 20-416 of this article, or authorized by a wetland alteration permit issued by the city, a person may not drain, grade, fill, bum, remove healthy native vegetation, or otherwise alter or destroy a wetland of any size or type. Any alteration to a wetland permitted by a wetland alteration permit must be fully mitigated so that there is no net loss of wetlands. Sec. 20-407 . Wetland alteration. (a) An applicant for a wetland alteration permit must demonstrate that the activity impacting a wetland has complied with all of the following principles in descending order of priority: (5) Replaces unavoidable impacts to the wetland by restoring or, if wetland restoration opportunities are not reasonably available, creating substitute wetland areas having equal or greater public value as set forth in Minnesota Rules 8420.0530 to 8420.0760. Exceptions to this part are calcareous fens, which are subject to Minnesota Rules 8420.1010 to 8420.1070. Sec. 20-408. Permit required. (a) No person shall drain, excavate in the permanent of semipermanent flooded areas of type 3, 4, or 5 wetlands, or fill a wetland, wholly or partially, or otherwise impact wetlands without first having a wetland replacement plan or other determination approved by the city. Draining, grading, excavating, filling, removing of healthy native vegetation, or otherwise altering or destroying a wetland of any size or type requires a wetland alteration permit. Activity in a wetland requiring a wetland alteration permit includes, but is not limited to: (1) Construction of new streets and utilities. (2) Creation of ponds or dams and alterations of the natural drainageways of water courses. This shall only be allowed as part of a mitigation project, or to restore or improve the function and value of the wetland. Sec. 20-409. Filling. When a wetland alteration permit is issued allowing filling in a wetland, filling must be consistent with the Chanhassen Surface Water Management Plan and the Minnesota Wetland Conservation Act. The filling shall not alter the hydrological patterns in the remainder of the wetland if a portion of the wetland remains unless exempted under section 20-416. Where wetland alteration is approved and mitigation is required pursuant to City Code and Minnesota Rules 8420.0540, mitigation must result in an improvement to the wetland function and value. Mitigation plans must address water quality, improvement, and maintenance of preexisting hydrological balance and wildlife habitat. The wetland function and value will include improvement of water quality, maintaining hydrological balance, and provision of wildlife habitat. Mitigation will be performed at ratios required by Minnesota Rules 8420.0546 to achieve replacement of the wetland function and value. BACKGROUND In 2006, the Minnesota Department of Transportation (MnDOT) constructed an extension of Powers Boulevard from Lyman Boulevard to Pioneer Trail in conjunction with the Trunk Highway 212 project. Future development within the City will necessitate a lift station south of the TH 212 on ramp and north of Pioneer Trail along Powers Boulevard. In addition, the TH 212 project needed to provide access to properties south ofTH 212, west and east of the Powers Boulevard extension. Due to Carver County's requirements for separation of access points onto a county road, the curb cut to access to the Erhart property was located adjacent to an existing wetland. The applicant is proposing the construction of a 31-foot wide street to provide access to the western portion of the property, in addition to the future City lift station. WETLANDS Existing Wetlands Two aglurban wetlands exist on-site. They were delineated by Westwood Professional Services in August 2006. Wetland A is a Type 4 wetland located just east of the western property line. It is dominated by reed canary grass and open water. The applicant is proposing 0.58 acres (25,381 square feet) of wetland impact through excavation (9,606 square feet) and filling (15,568 square feet). Wetland B is a Type 2 wetland located approximately 800 feet northeast of Wetland A. It is dominated by spike rush. The applicant is proposing to berm up the southern end of Wetland B to 901.5. This would increase the period of inundation for the wetland and raise the elevation of the wetland boundary to approximately 902.5. At least one species of spike rush is on the list of state threatened plant species. Because the species of spike rush was not identified during the delineation, the dominant spike rush within Wetland B should be keyed out to ensure that the increased period of inundation will not adversely affect a state threatened plant species or a significant natural community. Wetland Mitigation The applicant is proposing the creation of 0.83 acres (36,104 square feet) of new wetland by berming the southern end of Wetland B to 901.5. This would increase the period of inundation for Wetland B and raise the elevation of the wetland boundary to approximately 902.5. The access route must be stable, must avoid damage to significant trees (greater than 10" DBH) and must avoid