and plans required by applicable City Ordinance provisions. Before filing this application, you should confer with the
Planning Department to determine the specific ordinance and procedural requirements applicable to your application.
A determination of completeness of the application shall be made within 15 business days of application submittal. A written
notice of application deficiencies shall be mailed to the applicant within 15 business days of application.
This is to certify that I am making application for the described action by the City and that I am responsible for complying with

Dear Mr. Generous:
Attached is an application for Rezoning and Subdivision of Lot 1, Block I of
Zimmerman Fanns t ~l addition consisting of 8.8 acres and Lot 2, Block I of
Zimmennan Farms 1s1 addition consisting of 9.78 acres. Also attached are 16 copies
of pages 1- II of the subdivision plans for this property. This is ajoint application for
subdivision involving two separate owners. The owner of lot I, block I is Carlson
Custom Homes, Inc. and the owners of lot 2, block 1 are Peter and Deanna Brandt, of
7570 Dogwood Road, Chanhassen, MN. The name of the new subdivision is proposed to
be ., The Arbors".
This application is for Subdivision of the combined properties into 22 Residential lots to
be rezoned (0 Residential RI and a Comprehensive Plan amendment for the 3 lots lying
westerly of Dogwood Road extended to the south property line from Large Lot
Residential to RI residential lots. The application is signed by both property owners and
the developer and responsible party for the subdivision is Bruce Carlson, president of
"Arbors Development LLC". Arbors development LLC. will purchase the property
owned by Brandts which lies easterly of the existing Dogwood Road and the property
which lies easterly of the centerline of the proposed new right ofw<lY of Dogwood Road
which lies south of the proposed W. 7Slh Street. This purchase will be done under the
terms of a purchase agreement between Brandts' as sellers and Arbors development LLC.
as the buyer and this land purchase is contingent upon completion of the subdivision and
rezoning of the property and will be closed after the filing of the final plat.
The application involves subdividing the combined properties into 22 residential lots and
3 outlots. OULlot A is the center island of the oversized cul-de-sac, Outlot B will be a
common outlot for the enjoyment of the residents of the new subdivision and Outlot C
will be used for a new storm water detention pond to be constructed. These Outlots will
be owned and controlled by a common homeowners association to be named "'The
Arbors Homeowners Association". The subdivision is designed to preserve most of the
mature wooded area lying north of the proposed W. 78th street and easterly of Dogwood
Road. This will be done by limiting the tree removal by establishing a tree conservation

easement on the rear of Lots} - 8 of block I. Ibis conservation area will be controlled by
the owners association and the City ofChanhassen .
We are also requesting a vacation of the platted 30 foot right of way for Zimmerman
Road from Dogwood R()ad to the east property line of the proposed development This
platted right of way will not be used as it runs through the woods which we are proposing
to preserve with the tree preservation easement. We also will be constructing a sidewalk
'along the north side of W. 78th Street which will allow the vacation of the 20 foot
pedestrian easement along the south boundary line of the proposed development. This
easement is described in document # 117252 Carver County.
The ownership of the three lots lying westerly of Dogwood Road extended to the south
will remain with Peter and Deanna Brandt. The existing homes on lots I. block 3 and lot
4, block 1 will remain. An important part of this subdivision will be the ability for
Carlson Custom Homes to be able to market the existing home on lot 4, block]. This
home was built in 1993 and is served by a private well located on lot 4 and a mound
septic system located on lot 3, block 1. We propose to establish a temporary utility
easement over the rear of lot 3, block I which is the location of this mound system. This
temporary easemenl will automatically expire when the home on lot 4 is connected to the
proposed sewer and water mains to be constructed by the city in Dogwood Road. A
restriction will be filed on lot 4, block 1 which will require the hook up for sewer and
water service as soon as they are completed by the City of Chanhassen. This provision is
important for the financing for payments of the assessment to be levied by the City for
improvements for Dogwood Road and sewer, water and storm sewer service.
The city of Chanhassen is proposing to complete an improvement to Dogwood Road
Ii-om its intersection with W 78th Street North to the improved street on Tanadoona Drive.
This improvement will involve an assessment for the subdivided property for Street
improvements on Dogwood and sewer, water main and storm sewer improvements to
serve the lots in the project. This will require an agreement between the City of
Chanhassen and the aflected properties for the amount of such assessments. The city
staff is preparing a proposal fOr presentation to the City Council regarding these
proposed assessments. We anticipate that an agret::menl can be made regarding the
amount to be assessed against our properties for these proposed improvements.
Please process this application as soon as possible so that we can plan our improvements
to coincide with the Dogwood Road project being done by the City.