impacts to natural drainageways and any jurisdictional wetlands that may exist on site that were not delineated by Westwood Professional Services in August 2006. The applicant has not submitted a planting plan for M-l. A planting plan, including invasive vegetation management techniques, species to be planted, proposed planting rates, and the approach to upland buffer restoration, should be submitted prior to final City Council approval. The applicant shall submit a letter of credit equal to 110% of the cost of the wetland creation (including grading and seeding) to ensure the design standards for the replacement wetland are met. The letter of credit shall be effective for no less than five years from the date of final plat approval. The applicant shall submit a cost estimate for wetland creation (including grading and seeding) so the City can calculate the amount of the wetland creation letter of credit. A five-year wetland replacement monitoring plan shall be submitted. The replacement monitoring plan shall include a detailed management plan for invasive non-native species, particularly hybrid cattail, purple loosestrife and reed canary grass. The plans shall show fixed photo monitoring points for the replacement wetland. The applicant shall provide proof of recording of a Declaration of Restrictions and Covenants for Replacement Wetland. A wetland buffer 16.5 to 20 feet in width (with a minimum average of 16.5 feet) shall be maintained around all wetlands. Wetland buffer areas shall be preserved, surveyed and staked in accordance with the City's wetland ordinance. The applicant shall install wetland buffer edge signs, under the direction of City staff, before construction begins and must pay the City $20 per sign. ANALYSIS Steep slopes, distance from Pioneer Trail and significant trees to the south of the proposed access prevent the access from being located further to the south. Distance from the on-ramp for TH 212 prevents the access from being located further to the north. Because the spacing between access points is a safety issue, wetland impacts are unavoidable. A berm is proposed within the existing right-of-way (ROW) for Powers Boulevard. The applicant must receive approval from Carver County for the proposed normal water level (NWL) in Pond 1 and for the proposed berm. The plans depict a "Future Development Area" just south of the TH 212 on-ramp. The property is currently zoned Agricultural Estate District (A-2). The City's 2020 Land Use map shows the property as Residential Low Density. At this time, no development is approved for the "Future Development Area." Any future development and/or requested changes to the land use for this property must undergo the City's development and land use review process(es). When the future development area is developed, the pond may need to be modified in order to meet all stormwater requirements in place at that time. The east-west road that will extend from Powers Boulevard will only serve the future development area identified on the plan and the future lift station. This road will not extend further east. Future utility installation should be a lighter line weight than the proposed storm sewer installation that will be done in conjunction with the wetland alteration. The silt fence along Powers Boulevard should be installed east of the trail at the construction limits. The rock construction entrance should be at least 75 feet in length. The plans should be revised to show the City's standard details 3107, 3108, 5300, 5301 and 5302A. The temporary riser structure must remain in place until the pond and adjacent areas are stable. Erosion control blanket shall be installed on all slopes greater than or equal to 3:1. All exposed soil areas shall have temporary erosion protection or permanent cover year round, according to the following table of slopes and time frames: Type of Slope Steeper than 3: 1 10:1 to 3:1 Flatter than 10: 1 Time 7 days 14 days 21 days (Maximum time an area can remain open when the area is not actively being worked.) These areas include constructed storm water management pond side slopes, and any exposed soil areas with a positive slope to a storm water conveyance system, such as a curb and gutter system, storm sewer inlet, temporary or permanent drainage ditch or other natural or man made systems that discharge to a surface water. Street cleaning of soil tracked onto public streets shall include daily street scraping and street sweeping as-needed. A building permit should be obtained for all retaining walls greater than four (4) feet in height. The applicant shall apply for and obtain permits from the appropriate regulatory agencies (e.g., Minnesota Pollution Control Agency (NPDES Phase IT Construction Permit), Minnesota Department of Natural Resources (for dewatering), Carver County) and comply with their conditions of approval. FINDINGS 1) Section 20-404 of the City Code stipulates that there should be no net loss of wetlands. Erhart Wetland Alteration Permit Planning Case 06-32 October 3,2006 Page 6 of 8 Finding: The project proposes wetland replacement at a greater than 2: 1 ratio through the creation of wetlands on-site and stormwater ponding and buffer dedication for public value credits therefore there will be no net loss of wetlands. 2) Section 20-407 of the City Code requires an applicant for a wetland alteration permit must demonstrate compliance with the sequencing requirements set forth therein. Finding: The proposed project is compliant with the sequencing requirements. 3) Section 20-408 of the City Code stipulates that no person shall drain, excavate in the permanent of semi-permanent flooded areas of type 3, 4, or 5 wetlands, or fill a wetland, wholly or partially, or otherwise impact wetlands without first having a wetland replacement plan or other determination approved by the city. Finding: Upon approval of the wetland alteration permit, the proposed project will be compliant with this requirement. 4) Section 20-409 of the City Code stipulates that wetland fill must be consistent with the Chanhassen Surface Water Management Plan and the Minnesota Wetland Conservation Act. Finding: The proposed project is consistent with the City's Surface Water Management Plan and the Minnesota Wetland Conservation Act. 5) Section 20-412 of the City Code stipulates that wetland mitigation must comply with Chanhassen City Code and the Minnesota Wetland Conservation Act. Finding: The proposed project is consistent with City Code and the Minnesota Wetland Conservation Act. RECOMMENDATION Staff recommends that the Planning Commission adopt the following motion: "The Planning Commission recommends approval of Wetland Alteration Permit #06-32 for the construction of an access road and stormwater pond subject to the following conditions: 1. Because the species of spike rush was not identified during the delineation, the dominant spike rush within Wetland B shall be keyed out to ensure that the increased period of inundation will not adversely affect a state-threatened plant species or a significant natural community. 2. The plans shall be revised to show how M-l will be accessed. The access route shall be stable, shall avoid damage to significant trees (greater than 10" DBH) and shall avoid impacts to natural drainageways and any jurisdictional wetlands that may exist on site that were not delineated by Westwood Professional Services in August 2006. The Planning Commission conducted a public hearing on the proposed development which was preceded by published and mailed notice. The Planning Commission heard testimony from all interested persons wishing to speak. The Planning Commission has made recommendations to the City Council. The Chanhassen City Council now makes the following: FINDINGS OF FACT 1) The property is currently zoned A2 (Agricultural Estate District). 2) The property is guided by the Land Use Plan for Residential Low Density. 3) The legal description of the property is Outlot A, Butternut Ridge Addition, Carver County, Minnesota. 4) Two aglurban wetlands are proposed to be affected by the proposed project and wetland mitigation plan. 5) The total amount of wetland impact proposed is 0.58 acres (25,382 square feet). 6) Section 20-404 of the City Code stipulates that there should be no net loss of wetlands. One of the properties included a farm and home site occupied by the Wallace Krause family. The street ran one half mile north from Pioneer Trail and terminated in a cul-de- sac. The farm site was approximately 100 yards north of the cul-de-sac and had as its primary access from there. The road was maintained by the city of Chanhassen. The farm site and home were abandoned in the late 1970's at which time the city ceased maintaining the road. While no gravel was added, since then the culverts and drainage of the road had been in good condition (to where the Laurent and Erhart access was located) up until the construction of new Powers Boulevard. The road continued to be used by Gil Laurent and Bruce Jueressen for farming. Frank Fox, who purchased the Krause farm site, used it as it was the only access to their property. The Erhart's used it as their only commercial suitable access to the western part of his property where they operate one of two tree growing ranges on their property. The Erhart's have no practical alternative access to this growing range other than that from the old road or now what is Powers Boulevard. The construction of Powers Boulevard overlaid and destroyed the existing road and therefore whatever access the road provided to the four land owners. All four owners used the road and considered the right of way a public asset allowing them use of their property. MnDot did ultimately provide a curb cut to the Erhart property when constructing new Powers Boulevard. However, the access is unusable in its present form in that it immediately leads down to a steep bank and into a pond. This proposal would allow the construction of a driveway from the access provided off of Powers Boulevard to the western part of the Erhart Property. This approximate 10 acres of land is separated from the eastern part of the property by a heavily wooded ridge line and large wetland.
